Abstract

This study discusses the concept of legal standing of heirs in Indonesian civil law and its application in Verstek Decision Number 547/Pdt.G/2024/PN Jkt.Pst. The main problem focuses on how the legal position of heirs is determined and its implications for legal certainty and protection of rights. The research method used is juridical-normative with a statutory approach and a case approach. The results of the study show that normatively, the legal standing of heirs is sourced from the provisions of the Civil Code, especially Articles 830, 832, and 833, which provide legal legitimacy to heirs to file a lawsuit. However, in practice, the recognition of legal standing relies heavily on formal proof. In the judgment analyzed, the lawsuit was rejected due to the lack of authentic evidence regarding the marital relationship, despite the existence of a factual family relationship. This shows that there is a tension between legal certainty and substantive justice. Therefore, a balance is needed between a formal approach and the protection of rights so that the law provides not only certainty, but also justice.

Abstract

Democracy is basically a system of government that places the people as the holders of the highest sovereignty and aims to realize social justice as reflected in the values of Pancasila and the 1945 Constitution. However, in practice, democracy in Indonesia still faces serious challenges in the form of strengthening oligarchic practices in the political system. This study aims to analyze the influence of oligarchs on just democracy, the factors that cause oligarchs to continue to develop, and legal measures that can be taken to reduce this dominance. The research uses a normative legal method with a qualitative approach through literature studies. The results of the study show that oligarchic practices influence political processes, public policy, and law enforcement through the dominance of economic and political elites. This condition is strengthened by the weak internal democracy of political parties, high political costs, and low transparency of political funding. Therefore, political funding reforms, strengthening the independence of law enforcement agencies, and increasing public participation are needed to realize a more fair, transparent, and public-interest-oriented democracy.

Abstract

This article discusses the urgency of developing notary integrity as a preventive effort against abuse of authority in notary practice in Indonesia. Notaries as public officials have a strategic role in ensuring certainty and legal protection through authentic deeds, so that integrity is the main foundation in the implementation of their positions. The results of the discussion showed that there were various patterns of abuse of authority, including procedural irregularities, manipulation of the substance of the deed, conflicts of interest, and collusion that had an impact on legal losses for the parties. These irregularities have administrative, civil, criminal, and ethical consequences. To overcome this, a comprehensive strategy is needed through strengthening professional ethics, increasing supervision, transparency, and building a legal culture with integrity. Thus, notary integrity is the key to maintaining professionalism, accountability, and public trust in notary institutions.
