Abstract

Urf (tradition) is an aspect that can not be separated from humans, because ‘urf is an integral whole with actions that are repeatedly practiced and agreed upon by the local community. This tradition becomes a cultural symbol in which the culture (‘urf) in the perspective of fiqh epicemology becomes one of the elements in its formulation. The effort of indigenous jurisprudence mu’âmalât through cultural channels reap a positive response in society that is still recognized its existence. Like the principle of mutual “legowo” (QS 4: 29), the tradition of "maro" in the fiqh of mu’âmalât is called mudharobah, tradis “Ijon” (salam). All of it gets the legitimacy of Jurisprudence because fiqh is responsive and accommodative to the ‘urf, in addition to the basic law of fiqh mu’âmalât is permissible.

Abstract

This article examines the phenomenon of moral erosion in modern society, influenced by globalization, technological advancements, and demographic changes, which contribute to the rise of crime, corruption, and the degradation of social trust. Employing a qualitative research approach based on the theory of Maqāṣid al-sharīʿah and a literature review, this study proposes moral moderation as a crucial strategy for restoring and strengthening social values, particularly in multicultural societies. The findings reveal that moral erosion is marked by a decline in the application of social norms, driven by factors such as globalization and economic disparities, which complicate the integration of values within society. Moral moderation is proposed as a response to balance behavior and prevent extremism, and it is essential in cultivating wise and responsible character. This concept is also relevant in educational and workplace settings, supporting the principles of Maqāṣid al-sharīʿah in safeguarding vital human aspects. The article also explores the relationship between moral moderation and religious moderation in Indonesia, emphasizing the importance of balance and respect for diversity to create a harmonious and tolerant society. This research provides academic contributions and practical recommendations for policymakers and educators to strengthen morality in modern society   Artikel ini meneliti fenomena erosi moral dalam masyarakat modern yang dipengaruhi oleh globalisasi, kemajuan teknologi, dan perubahan demografis, yang berkontribusi pada peningkatan kejahatan, korupsi, dan degradasi kepercayaan sosial. Menggunakan jenis penelitian kualitatif berbasis teori Maqāṣid al-sharīʿah dan studi kepustakaan, penelitian ini mengusulkan moderasi moral sebagai strategi penting untuk memulihkan dan memperkuat nilai-nilai sosial, terutama dalam masyarakat multikultural. Hasil penelitian menunjukkan bahwa erosi moral ditandai oleh penurunan penerapan norma sosial yang disebabkan oleh faktor-faktor seperti globalisasi dan kesenjangan ekonomi, yang mempersulit integrasi nilai dalam masyarakat. Moderasi moral diusulkan sebagai respons untuk menyeimbangkan perilaku dan mencegah ekstremisme, serta penting dalam membangun karakter yang bijak dan bertanggung jawab. Konsep ini juga relevan dalam pendidikan dan lingkungan kerja, serta mendukung prinsip-prinsip Maqāṣid al-sharīʿah dalam melindungi aspek-aspek vital manusia. Artikel ini juga membahas hubungan antara moderasi moral dan moderasi beragama di Indonesia, menekankan pentingnya keseimbangan dan penghormatan terhadap keragaman untuk menciptakan masyarakat yang harmonis dan toleran. Penelitian ini memberikan kontribusi akademik dan rekomendasi praktis bagi pembuat kebijakan dan pendidik untuk memperkuat moralitas dalam masyarakat modern

Abstract

This article addresses the underexplored issue of the neglect faced by Mualaf as zakat recipients post-prophethood, necessitating a contemporary deconstruction of the concept. The objective is to ensure that, despite editorial disparities, the essence of Mualaf aligns with fiqh mainstream. The method involves applying Jaques Derrida's deconstruction theory in a qualitative research framework. The results reveal that the deconstruction of contemporary Mualaf primarily intersects with praxis, emphasizing the awakening of individuals' hearts to rediscover their inherent human nature inclined towards goodness. The implications point to a reconstructed understanding of Mualaf, manifested in practical initiatives such as efforts to revive those ensnared in immoral activities, support mental rehabilitation for individuals affected by addiction, and contribute to the development of isolated communities or tribes in remote areas. This study sheds light on the transformative potential of reevaluating Mualaf in addressing societal challenges and advocates for a nuanced understanding in the discourse surrounding zakat recipients

Abstract

Empiricism is a philosophy doctrine that emphasizes the role of experience in acquiring knowledge in excavation of Islamic law (istidlal) or known as al- tajribat al-hissiyat. This method departs from the induction field observations, and the reality of a society as the main source for legislation jurisprudence by using the senses and the intellect. Imam Shafi’i himself uses this method of digging the legal and produces two different opinions; qaulqadim and qauljaded. Similarly, Ma’had Aly Situbondo, Islamic legal thought the product was much influenced by the reality of Indonesian society. The results of this study found that Ma’had Aly (1) in the excavation law always look at the empirical reality (2) MA successfully develop jurisprudence in Indonesia by revitalizing the epistemology of classical Islamic law, the text diversification, expansion of the concept of ta’wil and reconstruction schools of thought (Madhab).
