Abstract

A journalist competence as intended in the Press Council Regulation is interpreted as knowledge capability without affirmation for journalists who have knowledge of certain scientific disciplines. The meaning is all journalists from any discipline may be recognized as journalists who have the competence to apply the presumption of innocence in reporting. This arrangement in journalistic practice, the press often appears' 'judgmental' in the news because the use of the terms is often interpreted the same, even though the law holds very different meanings, such as the suspect is written as the perpetrator, released is written as free, not accepted is written as rejected, sentenced to trial is written as the judge free it. To prevent the violation of the presumption of innocence principle in reporting, the regulation of journalists' competencies must be emphasized from intellectual abilities and general knowledge to legal knowledge. The affirmation is directly correlated with the news object which is in the realm of law as a function of the press that is obliged to respect the presumption of innocence principle.

Abstract

The concept of punishment is not only emphasized to the subject of the perpetrator, but also the consequences that can be caused need to be accounted. What is the ideal form of punishment for perpetrators of corruption. Does it really need extraordinary efforts to deal with this crime? This article was a type of normative research. The approach used in normative research was the statutory approach, which is an approach taken by examining all laws and regulations related to the legal issues being handled. Refund of state financial losses, especially corruption in Indonesia, is not easy and can be done. The perpetrators of corruption have very strong access to a wide network of power that is difficult for law enforcement to reach. This article describes the regulation of the return of state financial losses due to criminal acts that can be carried out through two legal instruments, namely criminal law instruments and civil law instruments.

Abstract

The appointment of journalists, especially in the field of legal coverage, is extremely urgent and has a wide- ranging impact on conveying information containing truth values, in order to realize a free and responsible press. The manifestation of this responsibility, however, is not accompanied by a system for the appointment of journalists, leading to the dissemination of information that triggers inaccuracies in news, resulting in legal claims, both criminal and civil. These claims continue to occur, and the number of journalists entangled in legal issues also continues to increase. All of this is caused by laxity, both in Law Number 40 of 1999 and in the Press Council Regulations, which do not regulate the standards for the appointment of the journalistic profession. This laxity has triggered the idea of creating a system for the appointment of legal journalists based on the affirmation of a profession that meets professional standards through an ideal model, the regulation of which lies within a legal framework. ___ References Books with an author: Gant, S.
