Abstract

Changing the constitution is a routine part of national governance. In Indonesian society, there are various views regarding the fifth amendment to the constitution. One perspective advocates for maintaining the fourth amendment, while another supports further amendment. A third group advocates for reverting to the original 1945 constitution. However, any amendments should be conducted meticulously, consistently, and comprehensively to enhance the Indonesian constitutional framework. The primary focus should be on returning sovereignty to the people by promoting participatory democracy and good governance.

Abstract

In accordance with the ruling of the Constitutional Court under Decision Number 97/PUU-XI/2013, the Constitutional Court no longer holds the authority to adjudicate disputes concerning the outcomes of direct local elections, as the provisions of Article 236C of Law Number 12 of 2008 are inconsistent with the 1945 Constitution of the Republic of Indonesia. Article 157 paragraph (1) of Law Number 8 of 2015 specifies that the resolution of disputes over regional election results falls directly within the purview of a specialized judicial entity. However, prior to the establishment of such a specialized judicial entity, the Constitutional Court retained the authority to adjudicate disputes over the outcomes of direct regional elections. The authority of the Constitutional Court is a temporary constitutional mandate to address legal vacuums. Hence, lawmakers must promptly establish a specialized judicial entity endowed with the authority to resolve disputes over the outcomes of direct regional elections.

Abstract

Elections serve as a means of implementing the sovereignty of the people, carried out directly, universally, freely, secretly, honestly, and fairly within the Unitary State of Indonesia based on Pancasila and the 1945 Constitution of the Republic of Indonesia. Elections are a manifestation of democracy and an important aspect to be carried out democratically. This research aims to analyze the mechanism for resolving and handling disputes over the results of the Presidential Election by the Constitutional Court according to applicable law. In this study, a normative juridical research method is used with data collection through document studies. The data sources obtained are secondary data, such as journals, articles, papers, news, and laws. This research concludes that the resolution of election disputes can be resolved through institutions, one of which is the Constitutional Court (CC). The CC's decisions have legal force. This research provides a clearer understanding of the CC's decisions and the resolution of Presidential Election disputes through the CC. It is expected to enrich the knowledge of the public, especially for students.

Abstract

As a country that embraces the concept of welfare state, and implicitly can be seen in the general explanation of the 1945 Constitution. The state plays a key role in implementing or realising the protection and promotion of the economic and social welfare of its citizens. In practice, the two are often at odds or have different views and opinions, such as when the state issues regulations or issues certain policies, some citizens reject them because they are not in accordance with the will and needs of the people. In the writing process using normative juridical research methods, which are sourced entirely based on secondary data. In the process of resolving the State Administration, there are two solutions, namely administratively and a lawsuit to the court. In its implementation, the Administrative Court is still less effective because there are no firmer regulations governing the execution of the Administrative Court's decision itself, in fact the execution of the Administrative Court is still difficult to carry out due to the lack of cooperation from the Administrative Court officials.

Abstract

This study aims to evaluate the effectiveness of the Retirement Benefit Program (JHT) in Indonesia in ensuring the welfare of retirees. Through an analysis of internal and external factors, this research identifies the challenges and opportunities in implementing the JHT program and its impact on retirees' welfare. This research method employs a qualitative approach by collecting data through literature review and interviews with relevant stakeholders. The results show that program management and administration, government regulations, community participation, and macroeconomic conditions influence the effectiveness of the JHT program. This study provides a better understanding of the factors affecting the success of the JHT program and offers recommendations for further improvement.

Abstract

Thinking in legal philosophy about the balance between individual freedom and national security in the context of human rights is an important debate in a democratic society. This study formulates the main problem with a focus on legal philosophy thinking on the concept of balance between individual freedom and national security and the policies that can be adopted by the government to maintain the balance. The article presents a review of the various perspectives and theories that underpin different approaches to this issue. While some views emphasize the importance of protecting individual rights as the foundation of democracy, others underline the need for strong measures to safeguard national security. The article also analyzes the various policies that can be pursued by the government to maintain such a balance, seeking common ground between the protection of human rights and the measures necessary to protect state security. It highlights the importance of legal philosophy thinking in guiding fair and balanced policymaking in the context of human rights

Abstract

The concept of responsibility plays a central role in legal philosophy, shaping views on justice in society and legal systems. Since antiquity, philosophers such as Plato and Aristotle have raised fundamental questions regarding individual responsibility in the context of law. They considered whether individuals have a moral obligation to abide by laws and social norms. The literature study method will be the main approach in this research to examine in detail the development of the concept of responsibility in the context of legal philosophy and explore how this concept has been applied in legal practice over time. To determine the differences and similarities in the context of the concepts of individual responsibility and societal responsibility in legal philosophy. This article demonstrates the importance of the concept of responsibility in designing a just and sustainable legal system in a complex and globally connected society

Abstract

Inequality in tax payments is a complex issue that has a significant impact on income distribution and social justice in Indonesia. In the context of this case study qualitative research, secondary data from official sources such as the Directorate General of Taxes, the Central Statistics Agency, and government reports are used to analyze the impact of unequal tax payments. This study shows that unequal tax payments can trigger increasing social and political inequality in society. The impact extends to the development and public services sectors, with a lack of funding available to support welfare programs and necessary infrastructure. Apart from that, unequal tax payments also contribute to greater income inequality in society. However, the Indonesian government has responded to this issue with various policies, including the Economic Equalization Policy (KPE), healthy fiscal policies through the Budget, and the Tax Amnesty program. Taxes are considered a tool for income redistribution, with progressive taxation on individuals with higher incomes. Awareness of the importance of paying taxes fairly and tax policies that support a more equal distribution of income are important steps towards a more just and sustainable society in Indonesia. Collaboration between government, the private sector and society is needed to overcome this problem and achieve better social welfare and maintain social and political stability.

Abstract

In this writing, we critically examine the juridical basis of criminal liability for the Director of PT. Jambi Tulo Pratama regarding his tax evasion. Where by deliberately using a tax invoice. So, from this there is a violation of a tax obligation carried out by the taxpayer (Article 38 of the KUP Law). In the crime of embezzlement there are objective elements and subjective elements. And also the concepts of 3 (three) types of concepts in criminal liability, namely, Criminal Without Fault, Strict Liability (strict liability or absolute responsibility) and Vicarious Liability (vicarious liability). The judge's consideration is also important in a case or problem. The judge's consideration is an important stage in the criminal justice process where the judge examines the facts revealed during the trial. These considerations play an important role in determining whether the defendant is guilty or not and in determining the appropriate punishment. The judge's considerations will be included in a decision, where a good decision will fulfill the 3 aspects in a balanced manner.
