Abstract

Bahwa dalam rangka pelaksanaan Peraturan Daerah Kota Surabaya Nomor 8 Tahun 2006 tentang Penyelenggaraan Reklame dan Pajak Reklame sebagaimana telah diubah dengan Peraturan Daerah Kota Surabaya Nomor 10 Tahun 2009, telah ditetapkan peraturan Walikota Surabaya Nomor 79 Tahun 2012 tentang Tata Cara Penyelenggaraan Reklame sebagaimana telah diubah dengan Peraturan Walikota Surabaya Nomor 76 Tahun 2013 merupakan landasan filosofis dari Peraturan Walikota Surabaya Nomor 21 Tahun 2018 tentang tata Cara Penyelenggaraan Reklame (Perwali No. 21-2018). Dimana hakikat peraturan walikota ini untuk menegaskan mengenai tata cara reklame di Surabaya. Permasalahan hukum Perwali No. 21-2018 merupakan permasalahan hukum yang ahnya dapat diatasi dengan penerapan yang tepat. Dalam arti, Perwali No. 21-2018 harus dilaksanakan secara konsekuen karena reklame merupakan hal yang dapat dilakukan oleh subjek hukum siapapun.

Abstract

A law is said to be good if the law goes according to its function. By all means is to implement the law in law science. The application of the law is a state characteristic of the law in which the application will be achieved legal objectives consisting of legal justice, legal certainty and legal benefit. Starting from this, the development of tourism in Indonesia, especially in the Dutch cemetry in Peneleh Surabaya does not comply with Act No. 10-2009. This development is also influenced by human resources in this case the government of Surabaya is less concerned about the existence of the Dutch cemetry in Peneleh Surabaya. By doing empirism Research, the results are still low desire of Surabaya city government because the location is not located in the city center
