Abstract

Penelitian ini mempunyai tujuan untuk mengetahui bagaimana implemantasi diterapkannya pasal 359 KUHP atas kasus lakalantas oleh hakim pengadilan negeri gorontalo dan bagaimana factor-faktor pertimbangan hakim dalam menerapakan pasl 359 KUHP pada kasus kecelakaan lalu lintas oleh hakim pengadilan negeri gorontalo. Adapaun metode yang digunakan dalam penelitian ini adalah metode normative empiris yakni dengan menggunakan pendekatan undang-undang serta berdasarkan fakta kasus dilapangan yang dengan ini di analisis secara kualitatif dengan menggunakan data primer dan data sekunder yang ada di lapangan yang berupa gambaran yang lebih jelas mengenai penerapan Pasal 359 Kitab Undang-Undang Hukum Pidana Dalam Kasus Kecelakaan Lalu Lintas. Berdasarkan hasil penelitian yang ditemukan bahwa dalam hal hakim menerapkan pasal 359 KUHP yakni Setiap perbuatan yang karena kelalaiannya menimbulkan kematian orang lain maka dipidana paling lama lima tahun . selanjutanya pada Faktor yang menjadi pertimbangan hakim dalam menerapkan pasal 359 KUHP terbagi atas dua yakni; pertama, factor yang memberatkan (terdakwa sebagai seorang Residivice,  pemberian keterangan yang berbelit-belit, tidak ada rasa penyesalan dari dalam diri terdakwa,tidak ada rasa penyesalan dari dalam diri terdakwa, terdakwa malah mencoba kabur dan melarikan diri, tidak lengkap surat berkendara, tidak adanya permohonan maaf dari terdakwa, terdakwa dalam keadaan mabuk, lost control mengemudi oleh terdakwa). Kedua factor yang meringankan(terdakwa bukan residivice, kooperatif dipersidangan, factor usia, permohonan maaf dari terdakwa)

Abstract

This study aims to evaluate the extent to which the National Legislation Program (Prolegnas) Priority is able to achieve the legislative formation targets in terms of both quantity and quality for the period 2015 to 2029. As a planning instrument for national legislation, Prolegnas is expected to serve as a foundation for creating a legal system that is harmonious, effective, and responsive to the needs of society. However, in practice, the implementation of Prolegnas often falls short of expectations. This research employs a normative legal method with statutory and conceptual approaches, and the data are analyzed using a descriptive qualitative technique. The data sources include official Prolegnas documents, legislative performance reports, and relevant academic studies. The findings indicate that the success rate of the Priority Prolegnas in recent legislative periods has ranged only between 13% and 20% of the established targets. This reflects a discrepancy between planning and legislative realization. Several key inhibiting factors include sectoral egos among legislative and executive institutions, low public participation in the legislative process, weak synchronization and harmonization of regulations, and a lack of post-enactment evaluation of legislation. The study concludes that there is a pressing need for more realistic and measurable legislative planning, stronger public engagement, and improved legal substance quality. Prolegnas should not only focus on the quantity of legislation but also prioritize the quality of regulations in order to produce fair, relevant, and effective laws that respond to the dynamic needs of society.

Abstract

This research analyzes the urgency of regulating Artificial Intelligence in supporting the national defense system. This research is a perspective normative legal research. The approaches used include the Legislation approach and the comparative approach. Legal materials consist of primary and secondary legal materials. Legal materials are obtained through library studies. Analysis of legal materials is done through deductive syllogism. Based on the discussion results, it is known that first, the use of Artificial Intelligence in strengthening the national defense system is increasingly developed by countries worldwide. Second, Indonesia still needs to be more optimal in using Artificial Intelligence technology to enhance the national defense system. Third, Indonesia still needs laws and regulations that specifically regulate the use of Artificial Intelligence in the national defense system. Researchers provide suggestions, including, first, forming laws and regulations that specifically restrict the use of Artificial Intelligence in the national defense system. Second, strengthening the position of institutions that specifically handle and are responsible for using Artificial Intelligence in the national defense system. Third, enhancing the capacity and capability of human resources in utilizing Artificial Intelligence in the national defense system. Fourth, prioritize Artificial Intelligence in national defense by allocating the special defense budget.
