Abstract

Abstract: Humans are social creatures, namely creatures that require interaction with other humans. Interaction between humans is not only communication but involves all aspects of life, including the legal aspect. Based on law number 36 of 2014 concerning health workers, it is anyone who devotes himself to the health sector and has knowledge and/or skills through education in the health sector which for certain types requires the authority to carry out health efforts. The purpose of this study was to determine the level of compliance of medical personnel in the implementation of informed consent. In addition, medical personnel understand the role of informed consent in preventing lawsuits and medical disputes. The research method used is a non-doctrinal research method, namely the questionnaire method, direct interviews with medical personnel, and medical record documents, especially informed consent sheets. Problem formulation: 1. How is the compliance of medical personnel with the implementation of informed consent? 2. What is the role of Informed Consent in Medical Dispute Prevention efforts? 3. What is the concept of implementing informed consent in order to prevent medical disputes? The results of the study: "Medical Personnel Compliance with the Implementation of Informed Consent: Study on Prevention of Lawsuits for Medical Disputes at the Central Surgical Installation of PKU Muhammadiyah Sragen Hospital" is that the compliance of medical personnel in the implementation of informed consent has not been carried out in accordance with the existing SOPs, so the role of informed consent consent has not been maximally implemented by medical personnel. The concept of implementing informed consent must be made clearly in accordance with standard procedures that must be filled in completely by medical personnel working in the central surgical installation of PKU Muhammadiyah Hospital Sragen.Keywords: Medical Personnel, Informed Consent, Lawsuits, Medical Disputes.Abstrak: Manusia merupakan makhluk sosial, yaitu makhluk yang  membutuhkan interaksi dengan manusia lainnya. Interaksi antar manusia tidak hanya komunikasi saja tetapi menyangkut seluruh aspek kehidupan, tidak terkecuali aspek hukum. Berdasarkan undang undang nomor 36 tahun 2014 tentang tenaga kesehatan adalah setiap orang yang mengabdikan diri dalam bidang kesehatan serta memiliki pengetahuan dan/atau keterampilan melalui pendidikan di bidang kesehatan yang untuk jenis tertentu memerlukan kewenangan untuk melakukan upaya kesehatan.Tujuan dari penelitian ini adalah untuk mengetahui tingkat kepatuhan tenaga medis dalam pelaksanaan informed consent. Selain itu juga sebagai pemahaman tenaga medis atas peran dari informed consent dalam upaya pencegahan gugatan hukum dan sengketa medis.Metode penelitian yang digunakan adalah metode penelitian Non-Doktrinal yaitu dengan metode quesioner, wawancara langsung kepada tenaga medis, dan dokumen rekam medis, khususnya lembar informed consent.Perumusan Masalah: 1. Bagaimana Kepatuhan Tenaga Medis Terhadap Pelaksanaan Informed  Consent ? 2. Apa peran Informed Consent dalam upaya Pencegahan Sengketa Medis? 3. Bagaimana konsep tentang pelaksanaan informed consent  dalam  rangka mencegah sengketa medis?Hasil Penelitian : “Kepatuhan Tenaga Medis Terhadap Pelaksanaan Informed Consent : Studi Pencegahan Gugatan Hukum atas Sengketa Medis di Instalasi bedah sentral RSU PKU Muhammadiyah Sragen” adalah bahwa kepatuhan tenaga medis dalam pelaksanaan informed consent, belum dilaksanakan sesuai dengan SOP yang ada, sehingga peran dari informed consent belum maksimal dilaksanakan oleh tenaga medis. Konsep pelaksanaan informed consent harus dibuat secara jelas sesuai dengan standart prosedur yang harus di isi lengkap oleh tenaga medis yang bekerja di Instalasi bedah sentral RSU PKU Muhammadiyah Sragen.Kata Kunci : Tenaga Medis, Informed Consent, Gugatan Hukum, Sengketa Medis.

Abstract

Abstrak : Rumah sakit adalah fasilitas pelayanan kesehatan yang menyelenggarakan Pelayanan Kesehatan perseorangan secara paripurna melalui Pelayanan Kesehatan promotif, preventif, kuratif, rehabilitatif, dan/ atau paliatif dengan menyediakan pelayanan rawat inap, rawat jalan, dan gawat darurat. Rumah sakit memiliki hospital bylaws untuk mengatur jalannya pelayanan kesehatan. Tujuan penelitian ini untuk menganalisis kebijakan penyusunan hospital bylaws di Muhammadiyah dan kesesuaian hospital bylaws RSU Muhammadiyah Siti Aminah Bumiayu dengan Pedoman Pimpinan Pusat Muhammadiyah. Metode Penelitian menggunakan penelitian hukum Normatif. Hospital bylaws di bentuk sesuai dengan kebutuhan rumah sakit berpedoman pada Keputusan Menteri Kesehatan Republik Indonesia Nomor 772/ KEMPENKES/2002. Penyusunan hospital bylaws Rumah Sakit Muhammadiyah mempertimbangkan pada Pedoman Pimpinan Pusat Muhammadiyah Nomor 01/PED/I.0/B/2011 tentang amal usaha kesehatan. Kebijakan Muhammadiyah dalam merumuskan hospital bylaws di Rumah Sakit Muhammadiyah dengan menerapkan prinsip-prinsip Islam dalam pelayanan kesehatan di rumah sakit. Kebijakan ini berdasarkan juga nilai-nilai Muhammadiyah yang terkandung dalam hospital bylaws seperti pengaturan kekayaan dan asset, prinsip dan tujuan. Penerapan kebijakan Muhammadiyah masih belum diterapkan secara keseluruhan di RSU Muhammadiyah Siti Aminah Bumiayu, karena baru mengakomordir sebagian ketentuan pada Pedoman Pimpinan Pusat Muhammadiyah.Kata kunci : Hospital bylaws, Rumah sakit, Muhammadiyah Abstract: A hospital is a health service facility that provides comprehensive individual health services through promotive, preventive, curative, rehabilitative and/or palliative health services by providing inpatient, outpatient and emergency services. Hospitals have hospital by laws to regulate the running of health services. The aim of this research is to analyze the policy for preparing hospital bylaws in Muhammadiyah and the suitability of the hospital bylaws at RSU Muhammadiyah Siti Aminah Bumiayu with the Muhammadiyah Central Leadership Guidelines. The research method uses normative legal research. Hospital bylaws are formed in accordance with hospital needs guided by the Decree of the Minister of Health of the Republic of Indonesia Number 772/KEMPENKES/2002. The preparation of hospital bylaws for Muhammadiyah Hospitals takes into consideration the Muhammadiyah Central Leadership Guidelines Number 01/PED/I.0/B/2011 concerning health business charities. Muhammadiyah's policy in formulating hospital bylaws at Muhammadiyah Hospitals is to apply Islamic principles in health services in hospitals. This policy is also based on Muhammadiyah values contained in hospital bylaws such as regulation of wealth and assets, principles and objectives. The implementation of Muhammadiyah policies has not yet been implemented in its entirety at RSU Muhammadiyah Siti Aminah Bumiayu, because it has only partially accommodated the provisions in the Muhammadiyah Central Leadership Guidelines.Keywords : Hospital bylaws, Hospital, Muhammadiyah

Abstract

Abstrak : Hak kesehatan reproduksi merupakan aspek kesehatan penting, terutama bagi perempuan, dengan dampak langsung pada perkembangan sosial dan ekonomi suatu negara. Di Indonesia, masalah kesehatan reproduksi menjadi fokus utama dalam meningkatkan kualitas hidup masyarakat. Meskipun Pemerintah Indonesia telah mengeluarkan Peraturan Menteri Kesehatan RI Nomor 35 Tahun 2014 untuk mengatur Standar Pelayanan Kesehatan Reproduksi, implementasinya di lapangan masih menghadapi sejumlah hambatan yang menghambat perlindungan hak-hak kesehatan reproduksi perempuan. Penelitian ini bertujuan untuk mengeksplorasi implementasi Peraturan Menteri Kesehatan RI Nomor 35 Tahun 2014 dalam praktik pelayanan kesehatan di Indonesia, mengidentifikasi hambatan yang perlu diatasi, serta mengkaji peran perspektif hukum dan aspek normatif dalam meningkatkan perlindungan hak-hak kesehatan reproduksi perempuan. Penelitian ini menggunakan pendekatan kualitatif dengan pendekatan yuridis normatif dan empiris. Analisis hukum mencakup studi dokumen hukum, sementara analisis empiris melibatkan wawancara dengan pemangku kepentingan di bidang kesehatan reproduksi. Hasil penelitian menunjukan Peraturan Menteri Kesehatan RI Nomor 35 Tahun 2014 mengatur berbagai aspek kesehatan reproduksi, tetapi implementasinya bervariasi. Pendidikan dan pelatihan bagi tenaga medis perlu ditingkatkan, komunikasi dengan pasien harus lebih baik, perlindungan hak-hak pasien perlu ditingkatkan, dan edukasi masyarakat tentang hak-hak kesehatan reproduksi perempuan harus lebih intensif. Perspektif hukum memberikan landasan yang kuat bagi perlindungan hak-hak kesehatan reproduksi, sementara aspek normatif membantu mengubah budaya pelayanan kesehatan reproduksi. Kesimpulanya implementasi Peraturan Menteri Kesehatan RI Nomor 35 Tahun 2014 masih perlu perbaikan dalam berbagai aspek. Peningkatan pendidikan, komunikasi, perlindungan hak-hak pasien, dan edukasi masyarakat penting. Perspektif hukum dan aspek normatif berperan dalam meningkatkan perlindungan hak-hak kesehatan reproduksi perempuan dan efektivitas pelayanan kesehatan reproduksi di Indonesia. Penelitian ini memberikan rekomendasi untuk perbaikan layanan kesehatan reproduksi dan pemahaman hukum dalam konteks kesehatan reproduksi di Indonesia.Kata kunci : kesehatan reproduksi, peraturan menteri kesehatan dan hukum kesehatan reproduksi Abstract: Reproductive health rights are a crucial aspect of healthcare, particularly for women, with direct impacts on a country's social and economic development. In Indonesia, reproductive health issues are a primary focus for improving the quality of life. The Indonesian government issued Minister of Health Regulation No. 35 of 2014 to regulate Reproductive Health Service Standards, but its implementation in the field remains challenging. This research aims to explore the implementation of Minister of Health Regulation No. 35 of 2014 in healthcare practices in Indonesia, identify barriers to be addressed, and examine the role of legal perspectives and normative aspects in enhancing the protection of women's reproductive health rights. This research uses a qualitative approach with normative juridical and empirical approaches. Legal analysis involves the study of legal documents, while empirical analysis includes interviews with stakeholders in the field of reproductive health. The research results show that Minister of Health Regulation No. 35 of 2014 regulates various aspects of reproductive health, but its implementation varies. Education and training for medical personnel need improvement, communication with patients must be enhanced, patient rights protection needs strengthening, and public education on women's reproductive health rights should be intensified. Legal perspectives provide a strong foundation for safeguarding reproductive health rights, while normative aspects help transform the culture of reproductive healthcare. In conclusion, the implementation of Minister of Health Regulation No. 35 of 2014 still requires improvement in various aspects. Enhancements in education, communication, patient rights protection, and public education are essential. Legal perspectives and normative aspects play a role in enhancing the protection of women's reproductive health rights and the effectiveness of reproductive healthcare services in Indonesia. This research provides recommendations for improving reproductive health services and legal understanding in the context of reproductive health in Indonesia. Abstract

Information and communication technology has developed very rapidly in various sectors including the health sector, one of which is the electronic medical record (ERME). Electronic medical records have been used in various hospitals in the world as a substitute or complement to health records in paper form. In Indonesia, improvements to rme management have begun to be implemented in several hospitals or health centers. Such is the complexity of the challenges for the implementation of the RME, it is necessary to carry out a readiness assessment prior to the implementation of the RME. Management is not always able to accept challenges and manage effectively and critically in order to make changes to information systems and new technologies. In the end, the new electronic information technology is expected to increase privacy and confidentiality. In the regulation of the Minister of Health of the Republic of Indonesia number 24 of 2022 includes: ownership and contents of electronic medical records; security and protection of electronic medical record data including the confidentiality of the contents of the electronic medical record, waiver of the rights to the contents of the electronic medical record and the storage period of the electronic medical record.

Abstract

Abstrak: Pada umumnya masyarakat di Indonesia sering mengatakan bahwa jika sakit maka mereka pergi ke dokter untuk meminta surat keterangan sakit; Namun, surat keterangan sakit tidak tepat sasaran. Tujuan dari penelitian ini adalah untuk mengetahui kesadaran hukum dokter dalam memberikan surat keterangan sakit palsu kepada pasien di Karesidenan Surakarta dan mengetahui konsep penanggulangan kedepannya atas tindakan dokter dalam memberikan surat keterangan sakit palsu kepada pasien. Kebaruan penelitian ini dibandingkan dengan penelitian sebelumnya. Penelitian ini membahas tentang kesadaran hukum dokter dan konsep kedepannya agar dokter tidak memberikan surat keterangan sakit palsu. Metode penelitian yang digunakan adalah pendekatan kualitatif non doktrinal. Hasil penelitian ini menunjukkan bahwa di Karasidenan Surakarta masih ditemukan masyarakat yang membuat surat keterangan sakit yang tidak sesuai dengan kondisi kesehatannya, padahal sudah diatur. Kesadaran hukum dokter mengenai pengetahuan dan pemahaman masih perlu ditingkatkan. Secara internal, sikap hukum dan perilaku hukum para dokter sudah sangat baik, namun berbanding terbalik dengan masih banyaknya dokter yang membuat surat keterangan sakit palsu. Konsep kedepan untuk menanggulangi tindakan dokter dalam memberikan surat sakit palsu kepada pasien adalah dengan mengubah peraturan hukum, mengubah mekanisme penerbitan surat keterangan sakit secara detail, meningkatkan integritas dokter, dan meningkatkan partisipasi masyarakat.Kata kunci: dokter, kesadaran hukum, surat keterangan sakit Abstract: In general, people in Indonesia often say that if they are sick, they go to the doctor to ask for a sick certificate; however, sick certificates are not on target. The purpose of this study was to determine the legal awareness of doctors in providing false sick certificates to patients in Karesidenan Surakarta and to find out the future concept of countermeasures for doctors' actions in providing false illness statements to patients. The novelty of this research is compared to previous studies. This study discusses the legal awareness of doctors and future concepts so that doctors do not provide false sick certificates. The research method used is a qualitative non-doctrinal approach. The results of this study indicate that in Karasidenan Surakarta it is still found that people have made sick certificates that are not by their health conditions, even though they have been regulated. Doctors' legal awareness regarding knowledge and understanding still needs to be improved. Internally, doctors' legal attitudes and legal behaviour are excellent, although this is in contrast to the fact that some still make fake sick certificates. The future concept of tackling doctors' actions in giving counterfeit sick notes to patients is changing legal regulations, changing the mechanism for issuing sick certificates in detail, increasing the integrity of doctors, and increasing community participation.Keywords: doctor, legal awareness, sick certificate

Abstract

The prevalence of drug abuse cases is increasing day by day. This is accompanied by the high number of cases of drug crime. In handling drug-related cases, a medical assessment is required from a psychiatrist or a doctor authorized to provide an assessment. This article uses a research method in the form of a literature study. From this literature study it was found that medical assessment can play a role in the judicial process, protect suspects and the environment, and can play a role in improving drug handling. In Indonesia, sanctions for narcotics cases have a two-way system, namely criminal sanctions and operational sanctions. Criminal sanctions are used to prevent abuse and illicit traffic of Narcotics and Narcotics or their ingredients and rehabilitation is a form of action-consequence of drug abuse. Based on the law, judges can decide or order drug addicts to undergo treatment and/or treatment. Through an integrated assessment, which involves the medical team and the legal team. Judgments are viewed from a legal and medical point of view, so that more and more decisions are starting to include not only criminal decisions, but are also accompanied by medical rehabilitation decisions for drug users.
