Abstract

Tulisan ini berjudul “Kekuatan Hukum Mediasi Sebagai Salah Satu Alternatif Penyelesaian Sengketa Pertanahan”. Mediasi sebagai salah satu cara Penyelesaian Sengketa Alternatif yang diatur dalam Undang-Undang No. 30 Tahun 1999 Tentang Arbitrase dan Penyelesaian Sengketa Alternatif. Mediasi adalah proses penyelesaian sengketa para pihak yang dibantu oleh pihak ke tiga yang netral yang tidak memihak sebagai fasilitator dimana keputusan tersbut diambil berdasarkan kesepakatan para pihak yang bersengketa. Mediasi ini dapat dipergunakan untuk sengketa pertanahan yang pihak ketiganya adalah BPN dan kekuatan hukum dari pada akta kesepakatan melalui mediasi ini sama kuatnya dengan keputusan pengadilan karena disepakati oleh kedua belah pihak. Kata Kunci : Kekuatan Hukum, Mediasi, Sengketa Pertanahan

Abstract

Government employees are the public servants who faithfully on Pancasila, theConstitution of the republic of Indonesian 1945 and the government and united, wellminded, disciplined, dignified, efficient, high quality and are aware of itsresponsibilities to the state. In an effort to improve the discipline of government havemade the civil government regulation. In the government regulation amended byGovernment Regulation Number.53 of2010 on Civil Servant Discipline. Civil ServantsDisciplinary Rules are rules governing the obligations, prohibitions, and penalties ifobligations are not complied with or violated by the Civil Servant. However ,from theyears 2010-2011increaseddisciplinarycivil servant in the Department of Food Crops ofBali. Most of the in disciplinary is because of the internal factor of the civil servantdaily.

Abstract

Public Servants have a very important role as a servant to hold the elements of thestateapparatus of government and development in order to achieve the purpose of thestate. Theexistence of a decision or lack of reasonable policy or self harm Servants,certainlypsychologically able to influence, disrupt, and prevent concentration in carryingout his duties asa Public Servant. Employment disputes as far as possible within the scopeof the work unit intansiissuing disciplinary decisions of moderate and severe levels in theform of dismissal with respectnot his own request and not with respect as Civil Servants(hereinafter abbreviated PNS) by thehead coach or official personnel both at central andlocal levels. Dispute among Civil Servants inthe presence of a decision or lack ofreasonable policies or adverse Servant can inhibitconcentration in duties as officers of theState. The formulation of the problem posed is whetherthe cause of employment disputesand legal actions that can be taken how civil servants due tothe imposition of sanctionsagainst him.
