Abstract

Banyak kasus malpraktik yang terjadi dari tahun 2006 sampai 2012, tercatat ada 182 kasus kelalaian medik dan malpraktik yang terbukti dilakukan oleh dokter di Indonesia, hal ini menyebabkan perlindungan hukum terhadap pasien sebagai konsumen pelayan medik sangat penting untuk didiskusikan. Kurangnya pemahaman terhadap hak tentang pasien menyebabkan pasien memiliki posisi yang lemah sebagai konsumen pelayan publik. Dalam jurnal ini, akan dibahas tentang hubungan antara pasien dan dokter, hak pasien dan penyelesaian sengketa malpraktik. Melalui penelitian ini diharapkan dapat memberikan informasi singkat untuk dapat memahami lebih baik tentang hak-hak pasien dan tindakan apa yang dapat diambil jika mengalami malpraktik dalam pelayanan kesehatan.

Abstract

Beliefs about the supernatural powers are a culture of the community. Belief in supernatural powers has led many paranormal practices. In this study will be discussed two issues those criminalization supernatural deeds in criminal law and public belief system of supernatural powers. Oracle can have both positive and negative connotations. Negative behavior of the oracle is known as witchcraft (“santet”). The criminalization of witchcraft in the draft Penal Code is still debated. Provisions concerning the mystical act have stipulated in Article 545, 546, and 547 of the Criminal Code. Belief in a supernatural power is not separated from the culture of the community who believe in the power of an object, “religiomagis” nature in customary law and the belief in the existence of spirits in the scriptures.

Abstract

AbstractCorruption is seen as a serious crime because it has eliminated the economic and social rights of the people. People really hate corruption, they even condemn the criminals who have stolen state funds. On the other hand, people have the habit of giving bribes to get what they want, such as to become civil servants, speeding up the processing of documents and others. This study examines the policy of combating corruption and perceptions of corruption.Indonesia’s anti-corruption policy rests on three elements in the legal system, namely the legal substance, legal structure and legal culture. Indonesia had the rule of law and law enforcement are adequate to combat corruption, but the problem lies in the commitment in law enforcement. The legal culture of society have an important role in the prevention of corruption. Community on the one hand the fight against corruption, but on the other hand it supports corruption. Bribery done to facilitate their getting his wish.
