Abstract

Children have a strategic position in ensuring the survival of a nation, so that legal protection for children is a state obligation as stated in Article 28B paragraph (2) of the 1945 Republic of Indonesia Constitution and the Convention on the Rights of the Child which has been ratified through Presidential Decree Number 36 of 1990. In the context of criminal justice, children involved in narcotics crimes must receive legal treatment in accordance with the principle of the best interests of the child. Law Number 11 of 2012 concerning the Juvenile Criminal Justice System has regulated that for children who are sentenced to imprisonment and fines, the fine must be replaced with job training. However, in practice, there is still a discrepancy between normative provisions (das Sollen) and the reality of law enforcement (das Sein), such as in Decision Number 1/Pid.Sus-Anak/2014/PN.Pli and Decision Number 98/Pid.Sus-Anak/2020/PN.Plg, which imposes a fine on children without applying a substitute punishment in the form of job training as mandated by the SPPA Law. The formulation of the problem raised in this study is how the criminalization system for children in conflict with the law in cases of drug abuse and how to enforce the law against children in conflict with the law in cases of drug abuse. In this study, the author uses the double track system theory and law enforcement theory as analytical tools in this study. The research method used is a normative legal approach. This study uses a statute approach, a case approach, a conceptual approach, and an analytical approach, which in principle are sourced from primary legal materials consisting of laws and judges' decisions, secondary legal materials consisting of books, research results, articles and tertiary legal materials from libraries, articles and websites. The legal material analysis technique uses grammatical interpretation techniques.. The results of the study on the punishment of children in several cases of drug abuse have not fully implemented the principle of restorative justice as mandated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA), this shows a disparity in court decisions. In several cases, children who were proven to be abusers were sentenced to prison and large fines, while in other cases children who acted as couriers or intermediaries were not subject to fines. The suggestion in this study is that it is necessary to harmonize and synchronize Law Number 35 of 2009 concerning Narcotics with Law Number 11 of 2012 concerning SPPA as a legal basis so that there is no longer the application of fines that are not in accordance with special provisions in juvenile justice, and in addition, it is necessary to increase the capacity and understanding of law enforcement officers, both investigators, public prosecutors, and judges, regarding the application of the principle of the double track system and restorative justice in handling child cases, especially in cases of drug abuse

Abstract

Human Trafficking is the act of recruiting, transporting, harboring, sending, transferring, or receiving a person by means of threats of violence, use of violence, kidnapping, confinement, forgery, fraud, abuse of power or vulnerable position, debt bondage or giving payments or benefits, so as to obtain the consent of a person who holds control over another person, whether carried out within the country or between countries. The formulation of the problem in this study is How is the Legal Protection for victims of the Crime of Human Trafficking and How is the Criminalization of the Crime of Human Trafficking in Criminal Law. The theory used in this study is the theory of Legal Protection and the theory of Criminalization. The method used in this research is a normative juridical research type, namely library legal research or secondary data with primary, secondary, and tertiary legal material sources. The research approaches used are the statutory approach, case approach, analytical approach, and conceptual approach. The legal material collection technique is carried out by identifying and inventorying positive legal regulations, book literature, journals, and other legal material sources. The legal material analysis technique is carried out by legal interpretation (interpretation), grammatical interpretation, and systematic interpretation.The research findings show that legal protection for victims of human trafficking, based on Law Number 21 of 2007, regulates the protection of victims of human trafficking as an important aspect of law enforcement. Furthermore, Article 48 provides for restitution for victims, but its implementation still faces various obstacles. Specifically, the victim's right to restitution lacks procedures that simplify the restitution application process and the provision of substitute fines for convicts. Many perpetrators' sentences are still not appropriate in practice, with court sentences often falling far below the maximum penalty. This creates a gap between legal norms and their implementation, and leads to dissatisfaction and a sense of injustice for victims. Criminal penalties tend to be minimal, and some are below the minimum.

Abstract

The application of criminal sanctions against child recidivists who conflict with the law in the juvenile criminal justice system in Indonesia. The background of the study departs from the phenomenon of increasing cases of children who commit repeat crimes, giving rise to a debate about the effectiveness of the juvenile criminal justice system that promotes the principle of restorative justice. This study aims to analyze how law enforcement is carried out against child recidivists, how criminal sanctions are imposed, and the extent to which the application of these sanctions is able to cause a deterrent effect without neglecting the best interests of children.  The research employs a normative juridical approach with descriptive analysis, reviewing positive legal norms, court decisions, and relevant literature on theories of punishment and law enforcement. The findings reveal that law enforcement against juvenile recidivists faces a dilemma between protecting children’s rights and the need to ensure deterrence. Judges tend to impose heavier sentences on juvenile recidivists, yet still consider the ultimum remedium principle. The effectiveness of law enforcement is influenced by legal substance, legal structure, and legal culture, thereby requiring synergy among law enforcement agencies, families, and society.  This study concludes that the application of criminal sanctions on juvenile recidivists should be progressive and proportional, combining deterrence with rehabilitation and social reintegration. Therefore, specific legal provisions on handling juvenile recidivists are necessary, alongside consistency from law enforcement officers in applying restorative justice principles to prevent children from re-engaging in criminal acts

Abstract

Restorative Justice is utilized as an approach to resolve criminal cases involving offenders, victims, families, and relevant parties to seek a fair resolution, prioritizing rehabilitation over retribution. The Guidelines for Narcotics Rehabilitation based on Restorative Justice guide Prosecutors in the stages of pre-prosecution, prosecution, and rehabilitation supervision. In practice, there are differences in the interpretation and application of the dominus litis principle by Prosecutors in handling narcotics cases with a restorative justice approach. The limitations in understanding and applying the dominus litis principle can affect the consistency and uniformity of rehabilitation policies provided by the Prosecutor's Office in narcotics criminal cases. Moreover, this issue can also lead to inconsistent treatment of narcotics defendants in need of rehabilitation. The issue concerning the authority of the prosecutor's office in implementing rehabilitation policies in narcotics criminal cases with a restorative justice approach and enforcing the law in narcotics criminal cases with a restorative justice approach. This research method employed a normative juridical research type using legislative and conceptual approaches as the basis for analysis in addressing the issues. The conceptual approach used includes the concept of narcotics rehabilitation by the Indonesian Prosecutor's Office based on theories of authority and law enforcement, serving as analytical tools in addressing the issue of prosecutor's authority in law enforcement rehabilitation in narcotics criminal cases. In conclusion, the Prosecutor's Office has the juridical authority to conduct rehabilitation in narcotics criminal cases with a restorative justice approach. This is regulated in the Indonesian Prosecutor's Regulation Number 18 of 2021. Prosecutors play a central role in controlling cases, from investigation to court judgment execution, based on the dominus litis principle. Public prosecutors have a significant role in ensuring that medical and social rehabilitation efforts are carried out appropriately by designated rehabilitation institutions or health services, as well as in issuing warnings and taking further action if suspects fail to comply with the prescribed rehabilitation process. Law enforcement in cases of narcotics abuse requires a thorough understanding and strict application of the requirements based on the Indonesian Prosecutor's Regulation Number 18 of 2021

Abstract

Based on Law No. 28 of 2014 concerning copyright, video content uploaded through the Youtube platform can be included in creations that are protected by law, because they are included in cinematographic works and can be categorized as intangible movable objects and can be used as objects of fiduciary security. In practice, both banks and non-bank financial institutions find it difficult to accept Youtube video content as an object of guarantee for financing agreements, this is because creditors do not feel that Youtube video content is an object that provides legal certainty if the debtor defaults. How does the fiduciary credit guarantee apply to youtube content Copyright? What is the legal certainty of fiduciary credit guarantee regarding youtube content Copyright? The theory used in this research is the theory of legal certainty Gustav Radbruch and The Theory of legal guarantees J.Satrio. The method used in this study is normative juridical research, namely legal research literature or secondary data with sources of primary, secondary and tertiary legal materials equipped with interviews. The research approach used is the approach of legislation and case approach and legal material collection techniques carried out by identifying and inventorying the rules of positive law, literature books, journals and other legal sources. For Technical Analysis of legal materials is carried out by systematic legal interpretation and methods of legal construction. From the results of the study, it can be concluded that youtube content is included in cinematographic works and can be categorized as intangible movable objects and can be used as objects of fiduciary security as Article 16 Paragraph (3) of the copyright law, but in practice there is still a need for arrangements and regulations related to the receipt of collateral in the form of intellectual property. Abstract

The current development of information technology has certainly had a huge influence on social life in Indonesia. With such rapid progress in the field of technology and information, it is like a double-edged sword because apart from having a positive impact, it can also have a negative impact, one of which is the emergence of cybercrime online dissemination of personal data. The research method used is a normative juridical research method, while technical data analysis uses a statutory approach and a case approach, as well as using legal protection theory and punishment theory. The problem formulation taken is how to regulate cybercrime victims disseminating personal data online in Indonesia and what legal protection there is for cybercrime victims disseminating personal data online in Indonesia. The research results showed that legal protection for cybercrime victims of online dissemination of personal data in Indonesia has been regulated based on Law no. 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE Law), whose criminal sanctions prioritize punishment for the perpetrator only to provide a deterrent effect, and have not provided a direct impact or benefit for the victim. And in order to provide human rights protection for cybercrime victims of online distribution of personal data in Indonesia, apart from being subject to imprisonment and/or fines, perpetrators may also be subject to additional penalties in the form of confiscation of profits and/or assets obtained or proceeds from criminal acts. , and payment of compensation for victims, such as additional criminal sanctions for confiscation of profits and/or assets obtained or proceeds from criminal acts and payment of compensation for victims. Thus, to realize the Integrated Criminal Justice System, law enforcers not only impose prison sanctions and/or fines on perpetrators, but can also impose additional criminal sanctions which can have a direct impact or benefit for victims. And the House of Representatives and the President need to revise the ITE Law, especially by adding additional criminal provisions in the form of confiscation of profits and/or assets obtained or proceeds from criminal acts and payment of compensation. So that this law can really provide better legal protection and can also be felt directly by victims of cybercrime spreading personal data online in Indonesia

Abstract

Bullying is a deliberate, repeated, and systematic behavior aimed at causing physical or psychological discomfort to others, often carried out for the perpetrator’s own amusement in witnessing the victim’s suffering. Bullying can take the form of mocking, insulting, making offensive remarks, or spreading false stories that isolate the victim or make them the subject of ridicule, leading to feelings of inferiority, fear, and distress. This behavior is increasingly concerning, as it affects various groups ranging from children to adults and can result in severe physical and psychological consequences, including fatal actions such as suicide. This study aims to analyze the effectiveness of criminal law in addressing bullying in Indonesia and to explore future normative concepts of criminal sanctions that combine both repressive and restorative approaches. The research problems raised in this study are. the current concept of criminal sanctions against bullying perpetrators, and the normative concept of criminal sanctions needed to ensure legal certainty in the future. Theories used in this research include the theory of punishment and the theory of legal certainty. he research method used is a normative legal approach. This study uses a statute approach, a case approach and a comparative approach which in principle originates from primary legal materials consisting of laws and judges' decisions, secondary legal materials consisting of books, research results, articles and tertiary legal materials from libraries, articles and websites. The legal material analysis technique uses grammatical interpretation techniques. This study reveals that the current concept of criminal punishment for bullying perpetrators in Indonesia adopts a mixed theory that combines retribution, prevention, and rehabilitation. However, the legal framework remains fragmented and unsystematic, leading to legal uncertainty and inconsistent law enforcement. To ensure legal certainty and public protection, a specific and comprehensive regulation on bullying is needed, including both criminal sanctions and additional penalties such as account suspension, content removal, temporary social media bans, public apologies, restitution, community service, and revocation of certain rights. The study also recommends the establishment of anti-bullying response units in educational institutions and workplaces, integrated with law enforcement and relevant agencies, to provide early detection, reporting mechanisms, and appropriate follow-up for bullying cases
