Abstract

The District Court is a general court institution that handles criminal and civil cases which is domiciled at the district or city level, while a state institution is a body that has the authority and duties for certain matters and is specific in nature, such as the KPU which functions as an organizer of general elections that cannot be separated from conflicts or disputes in the stages of holding elections, in this case there are issues that cause dynamics, namely the result of a lawsuit filed by the just and prosperous people's party in suing the KPU because the Prima party did not pass as a political party candidate for the 2024 election. This type of research is normative research. (legal research), namely placing law into a system of norms. This research uses a statutory approach (statute approach) and an analytical approach (analitycal approach). The authority of the district court in deciding disputes over the general election process that occurred as a result of the failure of political parties participating in the election with the KPU is beyond the competence of the general court and claims cannot be accepted. The election law regulates three matters relating to election dispute resolution: first, settlement Election process disputes are conducted through the election supervisory body (Bawaslu). Second, the settlement of election disputes is carried out by legal means through the State Administrative Court (PTUN) because every decision issued by the KPU is a State Administrative decision. Third, the settlement of disputes over the results of general elections is carried out through the Constitutional Court as regulated by the 1945 Constitution.

Abstract

Corruption is a serious threat to development, social stability and public trust in government. The involvement of members of the military in corruption cases is a serious concern, given the strategic role played by the military in maintaining national security. This article describes the urgency of judicial connectivity between the Corruption Eradication Commission (KPK) and the Indonesian National Armed Forces (TNI) in handling corruption cases involving members of the military. The research uses normative legal analysis methods by collecting data through literature studies, recognizing the legal responsibilities of military members in cases of corruption under existing regulations. This article also analyzes legal challenges that arise, such as hierarchies and loyalties within military institutions, which can affect the judicial process. The establishment of a judiciary connection between the KPK and the TNI is considered important to maintain the integrity of military institutions, ensure transparency in the handling of corruption cases, and strengthen the eradication of corruption. overall. The advice given is to strengthen cooperation between the KPK and the TNI and to increase the capacity of connectivity court judges to respond to legal challenges that arise in the handling of corruption cases for members of the military.

Abstract

This study aims to analyze the impact of the Constitutional Court’s (MK) Decision No. 62/PUU-XXII/2024 on Indonesia’s presidential election system, particularly regarding the removal of the presidential candidacy threshold. The research methodology employed is a normative juridical approach, analyzing laws, judicial decisions, and legal doctrines. The study utilizes primary legal materials, including the 1945 Constitution of the Republic of Indonesia, the Election Law, and relevant Constitutional Court decisions, as well as secondary legal materials such as legal journals, books, and academic articles. Data was collected through library research and qualitatively analyzed to understand the legal implications and political impacts of the decision. The results indicate that this decision opens broader opportunities for presidential candidates to run without having to meet the support requirements outlined in Article 222 of the Election Law, thus increasing competition and choices for voters. However, this change may also lead to greater political fragmentation and reduced political consolidation, which could threaten post-election governmental stability. The study provides recommendations related to enhancing democracy education, improving the two-round election system, strengthening the roles of the General Elections Commission (KPU) and Election Supervisory Agency (Bawaslu), as well as monitoring political fragmentation following the electoral system change. The findings are expected to provide solutions for policymakers in designing a more inclusive and efficient election system in Indonesia.
