Abstract

Introduction: Changes in the industrial revolution have increased the risk of copyright infringement of products, which can be detrimental to the creator. Therefore, better protection is needed to address this high risk.Purposes of the Research:  This research aims to analyze law enforcement related to copyright infringement in the era of the Industrial Revolution through case studies of judges' decisions.Methods of the Research: The research method used is the normative legal method by analyzing legislation and Court Decisions Number 505 K/Pdt.Sus-HKI/2021 and Number 1933 K/Pid.Sus/2021 through literature study, by applying descriptive legal interpretation techniques to reach the right conclusion.Results of the Research: The results showed that law enforcement against copyright infringement involves two main approaches, namely preventive and repressive. The preventive approach is carried out through regulations that provide legal certainty, such as the presence of the Copyright Act. Meanwhile, the repressive approach is realized through legal proceedings in court and out of court to take action against violations that occur. This study highlights several cases of copyright infringement in Indonesia and shows the importance of strong law enforcement to protect the rights of creators in the digital age.

Abstract

Introduction: Taxes are obligations requiring citizens to pay a specified amount of money to the state. Following the enactment of the Tax Harmonization Law in 2021, tax law enforcement in Indonesia has been directed toward recovering state revenue losses.Purposes of the Research: This study aims to describe and analyze the implementation of criminal fine execution in tax cases as outlined in Decision Number: 249/Pid.Sus/2022/PN.Tpg.Methods of the Research: The study employs a normative legal approach through library research, which includes references such as laws, articles, and journals. Secondary data were collected through literature review and analyzed using a qualitative juridical approach.Results Main Findings of the Research: The findings of the study show that the confiscation of land and buildings belonging to the convicts is not in line with Article 39 Paragraph (1) of the Criminal Procedure Code. In addition, the assets had been used as collateral by Bank Mandiri Tanjungpinang, a State-Owned Enterprise, before the investigation began. This results in a lack of legal certainty and becomes an obstacle in the execution process. To ensure legal certainty, the investigation process must be accompanied by the tracking and blocking of the assets found, in the settlement of tax criminal cases in Decision Number: 249/Pid.Sus/2022/PN.Tpg, deliberation or coordination regarding land and building assets can be carried out, because the ultimate goal is to return the results of the execution to the state.

Abstract

Introduction: This research examines the effectiveness of handling human rights-based public complaints at the Regional Inspectorate of Riau Islands Province.Purposes of the Research: The aim is to evaluate the implementation, obstacles, and efforts to optimize complaint management.Methods of the Research: Method used is an empirical legal research method with a statutory and empirical approach. Data were obtained through interviews, observations, and study of legal documents related to the handling of public complaints.Results Main Findings of the Research: Results showed that although the regulatory framework exists, its implementation has not been optimal. The main obstacles include limited human resources both in number and competence, lack of socialization to the community, and weak legal structure and culture. This has led to slow processing of complaints and a low level of responsiveness to community needs. Recommendations include improving HR competencies through regular training, strengthening socialization to raise public awareness, and optimizing technology to support complaints management. These measures are expected to ensure respect for and fulfillment of human rights in public services, increase public trust in the government, and support clean and accountable governance.
