Abstract

This article describes the structure of the waqf concept from a worldview theory perspective. Worldview is simply a fundamental belief system concerning God, reality, man and truth, ethics, etc.; which serves as a guide for human life. A person's worldview will determine his behavior and actions. The next question is what kind of belief concept makes someone willing to do waqf? This article is a literature review that employs qualitative data with a philosophical approach. The data analysis method employs content analysis of data sources from the library. The result shows that the worldview analysis on waqf is a concept that was emerging from the Islamic worldview whose emergence was supported by various other fundamental concepts such as God, Prophets, Revelation, and Sharia (religion). It proves that the structure of the waqf concept is not as simple as handing over the property to Allah for the benefit of others. The peculiarity of such waqf concept seems impossible to be affirmed by the secular Western worldview, which is unable to affirm the concept of revelation, the Prophet, and religion. It also proves that the philosophical foundation of a waqf concept built on an Islamic worldview is very consistent, solid, and even has a broad spectrum that spans the worldly and the hereafter visions simultaneously.

Abstract

The excellent potential of benefit waqf has not been fully realized since nāẓir or the community failed to develop a strategy and did not innovate enough on the advantages of waqf and its administration. One of the successful principals in administering benefits waqf is the Tazakka Modern Boarding School with its innovation and programs on endowment benefits. This study intends to identify the benefit waqf development approach for Tazakka Modern Boarding School for economic independence. With a descriptive strategy, this study employs a qualitative methodology. The results of this study demonstrate that the development of benefit waqf in Tazakka is advantageous for economic independence with three distinct benefit waqf categories. So, for future researchers to be able to discuss professional nāẓir with good management and strategy, to maximize the potential and role of beneficial waqf in improving the economy and people's welfare.

Abstract

Hajj is an act of worship that completes the fifth pillar of Islam for a Muslim and is performed by those who are able. In its implementation in Indonesia, the hajj is organised by the Ministry of Religious Affairs (MORA) of Republic of Indonesia, including the offices of MORA in every city throughout Indonesia. The contract used during the registration of prospective pilgrims is a wakalah contract, but when they attend to the bank, the bank requestions what kind of contract will be employed whether wadi'ah or murabahah. This research is purposed to reveal the repayment contract for prospective pilgrims and analyse the principle of the contract applied in the repayment of funds for prospective pilgrims. The type of research used is field research with qualitative methods using descriptive analysis. The primary data sources in this research are obtained from the MORA of the Republic of Indonesia, while the secondary data was attained from journals or research related to the hajj financing model, then descriptive analysis of the data as material for the research findings. There are two findings in this research, firstly, the contract on the repayment of funds for prospective pilgrims, starting from the wakalah contract between prospective pilgrims and the MORA, this contract will take effect after the repayment of funds for prospective pilgrims. Secondly, the fiqh analysis of the principle of the contract applied to the repayment of funds for prospective pilgrims is wakalah and is appropriate as it should be. Even so, the MORA must also cooperate with stakeholders in providing the best service to hajj pilgrims so that they can perform the worship in holy lands (Madina and Mecca) comfortably and solemnly.
