Abstract

Abstract Islamic law has a theological dimension that is different from the terminology of modern jurisprudence. The sacred value in Islamic law makes people feel afraid to make a revolution against the existing fiqh rules. Whereas in certain circumstances, Islamic law can change according to the demands of the benefit, such as the appearance of the imam of the fiqh school as strong evidence that Islamic law will always undergo renewal in accordance with the demands of the times and the social conditions of its adherents. This study will examine the reform of Islamic law today and as a result of this study concludes that Islamic law can basically be accepted by every community to become a role model that reflects progress and harmony with human life which has an impact on the benefit of both the Islamic world and the western world. Keywords: Renewal, Thought, Islamic Law Abstrak Hukum Islam memiliki dimensi teologis yang berbeda dengan terminologi ilmu hukum modern. Nilai kesakralan dalam hukum islam membuat orang merasa takut untuk melakukan revolusi terhadap aturan-aturan fiqh yang ada. Padahal dalam keadaan tertentu, hukum islam bisa berubah sesuai tuntutan kemaslahatan layaknya kemunculan imam mazhab fikih sebagai bukti kuat bahwa hukum islam akan selalu mengalami pembeharuan yang berkesesuaian dengan tuntutan zaman dan keadaan sosial pemeluknya. Penelitian ini akan mengkaji pembeharuan hukum islam masa kini dan sebagai hasil dari penelitian ini menyimpulkan bahwa hukum islam pada dasarnya dapat diterima oleh setiap komunitas masyarakat untuk menjadi role model yang mencerminkan kemajuan dan keselarasan dengan kehidupan manusia yang berdampak pada kemaslahatan baik didunia islam maupun didunia barat. Abstract

Abstrak Islam menyebut undian dengan nama qur’ah yang berarti upaya memilih sebagian pilihan (alternatif) dari keseluruhan pilihan yang tersedia itu memiliki kemungkinan (probabilitas) yang sama besarnya untuk terpilih. Undian merupakan upaya yang paling mampu menjauhkan unsur keberpihakan dalam memilih dan dapat dilakukan untuk maksud-maksud yang beragam dan luas, bisa untuk maksud perjudian dan bisa pula untuk maksud-maksud yang jauh sama sekali dari perjudian. Dan yang menjadi permasalahan dalam penelitian ini: bagaimana pendapat Yusuf Qardhawi tentang undian berhadiah dan bagaimana istinbath hukum Yusuf Qardhawi tentang undian berhadiah. Jenis penelitian ini menggunakan penelitian kepustakaan (library research), yaitu kegiatan penelitian yang dilakukan dengan pengumpulan dan penelusuran data-data serta pengolahan (buku-buku, literatur dan bahan pustaka) yang berkaitan dengan topik pembahasan. Berdasarkan hasil penelitian tentang dan setelah mengadakan penelitian serta penelaahan secara seksama tentang “Analisis Pendapat Yusuf Qardhawi Tentang Undian Berhadiah. Maka penulis dapat menarik kesimpulan sebagai berikut : Mengenai undian berhadiah, Yusuf Qardhawi secara umum mengharamkannya dengan alasan bahwasanya hal tersebut masuk dalam kategori judi atau mendekatinya. Kata Kunci: Undian, Yusuf Qardhawi, Hukum Islam Abstract Islam calls the lottery with the name qur'ah which means that the effort to choose some of the options (alternatives) from the total available options has the same probability (probability) of being selected. Lottery is an effort that is most capable of removing the element of partisanship in choosing and can be carried out for various and broad purposes, it can be for gambling purposes and it can also be for purposes that are far from gambling. And the problem in this research: what is Yusuf Qardhawi's opinion about the lottery and how is Yusuf Qardhawi's legal istinbath about the lottery. This type of research uses library research, namely research activities carried out by collecting and searching data and processing (books, literature and library materials) related to the topic of discussion. Based on the results of research on and after conducting research and careful study of "Analysis of Yusuf Qardhawi's Opinions About Lucky Draws. So the author can draw the following conclusions: Regarding the lottery with prizes, Yusuf Qardhawi generally forbids it on the grounds that it is included in the category of gambling or approaching it. Abstract

This research explores traditional values in the traditional inheritance distribution system carried out by the Sidojadi community in Mandailing Natal Regency from the perspective of Islamic law. So, the research aims to understand how local customary values and traditions coexist with various principles contained in Islamic law regarding the inheritance distribution process. The data found were analyzed using the descriptive-analytical method, namely analyzing primary and secondary data obtained through interviews and literature studies and trying to see the relationship between the two. The results of the research explain that the relationship between the customary inheritance system and the principles of Islamic law which is reflected in the arrangements for the distribution of inheritance in the Sidojadi community, starting from the appointment of heirs, as well as the involvement of traditional institutions in this process has illustrated a very positive thing. Apart from that, the research results also explain that the harmony between traditional values and principles in Islamic law related to the context of inheritance distribution in Sidojadi society is very appropriate.

Abstract

Abstract
