ABSTRACT A Notary's position is public or public office because the Notary is appointed and dismissed by the government. Although a Notary is a public/public official who is appointed and dismissed by the government, but a Notary is not a government employee/government with a salary from the government. Notary public/public officials who also participate in carrying out government in the field of law but do not get a salary from the government, but entitled to receive honorarium. The formulation of the issues raised are (1) How does the examination procedure against the notaries before the Honorary Board of Notary? (2) Does the presence of the Notary Public Assembly in conducting a notary examination constitute a form of legal protection against a notary? Problems that will be discussed will be studied based on normative point of view, in accordance with legal research that is used is normative then approach problem used in this thesis is approach of legislation and conceptual approach The result of the research shows that the procedure of examination of Notary before the Honorary Council of Notary, consisting of stage of report submission, calling stage, examination stage by regional examiner board, examination stage by regional examiner board, and inspection stage by central examiner board. The presence of the Notary Public Honor Council in examining the Notary is a form of legal protection against Notary Public, the Honorary Council of Notary is one representative representing the minister of law and human rights with the authority that is attributive in order to conduct supervision and supervision of the notary public officials in carrying out the code of ethics His profession. The Honorary Council of Notary serves to protect Notary's profession, not protect the person of Notary, so, the protected is his profession, not the Notary. Thus, when a Notary conducts or allegedly commits a crime which has nothing to do with the duty of the Notary's office, the Investigator does not need to seek MKN approval to inspect it. On the other hand, if MKN Territory (MKNW) receives a request for approval of a Notary's examination of an alleged offense, the MKNW must reject it by reason of "not authorized" to grant approval or rejection of the examination of the case.
