Abstract

Diversion of juvenile criminal cases at the investigation stage at the Ternate City Police Force. Object: This research analyzes the diversion of child molestation cases at Ternate Police Force during the investigation stage. Objective: This paper analyzes: (1) the diversion implementation of at the investigation stage of child molestation crimes at the Ternate Police Force and (2) the factors that influence the implementation of diversion at the investigation stage of child molestation crimes. Method: This research used empirical research, which is a research model in the form of an action to observe a legal reality in society. Results: At the investigation stage, diversion implementation at the crime of child molestation cannot be carried out because according to Article 7 clause (2) of Law No. 11 of 2012, diversion can only be carried out on children who commit crimes with a prison sentence of less than seven years and are not a repeat of the crime. However, the Ternate City Police Force provides a solution of mediation. Factors that influence the implementation of diversion at the investigation stage of child molestation crimes include an obstacle where the victim's family prefers to continue the legal process rather than mediate.

Abstract

This paper is entitled “Legal Analysis of Product Use with Brand Name Riding in Ternate City”. The existence of a brand has a major impact on business competition as well as on improving economic standards. This research analyzes the use of products that piggyback on the names of well-known brands. This study uses socio-legal research which is a combination of two methods in the form of dogmatic legal research and empirical research. Results show that products that piggyback on well-known brand names is a manifestation of bad faith as well as damaging reputation and deceiving consumers. Several Indonesian regulations prohibit such actions. Although the ban on piracy, counterfeiting, and the commercialization of goods resulting from IPR violations, including trademark piggybacking, should serve as a deterrent against trademark infringement, issues like business actors' ignorance of the law and the imitation culture continue to impede effective law enforcement. The legal ramifications of trademark infringement by piggybacking on brand names then refer to different effects or outcomes that may occur as a result of breaking the law or committing illegal conduct.

Abstract

The title of this research is “Analysis of Legal Responsibility for Environmental Impacts Due to Land Eviction in the Farm Road Construction Project in Tidore Islands City”. The object of this research was the impacts of land eviction to construct farm roads in Tidore Islands City as well as the government’s legal responsibility. It aims to study the environmental impacts of land eviction in the construction of farm roads and the government's legal responsibility for its environmental impacts in Tidore Islands City. This study is an empirical legal study that uses a qualitative approach with observation, interview and documentation methods. Results show that the land eviction project activities in the Ake Sahu Environment, Tosa Village, East Tidore District have a very bad impact on the environment in the form of landslides in the eviction project area, floods that bring soil and rock material to the highway so that it greatly disrupts the access activities of the surrounding community, such impacts are not only caused by the eviction of the project but also the utilization activity (C excavation) by Cv. Mafututu Indah. The government has taken action to handle floods and landslides, then gave warnings and stopped the project.
