Abstract

Judges in the Commercial Court can use different articles in the Law (Law) Number 37 of 2004 concerning Bankruptcy and Postponement of Obligations of Debt Payment (KPKPU). The behavior of judges in deciding cases becomes inconsistent because the articles in the Act regulate the opposite. Article 2 paragraph (1) and Article 2 paragraph (4) of the KPKPU Law stipulates that 2 (two) creditors can sue the debtor bankruptcy in the Commercial Court and Creditors cannot sue the Debtor bankruptcy, unless the Capital Market Supervisory Agency (Bapepam) sues the Securities Company . In deciding bankruptcy cases, judges must have a consistent legal basis to determine the articles used in the same case. To overcome this problem, the judge has two choices to use the basis, namely Jeremy Betham's theory of benefit and individual rights based on the thinking of Albert Venn Dicey, KC, FBA. From the results of the analysis, the use of individual rights takes precedence. Claiming bankruptcy by individuals to securities companies solves the problem more. Abstract

This research is motivated by the problem of food which is a basic human need that cannot be left behind in everyday life. The method used in conducting this research is to use the normative type, namely examining the duties and authority of the POM Agency / Balai POM against the applicable regulations. The approach method is carried out by linking tasks from several applicable regulations, and is assisted by interviews. The results of the research in the form of what tasks are carried out by the POM Agency / Balai POM to control food containing hazardous materials, show that the tasks carried out are in accordance with applicable laws and regulations, namely Presidential Regulation Number 80 of 2017 concerning the Food and Drug Administration Agency, as a Technical Implementers within the POM Agency, then their duties are regulated in the Regulation of the Head of the POM Number 12 of 2018 concerning the Organization and Work Procedures of the Technical Implementing Units within the POM Agency. Other research results explain the actions taken in controlling food containing hazardous materials, there are 3 (three) pillars of the system, namely: the producer supervision system, the government supervision system and the consumer control system. Abstract

The purpose of this study is to examine and analyze the decision of the Surabaya district court and follow-up on these decisions in the criminal justice system in Indonesia, as we know that criminal law enforcement includes a series of processes starting from investigation, investigation, prosecution and will lead to the formation of a judge's decision. as the peak and basis for the execution of the convicted person. Abstract

This study discusses the issue of whether the criminal sanctions against the perpetrators who distribute pesticides are not in accordance with the label and whether the legal considerations of the Tebingtinggi District Court No. 650 / Pid.B / 2015 / PN Tbt, is in accordance with Law Number 20 of 2016 concerning Marks and Geographical Indications. Research with a statutory regulatory approach and conceptual approach, a conclusion is obtained that the criminal sanctions against the perpetrator who circulates pesticides are not in accordance with the label, that producing and trading goods that are not in accordance with what is stated on the label, it can be said to have committed an illegal act, namely violating the provisions of Article 60 paragraph (1) letter g of Law no. 12 of 1992, prohibits the distribution of pesticides that are not registered and do not comply with the label. The government prohibits the procurement, distribution and planting of certain plant seeds that are detrimental to the community, plant cultivation, other natural resources, and / or the environment. Legal considerations of the Tebingtinggi District Court decision No. 650 / Pid.B / 2015 / PN Tbt, in accordance with Law No. 15 of 2001, that YN's action to produce grass-fighting drugs or weeds (herbicides) uses the original Basmilang 480 SL brand and label produced by PT. Petro Kimia Kayaku, has fulfilled all the elements of Article 90 of Law no. 15 of 2001, then he is subject to a criminal sanction in the form of imprisonment for a maximum of 5 (five) years and / or a maximum fine of Rp. 1,000,000,000.00 (one billion rupiah). This decision was based on the consideration that YN's actions had fulfilled all the elements of Article 90 of Law no. 15 of 2001. Abstract

The advisory opinion of the International Court states that de jure and de facto it is sufficient for the United Nations as an international organization that has the legal personality and legal capacity to act before the law representing the interests of the UN itself as well as the interests of its victims. ASEAN has a legal personality implicitly stipulated in article 3 of the ASEAN Charter. Based on this legal personality, the researcher examines ASEAN's legal capacity as a subject of international law and ASEAN's position in resolving South China Sea disputes. By using a conceptual approach and a comparative approach method. That ASEAN has a legal capacity as a subject of international law. ASEAN has the legal capacity to resolve South China Sea disputes between its member countries and has the right to submit international complaints to an international court with the approval of its member countries. Abstract

Minister of Law and Human Rights Regulation No. 17 of 2018 is the latest regulation governing the Registration of Limited Partnership, which was previously regulated in the Code of Business Law. There are several differences that could raise doubts about the legality of the Limited Partnership which was registered after this Minister of Law and Human Rights Regulation because it has several fundamental differences regarding the process and authority for its ratification, whereas the legal position of this Minister Regulation is under the Code of Business Law position which is equivalent to an Act. This study examines the Legis Ratio of the formation of Minister Regulation and the Role of Notaries after the enactment of this Minister Regulation. The type of research carried out is normative legal research, it was found that there was legal disharmony between Minister Regulation and the previous rules of the Code of Business Law referring to the Lex Superior Derogat Legi Inferiori Principle, and a change from the role of a Notary based on the Criminal Code to carry out the process manually to the District Court, after Minister Regulation register electronically through the Business Entity Administration System. Abstract

Cagar budaya merupakan warisan budaya bersifat kebendaan berupa benda cagar budaya, bangunan cagar budaya, struktur cagar budaya, situs cagar budaya, dan kawasan cagar budaya di Indonesia perlu dilestarikan, dijaga keberadaannya karena memiliki nilai penting bagi sejaerah, ilmu pengetahuan, pendidikan, agama dan kebudayaan. Benda cagar budaya seringkali dirusak, dijual, dan dicuri untuk mendapatkan keuntungan tertentu. Bahkan warga negara asing juga menginginkan kepimilkan tentang benda cagar budaya agar dapat mempunyai benda bersejarah tersebut. Oleh karena itu Indonesia membutuhkan peraturan yang lebih tegas dalam penanganan warga negara asing yang hendak memilki benda cagar budaya dan perlu kesadaran juga untuk warga Indonesia agar dapat melestarikan benda bersejarah tersebut. Kurangnya kesadaran dari warga negara indonesia tentang benda cagar budaya agar lebih bisa menjaga dari warga yang ingin memilki kepemilikan benda cagar budaya tersebut.
