Abstract

Health is a very important factor and has become a basic necessity for human life. When humans are sick and have to get certain medical actions we have to sign a contract which is called a Therapeutic contract. The purpose of this study was to determine the legality of the therapeutic contract in the perspective of Hindu law and contract law. The approach method in this research uses normative legal research methods. The legality of a therapeutic contract, both from the perspective of treaty law and Hindu law, refers to the arrangements regarding the validity of the agreement and the conditions for binding the contract or pacta sunt servanda. In the agreement law, the provisions for the validity of the agreement are contained in the provisions of Article 1320 of the Civil Code and regarding the conditions for binding contracts are regulated in Article 1338 of the Civil Code. Whereas in Hindu law, the arrangements regarding the validity of the agreement and the conditions for binding the contract are regulated in Book VIII Manawa Dharmasastra, namely for the legal terms of the agreement in Book VIII Sloka 165 (agreement), Sloka 163 (skill), Sloka 143 (achievement), and Sloka 164 (causa kosher); The conditions for binding contracts (pacta sunt servanda) are stipulated in Book VIII Sloka 46. As well as being sourced from the Civil Code and Manawa Dharmasastra, therapeutic contracts whose object is inspanning verbintenis (medical action based on effort, not results achieved) are also subject to the provisions of national law as stated in the Minister of Health Regulation Number 290 of 2008 concerning Approval of Medical Action.

Abstract

Spatial Plan has a significant influence on economic development in a region caused by many economic functions related to environmental areas that can be used as a means of investment. The issuance of Regional Regulation No. 5 on year 2015 on Provincial Spatial Plan can potentially arise a limited issue of investing.m This study aims to improve spatial policy in central Borneo and look at its implications for the investment climate. This type of research is empirical juridical research with qualitative-descriptive approach. The data analysis method used is descriptive-qualitative. Based on this research, it can be obtained an overview of the spatial policy direction of Central Borneo Province aimed at realizing the spatial order of agriculture-oriented areas of agribusiness and agro-industry, as well as energy barns and food barns while considering the carrying capacity and capacity of the environment. Based on the data obtained, it can be seen that investment realization from year to year has not increased significantly. Spatial policy has an influence on the investment climate in the plantation sector because this sector must occupy the cultivation area or land user area (Area Penggunaan Lahan/LAND USER AREA) in order to run the company. Abstract

Melimpahnya kekayaan budaya pada masyarakat dayak ngaju salah satunya adalah kemampuan supranatural/magis yang sangat erat dengan kehidupan ritual adat tetapi kerap disalahgunakan menjadi sebuah kejahatan. Tujuan penelitian ini adalah untuk mendeskripsikan ilmu hitam dalam pandangan masyarakat Dayak Ngaju dan wujud sanksi adat bagi pelaku ilmu hitam dalam masyarakat Dayak Ngaju. Metode yang digunakan adalah penelitian yuridis sosiologis dengan melakukan pendekatan yuridis empiris dan menspesifikasikannya melalui penelitian kualitatif berdasarkan bahan-bahan yang didapatkan dari lapangan seperti hasil wawancara yang didukung dengan bahan hukum normatif serta penelitian sebelumnya yang terkait. Hasil dari penelitian ini mengungkapkan bahwa masyarakat Dayak Ngaju mengenal beberapa jenis ilmu hitam, yaitu parang maya, aguh, sanggar, dan pulih dan sangat mengutuk serta membenci pelaku kejahatan ilmu hitam. Sanksi adat yang diberikan terhadap pelaku kejahatan ilmu hitam adalah bayar regan oloh artinya membayar biaya pengobatan bagi yang sakit, dan membayar biaya rukun kematian sesuai agama dan kepercayaan bagi korban yang meninggal dan sanksi sosial berupa pengucilan sosial oleh masyarakat. Sanksi adat dan sanksi sosial ini menjadi alternatif penegakan hukum di masyarakat untuk mengisi kekosongan hukum Undang-Undang KUHP terhadap pelaku kejahatan ilmu hitam. Kata Kunci: Ilmu Hitam, Penegakan Hukum, Hukum Adat.

Abstract

This article explores and explains the customary sanctions (singer) of the divorce case of the adat law community in Sigi Village, Central Kalimantan. Problems that occur in society need to be appropriately resolved by prioritizing a sense of justice and a sense of peace by considering the legal provisions that apply in society. Divorce cases that occur are resolved by customary law as an option for the community, especially those who experience problems directly for both parties. The problems discussed in this article are related to the factors that cause divorce and the customary sanctions applied to the parties that cause divorce. The method used is through a qualitative approach, which seeks to understand and describe in-depth matters relating to the phenomenon of research or research, which intends to understand what is experienced by the research subject by describing it in the form of words and language. This particular context is natural and makes use of various scientific methods. The conclusion from the results of this individual research is that the factors that cause divorce in Sigi Village, Central Kalimantan are the existence of an affair or the presence of a third party in the household and sanctions in the form of the singer or customary fines, which refer to the previous customary marriage agreement letter, besides that the customary fine is imposed. Abstract

Marriage is a period that will go throgh each individual human being. It is stated in Hinduism that the purpose of marriage is not only to bear children and to fulfill biological needs, but also as a yadnya. Marriage for children must also be considered, both in terms of age and mentally. Age as a benchmark to determine a person's maturity, both in mind, mentality and emotion. In the Hindu concept, marriage should be carried out after finishing studying or the Brahmacari period. Providing opportunities for children to study and complete the brahmacari period, as well as an effort for parents to prevent early marriage. In addition, taking a good approach or communication relationship with children and controlling children's relationships and providing religious doctrine are also important things in preventing early childhood marriage. On the other hand, the government has made a minimum age restriction for marriage, as well as an effort to suppress the occurrence of early childhood marriages. The socialization of the negative impact of early childhood marriage is also intensively carried out through related parties. However, the spearhead of preventing early childhood marriage are parents or family. For parents who interact more and directly with children and can also give permission and whether or not they want to marry.

Abstract

The act of radicalism is an act that disturbs and threatens the lives of others and can divide the nation. Thanotion of radicalism is a wrong understanding, because it considers soething wrong if it is not in accordance with its ideology and beliefs. From the point of view of state law and Hindusim, this has deviated from the order of relegius and state life and is contrary to the philosophy of the Indonesian nation, namely Pancasila and Bhinneka Tunggal Ika. However, radicalism group consider the ideology of the Indonesian nation inappropriate to be applied, because it is contrary to the ideology they believe in. morally and the character of the radicalism group can be said tobe immoral, because the group uses violence in realizing its wishes. Radicalism groups are also constantly lokking for follower to increase the number of their groups. The way he does it is to influence and indoctrinate others based on a certain religion. so that to be albe to preyent acts of radicalism the role of the family is needed in caring for and nurturing children. The family is the main place for children to leam be social and develop themselves. Families must build good communication and behavior from each family member. So that it will be embedded in children the values of life norms and good personalities and have character and morals thet are not easily influenced by negative things, such as radicalism.
