Abstract

In the midst of rapidly changing social dynamics, it is crucial to recognize the rights of women or widows as heirs by ensuring that they receive a fair share of inheritance in accordance with their contributions and roles in building the family and household. Therefore, there is a need for awareness regarding the protection of the rights of women or widows in the context of inheritance law, allowing them to receive fair and equal treatment in the distribution of inherited assets. This is a significant step towards achieving gender equality and justice in Indonesian society. This research focuses on examining and understanding the complex issues related to the procedures for the distribution of the inheritance of a deceased husband to a widow in the village of Sigi, Pulang Pisau Regency, Central Kalimantan Province. The study aims to provide profound insights into the practices and perspectives of the community regarding customary inheritance law and its influence on the rights of women or widows in inheriting their husband's estate. Through this research, it is hoped that solutions can be found to address the injustice often faced by women or widows in inheritance distribution. Additionally, the study aims to provide policy recommendations to enhance the protection of the rights of women or widows in the community. The method employed is empirical legal research using a qualitative approach. The conclusion drawn from the research is that the inheritance law system in the village of Sigi, Kahayan Tengah District, Pulang Pisau Regency, prioritizes customary inheritance law in the distribution of inherited assets by upholding noble values based on the principle of family solidarity. This is done through consensus and the distribution of inherited assets to all surviving family members, including widows or widowers and legitimate children or their descendants. The process is conducted fairly and evenly through family consensus and the eldest sibling or the appointed elder leading the family consensus.

Abstract

The Dayak tribe is one of the communities in Indonesia that still applies customary law as a guideline in regulating the lives of its people in various matters, including in terms of resolving problems, including traffic accidents. Conflict resolution through Customary Law will better represent the feelings and desires of the community because the law itself comes from the community itself. Customary Law seeks to resolve conflicts or problems with peace for the parties. Peace is a goal that all parties aspire to. Traditional institutions play a very important role in regulating the behavior patterns of indigenous communities, especially the Dayak indigenous community. Traffic accident cases are also one of the rights and permits for Let Adat to implement, this is stated in Article 10 of Central Kalimantan Regional Regulation No. 16 of 2008. Based on this, it clearly states that the existence of the Damang Traditional Head's permission to resolve the abilities that arise in cases of traffic accidents is included in the case of giving Singer. A traffic accident that takes someone's life is called a Sahiring Customary Violation (taking someone's life). The aim of implementing problem resolution through customary law is to achieve peace between the parties and restore the disturbed balance. Singer Sahiring is a singer or fine for murder or someone who takes the life of another person "Sahiring Matei". There are policies that are taken based on considerations based on the capabilities of the guilty party. Of course, Damang will make a decision based on the agreement between the parties after hearing the opinions of each party at the internship hearing. Customary Law in resolving problems seeks peace as a goal. This is in line with the highest goal of law which is to provide benefits to the parties by creating peace. Restorative Justice has existed in Indonesian society through a customary law settlement process. With procedures and guidelines that bring together parties and stakeholders, in this case the Damang Traditional Head, in an informal forum to reach consensus in seeking restoration of the situation.Keywords: Traffic Accidents, Crime, Peace, Customary Law

Abstract

Abstrak Perkawinan merupakan ikatan antara seorang pria dan seorang wanita yang bertujuan membentuk sebuah rumah tangga yang bahagia, harmonis, saling mendukung, dan melengkapi satu sama lain. Di Indonesia, pernikahan bisa menjadi kompleks ketika pasangan berasal dari agama atau keyakinan yang berbeda. Pada 17 Juli 2023, Mahkamah Agung mengeluarkan Surat Edaran Nomor 2 Tahun 2023 yang melarang pengadilan untuk menyetujui permohonan pencatatan pernikahan antar-umat yang berbeda agama. Namun, Pengadilan Negeri Jakarta Utara justru menerima permohonan tersebut dalam register perkara nomor 423/Pdt.P/2023/Pn Jkt.Utr. Hal tersebut menunjukkan kesenjangan antara apa yang seharusnya terjadi (das sollen) dan kenyataan yang ada (das sein). Penelitian ini menggunakan pendekatan yuridis-normatif, mengkaji teori-teori, konsep-konsep, serta peraturan perundang-undangan terkait. SEMA sebenarnya ditujukan untuk mengawasi hakim, namun kekuatannya dalam konteks spesifik suatu kasus bisa berbeda. Hakim tetap memiliki wewenang untuk menafsirkan SEMA sesuai dengan konteks kasus yang dihadapi. Penetapan Pengadilan, seperti dalam kasus nomor 423/Pdt.P/2023/Pn Jkt.Utr., dapat dianggap sebagai putusan pengadilan yang bersifat final. Dalam kasus tersebut, para pemohon diberikan izin untuk mencatatkan pernikahan beda agama di kantor Dinas Kependudukan dan Pencatatan Sipil Kota Jakarta Utara. Abstract

Joged Bumbung is an art form that combines music from Balinese traditional instruments and dance. Now, the presentation and aesthetic concept of the Joged Bumbung dance are starting to be ignored by the dancers making the identity of this dance disappear, namely the existence of Joged Bumbung which contains elements of pornographic action and pornography via social media. The purpose of this writing is to find out and examine criminal acts in pornographic Joged Bumbung performances as well as policies for dealing with them. This research method is a normative method, namely research which in its study refers to and is based on legal norms and rules, applicable laws and regulations and other literature materials that are relevant to the research topic. The results of this research are that based on Law Number 44 of 2008, both organizers and perpetrators of pornography, in this case namely Joged Bumbung performances that have pornographic nuances, can be given legal sanctions based on legal provisions that contain prohibitions on pornography and pornographic acts. Furthermore, related pornographic Joged Bumbung shows which are distributed via social media, it is regulated in Article 27 of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions. Policies to overcome these problems can be implemented by warning the dancers and pengibing not to display body movements that lead to pornography.

Abstract

Abstract The issue of decentralization is also closely related to the vertical separation of powers, namely a proposition that explains the distribution of powers between various levels of government. This is related to the division of authority between central and regional government levels. In Indonesia there have been several regulatory changes related to regional government, which of course also have an impact on the pattern of division of authority between the central and regional governments. The aim of this research is to analyze the ideal concept of decentralization for the Unitary State of the Republic of Indonesia. This type of research is normative legal research, because this research examines statutory regulations, theories or doctrines, and conceptual thinking and previous research related to the object of study in this research. The results of this research show that the ideal decentralization concept for the Unitary State of the Republic of Indonesia is a combination of symmetry and asymmetry which is the right combination or is known as the Integrated Decentralization System concept. In this decentralization, regions have broad authority in terms of managing their household affairs, including planning, implementation and evaluation, which are given to the regions with complete authority. In this decentralization, the role of the central government is not completely absent, the central government continues to supervise certain limits. Abstract

Religion is a guide or guidance for its followers. Embracing a religion is a human right of all individuals which has been guaranteed and protected by the state through the constitution. The purpose of writing this article is to reveal transparently based on the rules or constitution the freedom to embrace a religion. The method used in this research is normative law. Where data obtained through legal materials and legal articles is analyzed systematically. The result is that freedom of religion based on the constitution is contained in the values ​​of Pancasila as the ideology of the nation and state, especially the first principle. The 1945 Constitution in article 28 D (1) also explains freedom of religion and this is a guideline for every religious community in embracing and practicing their beliefs. Likewise, based on human rights law number 39 of 1999 and also the Universal Declaration of Human Rights (UDHR) it is clear that it states the protection and freedom to embrace a religion. The conclusion is that embracing a religion must be based on one's own wishes and beliefs, it is not permissible for other people or certain parties to intervene in this matter because it is a human right. In carrying out religious life, there must be no discrimination, no matter how small. This is because religious freedom is regulated by the constitution, so it is obligatory to obey the law.
