Abstract

The issuance of duplicate land ownership certificates gives rise to legal issues that culminate in civil disputes between parties holding certificates over the same plot of land. These problems are not only caused by the involved parties but also by the negligence of land registration officials. This study aims to identify the forms of unlawful acts in cases of land control based on duplicate certificates, as well as to examine the mechanisms for resolving land ownership disputes in such cases in Indonesia. The research method employed is normative juridical, using data collection techniques based on statutory and conceptual approaches. The results of the study indicate that an unlawful act occurs when a person takes control of land that is legally owned by another party, whether an individual or a legal entity. Proof of lawful land ownership is essential to ensure legal certainty, which can be demonstrated through authentic deeds such as a Sale and Purchase Deed (Akta Jual Beli or AJB) issued by a Land Deed Official (Pejabat Pembuat Akta Tanah or PPAT). To minimize disputes, firm law enforcement is required, along with the active role of the National Land Agency (Badan Pertanahan Nasional or BPN) in resolving disputes fairly through deliberation, mediation, and facilitation. In practice, land dispute resolution is not only carried out by the BPN but can also be pursued through the General Courts and the Administrative Court

Abstract

One of Indonesia's issues is agrarian strife. In an attempt to settle land conflicts, this research looks at the causes of agricultural conflict as well as the idea of ​​agrarian reform. Using a Normative Juridical methodology, the study demonstrates that social, cultural, economic, and political structural conflict concerns are almost invariably linked to agricultural conflict. Restructuring the ownership, management, and utilization of agricultural resources for the benefit of the general public (farmers, farmworkers, the homeless, and others) is known as agrarian reform. The goal of agrarian reform is to resolve the disputes and inequities that occur.

Abstract

The digital era has brought significant changes in the implementation and settlement of defaults in heavy equipment leasing agreements in Indonesia, especially regarding the validity of documents and electronic signatures. This study examines the implications of using digital technology in heavy equipment lease contracts as well as the role of regulation and legal literacy in overcoming default obstacles. The results of the study show that electronic documents and digital signatures have legal validity based on the ITE Law and its amendments, but challenges such as lack of understanding of business actors, limited digital technology infrastructure, and data security are still the main obstacles. Adaptive and specific regulations and improved legal literacy are key factors in strengthening legal certainty and minimizing disputes. In addition, the application of new technologies such as blockchain and digital dispute resolution platforms can improve the efficiency and transparency of the process. This research recommends strengthening derivative regulations, improving legal education, and developing equitable digital technology infrastructure to support a safe and reliable contract ecosystem. Thus, the digital era has the potential to encourage the growth of a more sustainable and highly competitive construction and heavy equipment leasing sector.

Abstract

The Complete Systematic Land Registration Program (PTSL) is a government effort to accelerate land registration, including in Bantul Regency. This study examines its implementation by analyzing each stage, from planning to certificate submission. The study also identified supporting factors, such as community participation and clear regulations, as well as inhibiting factors such as inherited land and disputed land. With more than 90% of land certified, PTSL has proven effective in improving land administration and legal certainty over land ownership in Bantul Regency.

Abstract

This research examines the implementation of execution in land dispute cases at the Palangkaraya District Court. Execution often faces obstacles despite the existence of final and binding court decisions. The purpose of this research is to understand the legal aspects and mechanisms of execution implementation. This research uses a normative-empirical approach. The results show numerous constraints, both juridical and non-juridical, that cause low success rates in execution.

Abstract

In the context of sale and purchase deeds, which are one of PPAT’s primary legal products, the application of prudence should not be limited to formal truth—truth based on fulfilling formal or procedural requirements as stipulated by law—without considering the substance or material facts behind it. These material facts are obtained through the application of material truth, which refers to efforts to ensure that all aspects of the deed-making process reflect actual reality so that the resulting legal product achieves perfection in both substance and future impact. Material truth, which produces material facts, also plays a crucial role in legal reform and legal certainty—two inseparable elements in legal practice. From a legal reform perspective, material truth that produces material facts is an urgent need, as there are currently no specific regulations governing its application in the deed-making process. Meanwhile, from a legal certainty standpoint, material facts have a direct impact on preventing potential disputes, both in the short and long term. Thus, applying material truth to obtain material facts in the preparation of sale and purchase deeds can be a concrete step toward creating legal products that are not only dispute-free but also provide justice and sustainable benefits for all related parties. Therefore, a review of existing regulations concerning the duties, obligations, and authorities of PPAT is necessary.

Abstract

Leasing is one of the solutions for society to acquire the goods they desire in order to improve their standard of living. A leasing agreement is an innominate contract, meaning that its formation is left to the parties involved to determine the clauses within the agreement. The research method used is based on normative legal research with a statutory approach and a conceptual approach. The research findings indicate that leasing agreements are implemented in the form of standard contracts following the "take it or leave it" principle, granting the lessor the right to terminate the agreement and unilaterally reclaim the leased object.

Abstract

Increasing space in open areas is one way to counteract the negative impact of housing and urbanization on land use. Apart from being a way to live, housing and settlements are more appropriately understood as a process of human settlement. Apart from being a practical place to live, housing and settlements are also the process of human settlement. The construction of flats aims to meet the needs of decent housing for the people, by increasing the usability and yield of land use in densely populated areas and only a limited land area is available. The definition of flats varies, flats are also called Flats/Apartments/Condominiums. In this study, there are two problem formulations. First, how to protect the owner of a flat unit in the case of a transfer of ownership carried out without a sale and purchase deed. Second, what is the role of the court in resolving disputes over the transfer of ownership of apartment units carried out without a sale and purchase deed based on Decision No.182/Pdt.G/2023/PN.Jkt.Tim. The research method used in this study is normative juridical which uses secondary data sources or data obtained from literature materials. From this study, it can be concluded that there are acts of unlawful acts that are demanded with compensation for losses. So that the role of the court in granting the lawsuit in its relevance to the Registration of Transfer of Land Rights can be the basis for being able to register the process of reversing the name of the certificate to the National Land Office as a substitute for the Deed of Sale and Purchase from PPAT.

Abstract

Overlapping land disputes are an agrarian issue that often arises in Indonesia, including in the city of Semarang. This study highlights the resolution of disputes over a plot of land in Kalipancur village, Ngaliyan district, which involves two different land ownership certificates for the same object. The purpose of this research is to examine the mediation process and the legal consequences of the agreement reached. The method used is a qualitative approach through case studies. The land office plays a crucial role in facilitating communication, assisting the resolution process, and ensuring that the mediation results have legal force and can be implemented by both parties.

Abstract

The sale and purcase agreement (PPJB) of land accompanied by a power of attorney to sell is frequently used as collateral in debt agreements. However, such a PPJB does not constitute valid legal collateral because it lacks executorial power and is susceptible to annulment by the court. This creates legal risk for creditors in the event of default by the debtor. Notaries must be held accountable for eansuring the accuracy and conformity of documents with actual conditions to prevent legal losses. Therefore, it is advi for creditors to use legally recognized forms of collateral, such a mortage risk (hak tanggungan), to ensure legal protection and debt repayment certanly. Legal protection for creditors can also be strenghened through fair contractual clauses and legal action in cases of default or unlawful condut.
