This research analyzes the overlapping case of HGB Certificate Number 00538/Lingkuang Aua under PT. PLN's name with 11 community property rights certificates in West Pasaman Regency. The overlap occurred due to manual administration systems in 1994, loss of PT. PLN's HGB documents, and land abandonment for 25 years. The community has physically occupied the land for residential purposes and obtained certificates through complete procedures. Consequently, both parties cannot conduct legal transactions on their land due to dispute status. The Land Office neglected to supervise abandoned land and failed to prevent overlapping certificate issuance. Mediation resolution failed, requiring settlement through Administrative Court to obtain binding legal certainty.

Certificates serve as valid proof of ownership under Indonesian law with the primary objective of providing legal certainty’. However, why is it that a land certificate must sometimes be annulled? Such situations may lead to ambiguity in legal implementation and result in a lack of legal certainty and protection for certificate holders. This study raises several legal issues: How is the application of the negative publication system with a positive tendency in land registration able to ensure legal certainty over the status of land certificates issued by the Land Office? How should the legal reasoning of judges in annulling Certificate of Ownership No. 212/Pasar Pangururan through Decision No. 35/G/2020/PTUNMDN be analyzed in relation to the value of justice? What are the legal responsibilities of the Head of the Land Office of Samosir Regency in issuing Certificate of Ownership No. 212/Pasar Pangururan to the aggrieved party?. This study is a normative juridical research employing a descriptive analytical approach. he findings indicate that the implementation of the negative publication system with a positive tendency in land registration has not yet maximally provided legal certainty regarding the status of ownership certificates issued by the Land Office, as such certificates can still be subject to legal challenge

Land acquisition for infrastructure development in Indonesia as a developing country often leads to disputes regarding compensation determination, as in the case of Bener Dam in Purworejo Regency decided through Supreme Court Decision Number 1382 PK/Pdt/2022. This normative legal research with a descriptive-analytical approach examines compensation mechanisms based on legislation, the validity of deliberations in determining compensation, and legal considerations in dispute resolution. The results indicate that legal defects in compensation determination can occur due to non-communicative deliberation procedures, non-compliance with Law No. 2 of 2012, or violations of time limits. The Supreme Court rejected the judicial review application because the applicants failed to file objections to the District Court within 14 days as required by the applicable Supreme Court Regulations.

Abandoned land is a serious problem in land management in Indonesia that requires appropriate supervision and control mechanisms. This research analyzes the annulment of decisions on the determination of abandoned land originating from Building Use Rights through a case study of Decision Number 150/G/2019/PTUN-JKT. The research method uses a normative juridical approach with court decision analysis. The research results show that the annulment of the decision was caused by violations of administrative procedures and administrative law principles, particularly in the identification, evaluation, and warning stages. This research concludes the need to apply the principle of prudence and good governance in determining abandoned land to ensure legal certainty and protection of rights.

A Sale and Purchase Deed (AJB) executed by Land Deed Making Official (PPAT) can be declared invalid and canceled through court proceedings if proven defective from external, formal, and material aspects. This normative juridical research analyzes the legal strength of AJB made unlawfully by PPAT, specifically regarding PPAT's responsibility for issuing deeds without the seller's knowledge. Based on Decision Number 3507K/Pdt/2023, AJB made unlawfully loses its strength as an authentic deed and creates juridical consequences in the form of civil, administrative, and criminal liability for PPAT proven to have committed procedural and substantial violations in deed preparation.

An important case in Indonesian agrarian law, Supreme Court Decision No. 24 PK/TUN/2024, concerns a crooked land dispute in a customary village. The main focus of the case is the alleged land grabbing that occurs when individual title certificates are issued on land that is allegedly a collective asset of the village. The Supreme Court upheld the jurisdiction of the district court, not the government, to determine land ownership, and rejected the review filed by the Setupatok Village Government. This decision strengthens the validity of the legality of the certificate that has been issued until the district court decides otherwise. This makes it very difficult for indigenous villages to defend their crooked lands, thus requiring more thorough legal support for historical claims.

This study aims to analyze the forms of legal protection for land rights holders in the context of land acquisition for public interest, and to launch its implementation through a case study of Decision Number 95/Pdt.G/2021/PN.Kis. The phenomenon studied was caused by problems between the government as the implementer of development projects and the community as landowners, who often suffered losses in the compensation process. The research method used was normative juridical with a regulatory, case, and conceptualization approach. The results of the study indicate that in this case, there were administrative errors in the form of errors in the object of land valuation and the failure to carry out proper compensation deliberations. This contradicts the principles of justice, participation, and legal certainty as stipulated in Law Number 2 of 2012. The panel of judges declared this action to be an unlawful act and partially granted the plaintiff's claim. These findings indicate that legal protection is still not optimal and that there is a need for strengthening regulations and supervision in the implementation of land acquisition to prevent harm to the community.

Land disputes in Indonesia reached 12,000 cases in 2024, promoting mediation as alternative resolution. This research analyzes implementation of ATR/BPN Minister Regulation No. 21/2020 in Indragiri Hilir Regency using empirical juridical method. Causal factors include administrative data inaccuracy, technical errors, low public legal awareness, and land economic value changes. Mediation process conducted through five systematic stages with Land Office as neutral facilitator. Main obstacles are parties' bad faith and institutional limitations, addressed through mediator capacity building and socialization programs. Mediation success rate reached 67% from 9 cases during 2021-2023 period.

Land has strategic value in the Indonesian legal system regarding lawful ownership and control. One common land right is the Right to Build (HGB), whose transfer must follow formal procedures, including the making of a Sale and Purchase Deed (AJB). Problems arise when the AJB is not made, as in Decision of the Serang District Court Number 107/Pdt.G/2024/PN. Srg. Research shows the AJB is a mandatory requirement for title transfer but may be set aside through other evidence if it meets the principle of substantive justice. The public is advised to transfer titles immediately, and the government to increase education on AJB’s importance.

Coastal borders play a strategic role for coastal ecosystems and communities but are often privatized by corporations for resort development. This practice alters ecological functions and creates agrarian conflicts between corporations, government, and society. This study analyzes the Bali Provincial Government’s policies regarding coastal border privatization within the framework of agrarian law, using a normative method with statute and conceptual approaches. Findings reveal the absence of specific regulations and weak supervision, highlighting the need for strengthened regulatory policies to safeguard public interests and ensure environmental sustainability.
