Abstract

The Ahmadiyya Congregation is an international Islamic organization founded in Qadian, India, in 1889 by Mirza Ghulam Ahmad. Until now, this organization has expanded to more than 200 countries, including Indonesia. The highest leadership in this organizational structure is held by the Khalīfatul Masih (Promised Successor) who is currently based in London, England. Meanwhile, in each country, this organization is led by a National Amir who acts as the Chairman of the Central Board. The caliphate system adopted by the Ahmadiyya Congregation is believed to be a continuation of the Khilafah 'alā Minhājin Nubuwwah, with the main characteristic of being apolitical. The question is, this organization prohibits the establishment of political parties or the formation of a state based on their version of the caliphate system. The caliphate model of the Ahmadiyya Congregation is interesting to study because it has similarities with the Papal system in the Vatican. The process of electing the caliph is carried out through deliberation and consensus, although historically this position continues to be held by the descendants of Mirza Ghulam Ahmad. Their organizational structure is very hierarchical, where every decision and instruction from the caliph must be obeyed. The caliph is considered a figure chosen by God through human intermediaries, so that his attitudes and behavior are used as examples in social, sharia, and worship aspects. Rejecting the teachings of the caliph in this context is seen as a form of understanding of religion. The Ahmadiyya Community believes that the institution of the Khalīfatul Masih will continue until the end of time.

Abstract

This research explores the burqa ban as a form of state control over religious symbols and its conflict with the right to religious freedom, which is protected by international law and Islamic teachings. Using a multidisciplinary approach, the study draws on Islamic studies, sociology, anthropology, history, law, and philosophy. It examines the burqa as both a religious obligation and a cultural identity marker, while also analyzing the roots of French secularism and the philosophical debate between individual freedom and state authority. The findings reveal that France's burqa ban reflects a secular, yet discriminatory policy targeting Muslims. While some view the burqa as an act of religious devotion, the state perceives it as a threat to national unity. This clash highlights growing tensions between religious expression and secular values. To promote justice in a pluralistic society, the study suggests adopting policies that respect religious and cultural diversity.

Abstract

Child sexual abuse constitutes a severe violation of human rights, causing multidimensional impacts—physically, psychologically, and socially. The rising number of such cases in Indonesia indicates that conventional sentencing systems have not been sufficiently effective in providing sustainable protection and deterrence. Therefore, Indonesia has adopted the double track system, a penal approach combining primary punishments such as imprisonment with additional measures like chemical castration, psychological rehabilitation, and the installation of electronic monitoring devices. This study aims to analyze the legal basis, effectiveness, and implementation challenges of the double track system in addressing child sexual crimes in Indonesia. Using a normative juridical method with a descriptive-analytical approach, the research draws on legal statutes, doctrinal studies, court rulings, and case analyses. The findings reveal that although regulatory frameworks exist, implementation still faces various obstacles, including inconsistencies in court decisions, resistance from medical professionals regarding chemical castration, and the limited availability of rehabilitation facilities. This study recommends the development of national technical guidelines, capacity building for law enforcement personnel, and harmonization between regulations and professional ethics to support a fair and effective implementation of the system.
