Abstract

This research explores the implementation and impact of ASEAN Mutual Recognition Agreements (MRAs) in the context of the ASEAN Framework Agreement on Services (AFAS), focusing on the mobility of professional workers in the ASEAN region. This study proposes the implementation of MRA in the creative professions sector, especially the profession of dancers, which has not received adequate attention within the MRA framework. This study aims to analyze the effectiveness of the implementation of MRA in the engineering sector and identify the potential for adopting a similar model in the performing arts sector. Using a juridical normative approach, this study conducts a qualitative analysis with a comparative approach, comparing the application of MRAs in the engineering sector and creative professions. The results show that although MRAs have succeeded in increasing the mobility of professional workers in the engineering sector, their application to creative professions faces major challenges, such as the disharmony of qualification standards and non-uniform accreditation systems. This study suggests the need to develop a more inclusive legal framework and harmonize qualification standards to support the implementation of MRAs in the creative sector. The implication of this study is the strengthening of ASEAN economic and cultural integration through broader recognition of creative professions, which can enrich the region's cultural identity and enhance the competitiveness of the ASEAN creative economy globally.

Abstract

Financial distress is a critical issue affecting companies, particularly in the infrastructure, utility, and transportation sectors, which require substantial capital investment. Various factors, including profitability, liquidity, and leverage, influence financial distress, while company size may play a moderating role. Understanding these factors is crucial for corporate decision-makers and investors to mitigate risks and enhance financial stability. This reseach aims to analyze the effect of profitability, liquidity, and leverage on financial distress, with company size as a moderating variable in infrastructure, utility, and transportation firms listed on the Indonesia Stock Exchange (IDX) from 2019 to 2023. The research adopts a quantitative approach, utilizing secondary data obtained from audited financial statements of 30 selected companies over five years (2019–2023), resulting in 150 observations. The study employs SmartPLS version 4 for data analysis, including descriptive statistical tests, measurement model evaluations, and hypothesis testing through bootstrapping. The findings reveal that profitability and liquidity have a significant positive effect on financial distress, while leverage has a significant negative effect. Furthermore, company size moderates the relationship between liquidity and financial distress but does not moderate the effects of profitability and leverage on financial distress. The research concludes that effective financial management, particularly in maintaining profitability and liquidity, is essential in reducing financial distress. Additionally, company size plays a critical role in strengthening liquidity's impact on financial distress. These findings provide theoretical contributions to financial literature and practical implications for corporate financial management and investment decision-making.

Abstract

The development of digital technology has significantly impacted various fields, including law, particularly in employment agreements. A key innovation is using electronic signatures, which enhance the efficiency and effectiveness of drafting legal documents. However, in Indonesia, the implementation of electronic signatures faces challenges such as regulatory issues, technical barriers, and societal acceptance. This study analyzes the validity of electronic signatures in employment agreements under Government Regulation Number 35 of 2021 and Law Number 1 of 2024 concerning the Criminal Code. Using a normative juridical approach, the research examines electronic signatures' compliance with contract law principles and the legal validity outlined in Law Number 11 of 2008 on Electronic Information and Transactions (ITE Law). The findings confirm that electronic signatures are legally recognized if they meet the criteria in Articles 5 and 11 of the ITE Law. Government Regulation Number 35 of 2021 and Law Number 1 of 2024 further support the legality of electronically signed employment agreements. However, challenges remain, such as low digital literacy and inadequate digital infrastructure. To overcome these, the study recommends improving digital literacy, strengthening data security, and enhancing regulations to support electronic signature adoption in employment agreements, ensuring their effective use in the digital era.

Abstract

This research aims to identify the effect of work-life balance and transformational leadership on the turnover intentions of PT employees. X. Data obtained from the Company explains that the employee turnover rate in 2023 is 38.4%, which indicates that employee intentions to leave the company may also be quite high. Two predictors are raised to predict turnover intentions, namely work-life balance and transformational leadership, which are taken based on employee exit interview data. The research method used is a quantitative approach with a correlational analysis design to determine the relationship between predictor variables and outcome variables and multiple linear regression analysis to determine the magnitude of the influence of predictor variables on outcome variables. This study involved 245 respondents selected using purposive sampling techniques. The analysis results show that work-life balance and transformational leadership have a significant negative relationship with turnover intentions. In addition, work-life balance and transformational leadership also significantly negatively affect turnover intentions of 32.8%. The results of the multiple linear regression analysis show a significant negative influence value from the transformational leadership variable of t = -8.04 which is greater than the work-life balance variable of t = -4.31. The results of this study are expected to be input for companies to create programs or provide treatment for employees in order to improve transformational leadership and work-life balance to reduce the intention to move companies in employees and manage employee retention in the company.

Abstract

This research aims to analyze the impact of the 'America First' policy, particularly with regard to illegal immigrants, on bilateral cooperation between the United States (US) and Mexico in 2025. The 'America First' policy that focuses on border security and immigration enforcement is expected to put pressure on US-Mexico relations, especially in the areas of trade, security, and border management. Through a qualitative case study approach, this research will examine how changes in US immigration policy affect the dynamics of cooperation in various sectors, including the economic impact of immigration restrictions, the security implications associated with increased activity at the border, and Mexico's response to the policy. The Mexican government is not solely responsible for the illegal movement of its citizens into the United States. The results of the study are expected to provide a deeper understanding of the challenges and opportunities in the US-Mexico bilateral relationship amid the 'America First' policy, as well as provide recommendations to maintain stability and sustainability of cooperation in the future.

Abstract

The effectiveness of Japan International Cooperation Agency (JICA) foreign aid in the Jakarta Mass Rapid Transit (MRT) project plays a crucial role in infrastructure development in developing countries, particularly those funded by external sources such as Japan. By applying the concept of Paris Declaration on Aid Effectiveness and qualitative method with descriptive-analytical approach, this research focuses on the fulfillment of five principles of aid effectiveness namely ownership, alignment, harmonization, managing for results, and mutual accountability by JICA as the donor and the Government of Indonesia as the recipient. The result shows that although the foreign aid from JICA has a positive impact on infrastructure development in Indonesia, the Special Terms for Economic Partnership (STEP) financing scheme used creates limitations in the selection of main contractors and hampers the tendering process. Attachment to one donor limits Indonesia's flexibility to determine its development strategy. Continuous efforts and evaluation in approving aid schemes periodically are needed to ensure the effectiveness of foreign aid in funding infrastructure projects in Indonesia.

Abstract

Regulations for acupuncture practice in Indonesia are based on Law No. 17 of 2023 concerning health and Permenkes No. 34 of 2018 concerning license and practice regulation of acupuncture therapists. In Indonesia, acupuncture treatment consists of traditional acupuncture done by acupuncture therapists and medical acupuncture done by doctors, both acupuncture specialists and general practitioners. This research titled "Legality of General Practitioners in Carrying Out Acupuncture Treatment" aims to analyze the authority of general practitioners in carrying out acupuncture treatment and the liability between general practitioners and patients when carrying out acupuncture treatment. This research uses a normative juridical method with two approaches, namely the statuary approach and the conceptual approach. The results of this research are that currently, in Indonesia, there is a void of norms that regulate the authority of general practitioners in doing acupuncture treatment. Therefore, besides liability in the form of default and acts against the law in the field of civil penal law between doctors and patients, general practitioners can also be held responsible in the field of penal law and administrative penal law.

Abstract

This research investigates the effectiveness of various language learning models in improving students' skills in writing anecdotal texts at the secondary school level. The primary research problem addresses the gap in the existing teaching methods for anecdotal text writing and the need for innovative, intercultural, and project-based learning models. The objective of the research is to evaluate the impact of project-based learning, technology, and intercultural communication strategies on students' writing and critical thinking abilities. The research method used is a Systematic Literature Review (SLR), analyzing 50 relevant articles published in the last five years. Results show that project-based learning models and technology such as Grammarly and other digital media can improve students' writing and critical thinking skills. The intercultural approach also plays an important role in building cross-ethnic cultural understanding between teachers and students. However, there are limitations on the implementation of technology and generalization of research results, so further research is needed for the development of a more inclusive model.
