Abstract

Some benefits of zakat is as form of faith to Allah, but also it has bigger own contribution in process of building Muslim personality as the community and state member. Beside of that, it also could increase the form of social and solidarity as the relationship soul between the rich and poor level. So it will formed balancing of economic empowerment and falah or winning. Contextual understanding about zakat revenue consisted of eight level which is called 8 asnaf 9 (groups) it caused the purpose of zakat will not achieved, because zakat fund distribution to them just only in kind of charity. Furthermore, for the achievement of zakat purpose and benefits of zakat obligation, so the comprehensive and contextual understanding about eight groups or asnaf of zakat receiver need to be done, so the group which has the right to get the fund of zakat will receive their right. This research has the objective to explained how the interpretation of asnaf zakat in contextual classic and contemporary fiqh and to give a brief explanation about the function of zakat to economic empowerment of Muslim community. In alQur’an, the word of zakat and praying was called as many as 82 times in the sequence of words which is successively, so zakat has it owns position as same as praying and we can find more or less 27 articles that put in line the praying with the obligation of zakat payment. The result of research has shown that the understanding of 8 asnaf (groups) should be studied again universally, where at this time the meaning and concentration to the mustahik zakat in the narrow scopes. Zakat is related with relocation of economic source that can enhance the poor’s level to higher degree. To empower of zakat potential economically it’s mean we think how to take the benefit of zakat as one of economic source which can get the benefit or result, maximum and optimal of consumptive and productive benefits, and also, to solve the poverty problem and economic empowerment of Muslim community also to prevent the happen of wealth concentration from some group of people. In term of economic empowerment of Muslim community and eradication of poverty, so the institutions of zakat have to apply the management of zakat based on the development and empowerment, so the presence of those institutions could be the real helper for mustahiq zakat of zakat receiver.

Abstract

Social and cultural life Arab jahiliyyah society changed through the process of diffusion. This means that Muhammad SAW brought Islam started preaching of those nearby and continues to others. On the name of religion, the changing social and cultural life of the society in this case is not differentiated between the period of Mecca and Medina. The question iswhat isthe purpose of thesocio-cultural changes? howsocial and cultural changes in Arab jahiliyah society reviewed fiqhal-Hadith?. The results ofthis study; First, socio-culture is the product ofthought, emotion and human initiativein full of their need sandlargely followed thepractice that has been done ancestors. Second,social and cultural lifeof Arab jahiliyah society contained inthe hadithis classified, among others; language, knowledge systems, socialorganization, equipment of life systemsandtechnology, livelihoodsystems, the religious, and the arts. Social and culturallife of theArabjahiliyah society is omitted, repaired, maintained and thereis new.

Abstract

This study aimed to know the factors of Worship, Zakat Knowledge, Wealth, Role of Government, The Role of Ulama and the Credibility of institutions Amil Zakat influence of Motivation Paying Zakat, To know the factors of Worship, knowledge, charity, property , the role of government, the role of Ulema and the Credibility of Institutions influential Partial Amil Zakat and Zakat Simultaneous to the magnitude of value. The method of analysis used the method of descriptive analysis and multiple linear regression analysis. The results showed that factors of worship, knowledge of charity, property or income, the role of scholars and credibility of institutions partially amil zakat has positive and significant impact on motivation to pay zakat, while the factors positively influence the role of scholars and not significant to the motivation to pay zakat. Simultaneously factors of worship, charity knowledge, wealth or income, the role of government, the role of scholars and credibility amil zakat institutions have a positive and significant impact on motivation to pay zakat.

Abstract

Pembahasan ushulfiqh adalah seputar hukum, dalil-dalil dan pembagiannya, teori pengambilan hukum dari dalil dan kode etik seorang pengambil hukum. Rukun hukum ada empat, yaitu: hakim; mahkumalayh; mahkumfih, dan hukum itu sendiri. Sebagai salah satu rukun hukum, persoalan tentang hakim adalah penting, sebab berkaitan dengan pembuat hukum dalam syariat Islam. Sementara itu, ketika melihat produk hukum yang telah diciptakan oleh para mujtahid, syarat wajib, atau pun syarat sah dari sebuah perbuatan baik yang bersifat ‘ubudiyah, mu‘amalah ataupun munakahah, sama sekali tidak melepaskan poin ‘aqil (berakal) bagi para pelakunya. Di lain masalah, problematika penentuan sah atau batal, wajib atau haram dan baik atau buruk bagi sebuah perbuatan, terkadang menggunakan ukuran akal, seperti keharamanmengkonsumsi benda-benda yang membahayakan badan atau nyawa, seperti mengonsumsi racun. Setelah penulis melakukan analisis dalam berbagai literatur, ternyata menurut kajian ushulfiqhakal berperan untuk menetapkan ahliyah (kepatutan) dan taklif (pembebanan hukum) pada diri seseorang, akal dan istinbath mempunyai keterkaitan erat karena adanya penggunaan akal maka adanya istinbath, dan yang menjadi hakim dalam hukum syariat adalah Allah Swt. Sedangkan akal hanya berperan untuk menyingkap makna-makna yang tersirat yang terkandung dalam nash untuk menetapkan hukum pada persoalan-persoalan yang tidak ada nashnya, baik dalam Alquran maupun hadis. Akal tidak mengandung kebenaran absolut di dalamnya, tetapi hanya bersifat relatif. Ini menurut pandangan jumhur ulama fikih. Adapun menurut Mu‘tazilah, akal berperan secara absolut dalam menetapkan hukum-hukum syariat. Akal berperan penting dalam menetapkan hukum-hukum setiap persoalan yang muncul karena di antara dalil hukum adalah dalil akal, yaitu al-qiyas, al-istihsan, al-istishab, al-mashlahahal mursalah, dan saddal-dzara‘i.
