Abstract

Artikel ini mengkaji hak dan kedudukan perempuan korban pelecehan seksual dalam hukum acara pidana. Tujuan utama penelitian ini adalah mengkaji pemanfaatan perlindungan hukum dalam hukum acara pidana untuk menjaga hak-hak perempuan yang mengalami pelecehan seksual. Selain menjadi sasaran pelecehan, perempuan sering kali dianggap sebagai penyebab dan penggerak kejahatan pelecehan, sehingga terkadang mereka tidak mendapat perlindungan hukum yang sesuai. Perempuan sebagai korban pelecehan berada diposisi yang sangat rentan dan memerlukan perlindungan khusus dan terjaminnya hak-hak yang sesuai dan efektif. Penelitian ini menggunakan pendekatan kualitatif, dengan menggunakan kombinasi tinjauan literature: Meninjau teks hukum, keputusan pengadilan,dan penelitian akademis yang relevan mengenai topik tersebut. Berdasarkan hasil penelitian ini, sistem hukum saat ini kurang atau tidak efektif dalam melindungi hak-hak perempuan yang mengalami pelecehan seksual. Kurangnya kesadaran dan pemahaman mengenai pelecehan seksual di kalangan profesional hukum dan masyarakat umum serta masih berkembangnya budaya patriarki didalam masyarakat. Kesimpulan penelitian ini adalah sistem hukum saat ini tidak berfungsi secara baik dalam melindungi hak-hak perempuan ketika mereka menjadi korban pelecehan seksual. Sehingga perlu adanya perlindungan khusus dimana terpenuhinya hak-hak korban dan juga meningkatkan kesadaran mengenai pelecehan dalam masyarakat yang cenderung masih terdoktrin oleh budaya patriarki.

Abstract

The role of the village head in bureaucratic reform refers to an action or contribution provided by a leader to improve a bureaucratic system to be better than before. The background of this research is due to the lack of bureaucracy responsiveness in public services in Sambibulu Village, Taman District, Sidoarjo Regency. Therefore, the research objective is to identify and analyze the role of the village head in bureaucratic reform of public services in Sambibulu Village, Taman District, Sidoarjo Regency. This research is qualitative in nature with data collection techniques including interviews, observations, and documentation. The informants are the Village Head, Village Secretary, and the villagers of Sambibulu. The theory used refers to the Servant Leadership theory by Barbuto & Wheeler (2006) which includes indicators such as Altruistic Calling, Emotional Healing, Wisdom, Persuasive Mapping, and Organizational Stewardship. The results of this study show that overall, the role of the village head in bureaucratic reform of public services in Desa Sambibulu is very significant. Through commitment, wisdom, and effective leadership, he acts as a change agent driving the establishment of a more efficient, responsive, and quality public service system. In addition, the village head is actively involved in various aspects ranging from democratic values, openness to community participation, to the ability to lead with an innovative approach. The Village Head of Sambibulu plays a role in realizing quality public services oriented towards community interests. However, there is still a gap between public expectations and reality, such as inconsistency in implementing responsive public services.

Abstract

The Pekanbaru City Population and Civil Registration Service has issued an e-government-based service, namely an application-shaped platform to help facilitate the issuance of children's identity documents, called the Cendikia service, which can be accessed via the web on the pekanbaru.go.id/kia page, where the public can submit requests for services. issuing child identity cards online without having to come and queue at the Pekanbaru City Population and Civil Registration Office. In implementing this service, there are still people who do not realize the importance of making KIA, there are overlapping applications in submitting KIA, people who do not understand how to use the Cendikia service, and there is a lack of direct socialization regarding the web-based Cendikia application service. This research aims to determine the effectiveness of Cendikia's services in accelerating the issuance of KIA documents. The theory used is Campbell's (1989) effectiveness theory in Mutiarin and Zainuddin (2014) with 5 (five) indicators, namely Program Success, Target Success, Program Satisfaction, Input and Output Levels, and Overall Goal Achievement. This research uses qualitative methods with data collection techniques obtained through observation, interviews and documentation. The results of this research show that the creation of Child Identity Cards in the Cendikia service has not been effective as seen from the indicators of the level of program success and target success, the Cendikia service still has several factors which are obstacles found in the system (internal) and outside the system (external). thus causing the implementation of these services to be ineffective.

Abstract

As a state of law, legislation is fundamentally important for the way of life of a state. Legislation is made not only to regulate the powers that exist towards the ruler and the people, but also has important points in running the life of the state in accordance with what is to be realized in the constitution. Legislation basically has binding force on the entire public, so the public should be involved in the legislative process because this is also to encourage the quality of legal products that are in accordance with developments and public needs. Public participation is one of the important foundations in making legal products that favor and provide benefits to the community. Thus, this paper addresses how a legal product is made in accordance with public needs and how legislation should be implemented by the authorities. This study also discusses how to form recommendations regarding improving the quality of public participation in the legislative process.

Abstract

The Government of Surabaya has empowered by providing Direct Cash Assistance (BLT) in accordance with the Regulations of the Mayor of Surabaya No. 130 Year 2023 on the Implementation of Direct Cash Aid to the Poor Families in the City of Surabaya through Jatim Bank and has been implemented in Klampis Ngasem Village of Surabaya, but many still do not know about the BLT of the Government of this city. As a result, the implementation of the BLT is still unclear. The research uses the Shanahan Narrative Policy Framework (NPF) Theory and descriptive qualitative methods with an approach through observations, interviews and documentation. The results of the research show that the implementation of the BLT in Klampis Ngasem Village Surabaya has been well carried out and was welcomed by the very high enthusiasm of the community. However, in Klampis Ngasem Village there is still a lack of knowledge about the BLT and the Solid Work Program because there is no socialization about it. At the micro level, societies are used to relying on help so there is no desire to be independent and difficult to move towards prosperity. At the meso level, there is still a lack of communication about the BLT of the City Government between the institutions and the related apparatus that affects public understanding. At the macro level, the lack of transparency of the data and the criteria of the recipient by the agency on the relevant apparatus. The City Government also created a culture of dependence on aid in Klampis Ngasem Village Surabaya.

Abstract

The principle of impartiality is an important element of criminal procedure law, playing a crucial role in ensuring a fair and impartial judicial process. This article discusses the importance of impartiality in criminal proceedings, both in terms of the concept and the impact of violating the principle in the justice system. The principles of fairness and impartiality require judges and law enforcers to be neutral, and not influenced by external pressure in making decisions. Implementation of the principle of impartiality ensures that every individual is treated equally in the eyes of the law, in accordance with the principle of equality before the law. Violation of this principle can result in injustice, cause harm to the parties involved, and reduce public trust in the justice system. This confirms that the principle of impartiality is not only an ethical norm, but also the foundation of substantive justice in criminal law. Therefore, upholding the principles of fairness in criminal proceedings is crucial to maintaining the integrity and fairness of the justice system in Indonesia. To improve the implementation of the principle of impartiality, various strategic steps need to be taken, such as providing intensive training to judicial officers, strengthening supervisory mechanisms, increasing transparency in the judicial process, and strengthening the enforcement of professional ethics. In addition, active public participation in the judicial process must be encouraged.

Abstract

Bullying and intimidation are several forms of bullying that we often encounter on campus, neighbors and in the office, especially in the school environment. Bullying can be done in various ways, including physical, mental and social media. The targets of bullying are usually accepted or experienced by weak people who cannot resist these actions. Bullying itself is regulated in article 76C of Law Number 35 of 2014. The focus of the problem that we will examine is "Psychoeducation: Socialization of the impact of criminal bullying in accordance with existing laws on Santa Maria Monica Middle School Students for Mental Health" with the aim of preventing bullying behavior that often occurs in the school environment. The method we will use in this research is psychoeducation or socialization which we explained in the counseling. The impact of the activities we provide is that students at SANTA MARIA MONICA SMP get deeper knowledge about the dangers of bullying behavior on a person's mental health. Apart from that, understanding how to prevent and deal with bullying behavior.

This is a very important key to strengthen the capacity between authorities and service providers to achieve the improvement of a system to deal with cases of sexual violence.

Abstract

The BLU-E smart card is one of the programs developed by the Indonesian Ministry of Transportation, in this case it aims to facilitate the distribution and issuance of proof of passing periodic motor vehicle tests so that it is fast, efficient, integrated, transparent and reduces data leaks. This research aims to find out and understand how the BLU-e Smart Card is implemented in KIR Services in Pekanbaru City and the supporting and inhibiting factors in the implementation of BLU-e Smart Cards in KIR Services in Pekanbaru City. The theory used in this research is aspects of program implementation according to Jones in Dedi et al. (2017) which is divided into three main indicators, including organizational aspects, interpretation aspects, and implementation or application aspects. The research method used is a qualitative approach with descriptive methods. The data collection techniques in this research are observation, interviews and documentation. The data analysis techniques used are data reduction, data presentation and drawing conclusions. The results obtained in this research are that the implementation of the BLU-e Smart Card in KIR Services in Pekanbaru City is quite good. Where the supporting factors in using the BLU-e smart card at the UPT-PKB of the Pekanbaru City Transportation Service are ease of access, minimal fraud, and transparency of the budget used. The inhibiting factor in using BLU-e smart cards at the UPT-PKB of the Pekanbaru City Transportation Service is that there are still many people who do not understand the use of BLU-e Smart cards and there is a lack of public awareness of the benefits of vehicle fitness testing.

Abstract

Community Advisors are professional officers who work under the Ministry of Law and Human Rights, especially in the Directorate General of Corrections. They are in charge of providing guidance, counseling, and assistance to inmates and correctional clients, including children who are facing the law. The Roles and Responsibilities of Community Advisors are: legal and social assistance, rehabilitation and reintegration, individual and family counseling, supervision and evaluation, coordination with relevant institutions, reports and documentation. Community guidance has a central role in ensuring that children involved in the criminal justice system receive the support they need to reintegrate properly into society. The purpose of this study is to find out what the role of community guidance is and what are the obstacles experienced by community supervisors in handling children who are facing the law. The research method used is an empirical juridical research The results of the study show that: (1) The role of community supervisors is very significant in supporting the implementation of SPPA in Bapas Class II Kupang. They not only act as facilitators in the rehabilitation process, but also as mentors and supporters for children in the criminal justice system. Community counselors are actively involved in developing rehabilitation programs that are tailored to the individual needs of children, providing counseling services, and assisting in the formation of social skills and life skills necessary for reintegration into society. (2) The main obstacles faced by community advisors include limited resources, such as inadequate budgets, and high workloads due to the number of cases exceeding the capacity of employees handling ABH cases. In addition, the obstacles to coordination with related agencies, including judicial institutions, police, and social services, are also a significant challenge, hindering the implementation of integrated rehabilitation program.
