Abstract

The digital era has increased global dependence on cyber infrastructure, yet it has also created vulnerabilities to transnational cyberattacks. This phenomenon becomes legally complex when attacks are carried out by non-state actors, raising fundamental questions about the accountability of the state from which such attacks originate. This research aims to analyze the application of the principle of state responsibility in international law, particularly concerning how the actions of non-state actors can be attributed to a state. Furthermore, this study identifies the fundamental juridical challenges in the process of evidence-gathering and law enforcement against states suspected of involvement or negligence. Using a normative legal research method with a statute approach and a case study approach, this article examines primary and secondary legal sources such as the Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA), the UN Charter, and relevant doctrines including the Tallinn Manual 2.0. The findings indicate that the attribution standard based on 'effective control' is difficult to meet in the context of anonymous and decentralized cyberattacks. Consequently, the focus of responsibility shifts to the breach of the due diligence obligation, where a state can be held accountable if proven negligent in preventing or responding to malicious cyber activities from its territory. Nevertheless, significant challenges remain in terms of technical evidence and the limitations of effective, non-escalatory international enforcement mechanisms

Abstract

Kasus penemuan mayat wanita korban mutilasi dalam koper di Ngawi menjadi perhatian publik karena unsur kekerasan dan kejahatan yang mengerikan. Mayat korban ditemukan pada 23 Januari 2025 di sebuah selokan di Desa Dadapan, Ngawi. Identitas korban diungkap sebagai Uswatun Khasanah (29), yang tubuhnya ditemukan tanpa kepala dan kaki. Investigasi mengarah pada tersangka utama, Rohmad Tri Hartanto alias Antok (32), yang memiliki hubungan dekat dengan korban. Motif kejahatan diduga terkait dengan kecemburuan dan permasalahan pribadi. Potongan tubuh korban ditemukan di beberapa lokasi terpisah, menunjukkan tindakan terencana dari pelaku. Kasus ini menyoroti urgensi pencegahan kekerasan dalam hubungan personal serta pentingnya penegakan hukum yang ketat terhadap kejahatan mutilasi.

Abstract

Human trafficking poses a serious challenge in the modern world and requires serious attention from the international community. This journal discusses the role of international law in efforts to combat human trafficking through a review of literature studies. By analyzing various prior studies and related reports, this article investigates on how international legal developments seek to address this issue of human trafficking. Through a literature study, this article identifies the various international legal approaches that have been taken to address human trafficking as well as evaluates the effectiveness of measures as well as the challenges faced by the international community in combating human trafficking. The results of this literature review provide an understanding of the international legal landscape related to human trafficking, as well as identify areas where further efforts are needed. This article concludes the importance of interstate cooperation and effective implementation of laws in efforts to combat human trafficking effectively worldwide.

Abstract

In facing the challenges of globalization and increasing financial crimes such as money laundering and terrorism financing, the Know Your Customer (KYC) principle is an important pillar in maintaining the integrity of the financial system in Indonesia. This article analyzes the legal aspects of the application of the KYC principle in Indonesian banking institutions using a normative legal approach. The study was conducted on various regulations that serve as the legal basis, including Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering, as well as regulations from the Financial Services Authority and Bank Indonesia. The findings show that although the legal framework is available and the implementation of KYC has made a significant contribution to identifying and preventing suspicious transactions, there are still implementation challenges such as limited human resources, technology gaps, and ownership of official documents by customers. To increase the effectiveness of KYC, it is necessary to increase human resource capacity, utilize advanced technology, and strengthen cross-country cooperation in combating financial crimes.

Abstract

Indonesia merupakan negara hukum yang semua landasannya harus memiliki hukum yang jelas dan sesuai dengan konstitusi Indonesia. Indonesia memiliki banyak peradilan seperti peradilan pidana dan peradilan militer yang dimana dua peradilan ini berjalan beriringan. Peradilan pidana sebagai sumber utama yang mengatur segala bentuk perbuatan rakyat Indonesia, sedangkan peradilan militer merupakan peraturan perundang-undangan yang mengatur serta mengikat bagi anggota Tentara Nasional Indonesia. Hukum pidana dengan hukum militer memiliki keterkaitan yang linier, namun terdapat perbedaan dalam pemidanaannya antara hukum pidana dan  hukum militer karena dalam hukum militer memiliki aturan yang lebih dikhususkan bagi Tentara Nasional Indonesia. Bagi Tentara Nasional Indonesia yang melakukan tindakan pelanggaran pidana maka ia juga akan dikenakan pemidanaan militer. Penelitian ini akan membahas tentang perbedaan pidana pokok dalam pidana umum dan pidana militer dan bagaimana pengaturan serta pelaksanaan pemidanaan pada kedua pemidanaan tersebut. Penelitian ini menggunakan metode yuridis normatif dengan studi literatur. Hasil penelitian ini menunjukan bahwa terdapat perbedaan pemberatan pemidanaan antara hukum pidana umum dengan hukum pidana militer bagi Tentara Nasional Indonesia.

Abstract

Purpose: This study aims to analyse the impact of the digital revolution on the emergence and transformation of criminal behaviours. It focuses on understanding how digitalization has influenced the nature, method, and scope of crimes, particularly in the context of cybercrime, digital fraud, data exploitation, and hacking. Research Methodology: The research adopts a qualitative approach, utilizing literature review and theoretical analysis. Various contemporary criminological theories are employed to interpret the changing patterns of criminality in the digital era. Results: The study reveals that the digital revolution has significantly altered criminal behaviour. New types of crimes have emerged, characterized by their transnational nature, anonymity, and reliance on technological tools. These developments challenge traditional law enforcement mechanisms and demand updated frameworks for crime prevention and investigation. Conclusion: The evolution of crime in the digital age necessitates urgent reforms in legal, regulatory, and security systems. Traditional approaches are no longer sufficient to address the complexities of digital crime. A multidisciplinary and adaptive response is crucial. Limitations: This study is limited by its reliance on secondary data and theoretical frameworks. Further empirical research is needed to validate the findings and explore region-specific crime patterns in more detail. Contribution: The study provides a conceptual foundation for policymakers and legal practitioners to develop technology-based, forward-looking criminal justice policies. It also contributes to the academic discourse on the intersection between digital transformation and criminology.

Abstract

This study discusses the comparison between the governance system during the time of Prophet Muhammad (peace be upon him) and the governance system in Indonesia, particularly from the perspective of Kuntowijoyo’s prophetic political theory. The governance system in the Prophet’s era and modern Indonesia have fundamental differences, yet both can be comprehensively analyzed through Kuntowijoyo’s prophetic politics, which emphasizes the values of humanization, liberation, and transcendence. The Prophet’s governance was based on divine revelation, incorporating principles of consultation (shura), social justice, and respect for the diversity of the Madinah community, exercising power as a moral trust within a theodemocratic system. Meanwhile, Indonesia’s governance adopts a representative democracy with separation of powers and legitimacy derived from the people’s mandate through elections, but it still faces challenges in fully actualizing prophetic values. Therefore, political and ethical leadership reforms grounded in prophetic political principles are essential so that modern governance not only operates formally and legally but also realizes social justice and structural liberation, leading to a civilized and dignified society.

Abstract

Sharia economic law has become a crucial pillar in the development of the economy in Indonesia, particularly in the context of entrepreneurship. This article aims to analyze the role of sharia economic law in promoting the growth of entrepreneurship in Indonesia, focusing on the fundamental sharia principles underlying economic transactions. Through a qualitative approach, this study explores various sharia financing products, such as murabahah, musyarakah, and mudharabah, which provide better financing access for entrepreneurs, especially among communities underserved by conventional financial systems. Additionally, this article discusses the challenges faced in implementing sharia economic law and provides recommendations to enhance understanding and application of sharia principles in the entrepreneurial world. The research findings indicate that sharia economic law not only contributes to increased access to financing but also promotes innovation and sustainability in entrepreneurial practices. Thus, the role of sharia economic law is highly significant in creating and realizing an inclusive and sustainable entrepreneurial ecosystem in Indonesia

Abstract

This research examines the tension between the application of international humanitarian law and the legal needs of the military in maintaining state sovereignty during armed conflict. Using normative juridical methods, the study analyses the legal framework governing military action and the protection of civilians in conflict situations. The research focuses on three issues: the effectiveness of applying humanitarian law without compromising military strategies to safeguard sovereignty; obstacles in ensuring civilian protection and solutions from humanitarian law; and synergies between military law and humanitarian law without compromising operational effectiveness. The results show that the dilemma between military and humanitarian interests can be harmonised through proper interpretation of the principles of proportionality, distinction, and precaution, as well as the development of military doctrine that  integrates humanitarian values. The research concludes that strengthening compliance mechanisms, humanitarian law training for military personnel, and improving rules of engagement are crucial steps to balance military imperatives with humanitarian protection in contemporary armed conflicts.
