Abstract

The rapid development of technology has led to a transformation in gambling practices, shifting from physical establishments to online platforms. However, law enforcement in Indonesia continues to struggle with multiple challenges in addressing this issue. This research aims to assess the enforcement of online gambling laws based on Lawrence M. Friedman’s legal system theory. It focuses on how legal structure, legal culture, and legal substance interact in the enforcement process.  The findings demonstrate that, first, in terms of legal substance, existing regulations are not yet fully effective in combating online gambling. Second, from the perspective of legal structure, law enforcement agencies face persistent challenges in combating online gambling. Third, from the perspective of legal culture, public legal awareness remains relatively low.

Abstract

This study aims to analyze the legal implications of the luxury goods Value Added Tax (VAT) increase policy in Indonesia, which will take effect in January 2025. This policy is based on Law Number 7 of 2021 on the Harmonization of Tax Regulations and its derivative regulations, with the objective of increasing state revenue and reducing the consumption of luxury goods, which is often associated with economic inequality. This research employs a normative method with a literature study approach, analyzing tax regulations, academic journals, and relevant literature. The findings indicate that while this policy may enhance tax revenue and reduce economic disparity, its implementation faces challenges related to legal certainty, tax compliance, and its impact on consumer purchasing power and investment in the luxury goods sector. Additionally, the potential rise in tax disputes due to differing interpretations of luxury goods classification is a major concern. Abstract

This study aims to analyze the state's authority in organizing electronic systems related to freedom of expression in the digital world. The development of technology that gives rise to a dilemma between the needs or activities of society and regulations to protect public interests and individual human rights, especially freedom of expression, makes it necessary to have regulations that accommodate both of these things. Through a prescriptive normative legal research method with a statutory approach, through an analysis of laws and regulations, legal literature, and international human rights instruments, this study examines the state's authority in regulating the implementation of electronic systems that are pro-freedom of expression. The results of the study indicate that the state has the authority to regulate the implementation of electronic systems to determine and enforce restrictions on a person's human rights, which in this case is shown through the ability to terminate access to content. However, the implementation of the provisions that have been in effect has the potential to violate the right to freedom of expression because of the possibility of restrictions on rights that do not meet the principles of legality, legitimate purposes, and proportionality as regulated by laws and regulations, especially the constitution and international human rights standards.

Abstract

The dissemination of information that cannot be proven true or what is often called fake news is very vulnerable today. In reporting, the press has a responsibility in the event of an objection to a news report. Based on the Press Law, the press is obliged to serve the right of reply and the right of correction to public complaints about press coverage. Regarding fake news in Indonesia, the regulations are contained in the Criminal Code, ITE Law, Broadcasting Law and other laws. This research aims to find out the regulations that become the legal umbrella for victims of fake news perpetrated by the press and the extent to which the press is responsible for fake news in the news. The research method used is a literature study using primary, secondary and tertiary legal materials.

Abstract

The evolution of social media and its algorithms has transformed the dissemination of Pancasila as Indonesia’s national ideology. This study aims to analyze the representation of Pancasila in algorithmically curated digital discourse and its impact on public understanding. A qualitative approach, combining digital discourse analysis and netnography, was applied to examine content on Twitter, Facebook, Instagram, and YouTube. Findings reveal the dual role of social media algorithms: while facilitating educational content on Pancasila (e.g., religious tolerance, human rights campaigns, and nationalism), they also amplify polarizing content, hoaxes, and hate speech that contradict Pancasila values. Analysis of Pancasila’s five principles shows that conflict-driven content (e.g., ethnic-religious issues) gains higher virality due to algorithms’ prioritization of engagement metrics. The filter bubble and echo chamber phenomena exacerbate discourse fragmentation, hindering inclusive dialogue about national ideology. The study concludes that Pancasila-based digital literacy, algorithmic transparency, and multistakeholder collaboration are critical to optimizing social media’s role in strengthening national identity. Policy recommendations include integrating "social cohesion" parameters into algorithm design and regulating content to uphold diversity.

Abstract

Micro, Small and Medium Enterprises (MSMEs) play a significant role in the economy, but often face obstacles in accessing financing. Credit performance guarantee is one of the mechanisms to mitigate risks for financial institutions. Along with the development of financial technology, innovative credit scoring emerged as an alternative method of assessing the creditworthiness of MSMEs. This research aims to analyze the legal effectiveness of the application of MSME credit performance guarantees based on innovative credit scoring. This research uses a normative juridical method with qualitative juridical analysis to try to examine and analyze the problems studied. The application of innovative credit scoring in MSME credit performance guarantees has the potential to increase the legal effectiveness of guarantees through a more comprehensive and accurate risk assessment. However, its implementation requires regulatory clarity regarding scoring standards, personal data protection, and dispute resolution mechanisms. An adaptive and responsive legal framework to technological innovation is crucial to optimize the role of innovative credit scoring in strengthening the effectiveness of MSME credit performance guarantees and promoting financial inclusion.

Abstract

The phenomenon of buying and selling photocards is growing among music fans, with X social media widely chosen as a platform for buying and selling due to its ease of access and wide reach. However, this practice often raises legal issues, especially regarding the occurrence of fraud by the seller through the provision of false evidence of goods or the sale of non-original goods. This study aims to analyze the legal implications of photocard sale and purchase agreements that contain elements of fraud. This study uses a normative legal research method with a statutory approach and a conceptual approach. Based on the results of the research, it is known that the agreement containing elements of fraud does not fulfill the subjective aspects in the validity of the agreement as stipulated in the Civil Code (KUHPerdata), thus causing a defect of will. As a result, the agreement can be canceled through the mechanism of requesting cancellation in court.

Abstract

Disputes over general election results (PHPU) at the Constitutional Court reflect the critical role of evidence in resolving electoral conflicts. However, in practice, there exists an imbalance in the evidentiary process between the disputing parties. This study aims to analyze such disparities using a normative juridical approach by examining laws and regulations, Constitutional Court decisions, and relevant legal literature. The findings indicate that evidentiary issues in PHPU are influenced not only by formal and material legal aspects but also by the political dynamics that accompany every electoral contest. Unequal access to evidence, disparities in evidentiary capacity among parties, and the Court’s limited ability to conduct active examinations exacerbate this imbalance. Additionally, political interests often influence perceptions of the independence of evidence and the objectivity of court decisions. Therefore, there is a pressing need to strengthen technical regulations on evidence, enhance the evidentiary capacity of disputing parties, and optimize the Constitutional Court’s role in maintaining balance in the evidentiary process. In conclusion, the imbalance of evidence in PHPU at the Constitutional Court stems not only from procedural weaknesses but also from the political interests surrounding the trial process. Reforming the evidentiary system is urgently needed to uphold the principles of electoral justice in Indonesia.

Abstract

The phenomenon of illegal cigarette circulation can still be found especially in Jember district. The characteristics of illegal cigarettes include the absence of excise stamps on the cigarette packs, attaching cigarette packs with fake excise tape or placing excise tape that is not in accordance with its intended use. The Directorate General of Customs and Excise has the authority to take action and investigate illegal cigarette distributors in accordance with Law Number 39 of 2007 concerning amendments to Law Number 11 of 1995 about excise. The purpose of this researcher is to find out the law enforcement process against illegal cigarette dealers in Jember Regency by the Jember Regenc KPPBC. This research method uses empirical legal research. Primary and secondary data obtained through interviews with staff of the prosecution and investigation section of the Jember Regency KPPBC. The data analysis method is descriptive qualitative. The results of this study are that law enforcement carried out by the Jember Regency KPPBC has not been able to be carried out optimally because in its implementation there are many obstacles such as a very wide illegal cigarette distribution network so that there isa lack of officers. However, these various obstacles can hopefully be overcome with existing efforts.

Abstract

This study aims to describe the implementation of kapalo samek embroidery training in Nagari Simpuruik as an effort to promote economic empowerment and preserve local culture. Based on interviews with village officials and women participating in the training, it was found that most participants had already acquired embroidery skills through self-taught methods prior to the training. They were accustomed to working on embroidery either based on custom orders or in cooperation with "fabric bosses" who provided pre-designed cloth and threads. Embroidery has become a productive activity in Jorong Sijangek, mainly practiced by housewives. Although the training was conducted smoothly, the main challenge was gathering participants due to their limited availability. The market potential for kapalo samek embroidery is significant, especially during cultural or ceremonial events, but a major obstacle lies in marketing capabilities, particularly in digital platforms. Therefore, the training also served as a medium to introduce basic marketing strategies for craft products. In addition to enhancing economic capacity, the activity encourages cultural preservation by regenerating embroidery skills among the younger generation. This embroidery training highlights the importance of local initiatives in safeguarding cultural heritage and improving community welfare.
