Abstract

Freedom of opinion is a fundamental right that has existed since birth and has been recognized nationally to internationally. There is a recognition of the guarantee of the right to freedom of opinion, it is clear that this right must be respected. Nowadays, the scope of freedom of expression of opinions is very wide. Social media is the main source of human beings to share, receive, and channel opinions without any pressure. However, there are still many civilians whose right to expression is silenced. The focus of this research is the birth of the Constitutional Court Decision Number 78/PUU-XXI/2023 as evidence that the shackles of the right to freedom of opinion are still rampant. Where the content of the decision examines several articles that are often used as a basis of reference to silence the right to freedom of opinion which has been clearly recognized and guaranteed by the constitution. The Constitutional Court's decision needs to be further studied regarding the benefits of the results of the decision for the public interest. This research is normative research using a conceptual approach and a case approach. The primary legal materials to support this research are the Constitutional Court Decisions, the Human Rights Law, and other related regulations, while the secondary legal materials are journals related to the benefits. This research shows that the Constitutional Court Decision Number 78/PUU-XXI/2023 has a good impact, unraveling the shackles on the right to freedom of opinion, upholding the legal umbre protection to freedom of opinion, and the decision is beneficial because it provides benefits for everyone and is in accordance with the conditions of maslahah.

Abstract

This research aims to provide legal certainty and a conceptual basis for determining the percentage threshold for parliamentary representation. (parliamentary threshold). The method used in this research is normative juridical (law-normative) relying on literature: books, journals, laws, Constitutional Court decisions, and the internet as the analytical tools in this study. Basically, Indonesia has quite a number of political parties. Viewed from the electoral contests from 1999 to the 2024 elections, according to Satori, Indonesia falls into the category of an extreme multi-party system. With an average of 5 or more relevant political parties in Parliament, this impacts government and political stability. Looking at its history, Indonesia has already responded to this and intends to simplify the party system in parliament. Starting from the implementation of the electoral threshold and parliamentary threshold, this is one of the government's steps towards achieving a simple multiparty system. However, it becomes a problem when the threshold numbers, especially the parliamentary threshold, increase year by year, from 2.5%, 3%, to the current 4%. However, the attainment of these percentage figures lacks a conceptual basis, as they are merely the result of agreements between political parties. Therefore, this research discusses the formulation to obtain the ideal percentage figure using Taagepera's theory, and the ideal figure in Indonesia according to Taagepera's theory is 1%.

Abstract

The principle of equality before the law is one of the main pillars in the state of law. However, its implementation is often not fully felt by all parties, especially women in the political realm. This article discusses how legal equality for women is applied in the political world, the challenges faced, and steps that can be taken to address gender-based discrimination. The case study focuses on women's representation in the Indonesian parliament and the systemic barriers affecting their participation. This analysis was carried out using normative and empirical approaches, and supported by secondary data. The results of the study show that cultural, social, and policy constraints are still the main obstacles in achieving gender equality in politics.

Abstract

The implementation of Law Number 23 of 2014 concerning Regional Government has brought about fundamental changes in the structure of authority between the central government, provinces, and districts/cities. This study examines the dynamics of governance in West Java Province, with a focus on challenges, institutional responses, and intergovernmental synergy strategies. The results of the study indicate that West Java Province faces various problems, such as institutional unpreparedness, weak cross-government coordination, fiscal limitations, and fragmentation of information systems. Meanwhile, institutional responses indicate efforts to adjust structures and innovate public services, but have not been fully integrated with districts/cities. As a novelty, this study offers a strategic policy framework based on equitable asymmetric decentralization, including the formulation of regional capacity indicators, integration of planning information systems, and strengthening cross-regional collaboration. This research is expected to be a theoretical and practical contribution in formulating a model of regional governance that is adaptive and responsive to the local context.

Abstract

This study examines the involvement of State Civil Apparatus (ASN) in practical electoral politics and its implications for democracy from a constitutional law perspective. ASN, as part of the state bureaucracy, are required to maintain neutrality to ensure honest, fair, and democratic elections. However, the reality on the ground shows that violations of ASN neutrality persist, manifested in support for certain candidates, both directly and through social media. The research method used is a normative juridical approach by examining laws and regulations related to ASN neutrality and case studies of violations that occurred in several elections. The results show that ASN involvement in practical politics not only violates regulations but also has negative implications for electoral integrity, the principle of equal political rights, and public trust in democracy. From a constitutional law perspective, ASN neutrality is part of the realization of the principles of the rule of law and constitutional democracy. Therefore, strengthening legal instruments, optimizing oversight functions, and implementing strict sanctions are needed to uphold ASN neutrality while strengthening the quality of democracy in Indonesia.

Abstract

This study aims to examine the legal policy of the Indonesian government in determining the COVID-19 vaccination policy and the extent to which its implementation meets the principles of justice, especially in terms of equal access and an educational approach to the community. The research method used is a normative qualitative approach with an analysis of laws and regulations, official government documents, and scientific literature. Data were collected through literature studies and analyzed descriptively-analystically. The results of the study show that although the vaccination policy was designed as a form of protecting the public interest, its implementation still faces challenges in terms of inequality in vaccine distribution, lack of public education, and a legal approach that tends to be coercive. For this reason, the vaccination policy needs to be reviewed to emphasize the principles of social justice, respect for human rights, and public participation as part of a responsive and democratic legal policy.

Abstract

Penelitian ini menganalisis penguatan fungsi Badan Pemeriksa Keuangan (BPK) sebagai Supreme Audit Institution melalui tindak lanjut hasil pemeriksaan keuangan negara. Metode yang digunakan adalah yuridis normatif dengan kajian peraturan perundang-undangan, dokumen resmi BPK, dan literatur akademik. Hasil penelitian menunjukkan bahwa meskipun landasan hukum BPK kuat, mekanisme tindak lanjut rekomendasi masih formalistik dan administratif, sehingga efektivitas pengawasan keuangan negara terbatas. Hambatan muncul dari tumpang tindih kewenangan antar-lembaga, keterbatasan kapasitas teknis entitas auditee, lemahnya pengawasan DPR, dan budaya birokrasi yang lebih loyal pada kepentingan politik daripada norma hukum. Strategi penguatan BPK harus multidimensi, meliputi penguatan regulasi dengan sanksi tegas, koordinasi kelembagaan yang jelas, harmonisasi dengan standar internasional (ISSAI), serta pengawasan publik berbasis transparansi dan partisipasi masyarakat. Pendekatan ini menegaskan posisi BPK sebagai guardian of public money yang efektif dan akuntabel, mendorong tata kelola keuangan negara yang transparan, akuntabel, sesuai standar internasional, dan memperkuat prinsip checks and balances serta pemenuhan hak rakyat.

Abstract

The Indonesia, as an archipelagic nation, faces complex social, cultural, and economic challenges within the maritime space, which demand inclusive, responsive, and socially just legal formulations. This article examines the relevance of maritime legal norms to the social structure of coastal communities through a sociological perspective. The primary objective of this research is to analyze how a sociological approach to law can be used as a method for formulating maritime legal policies that are contextual and adaptive to the dynamics of coastal communities. This sociological approach demonstrates that good law is not only formally valid but also socially legitimate because it reflects local values, customary wisdom, and the just distribution of marine resources. The study's findings demonstrate that maritime legal reform must involve community participation, accommodate legal pluralism, and be based on the needs and social structure of coastal communities. By integrating formal norms and social practices, national maritime law can become an instrument for just, democratic, and sustainable social engineering.
