HOKI: Jurnal Ilmiah Hukum Keluarga Islam merupakan inisiatif dari Jurusan Hukum Keluarga Islam, Universitas Sunan Drajat Lamongan. Tujuan utamanya adalah untuk memfasilitasi mahasiswa, dan/atau Civitas Akademika yang memuat diskusi ilmiah mengenai perkembangan isu-isu hukum di Indonesia saat ini serta untuk mempublikasikan penelitian hukum inovatif mengenai hukum dan sistem hukum Indonesia. Kajian ini pada dasarnya memuat topik-topik baru tentang hukum dan sistem hukum Indonesia. Kisaran konten yang dicakup oleh ulasan ini mencakup dari bidang hukum seperti hukum Islam, hukum perdata, dan hukum publik yang meliputi: Hukum Islam Hukum tata negara dan administrasi Hukum Kriminal berbagai pendekatan Studi hukum seperti perbandingan hukum, hukum dan ekonomi, dan sosiologi hukum, dan Bagian lain yang berkaitan dengan isu-isu kontemporer dalam hukum. Naskah tentang subjek yang tidak tersedia pada daftar di atas akan dipertimbangkan, sepanjang topik tersebut menyangkut atau terkait dengan hukum Indonesia.

Abstract

The role of autopsik expert witnesses is very important in the process of proving criminal cases, especially murder. The process of examining criminal cases in court, there must be two valid pieces of evidence as a minimum standard. In relation to murder cases, judges need autopsik experts to find out the causes of a crime. The autopsik expert's testimony in the Visum et Repetrium plays an important role in deciding a criminal case, because it contains information about the causes that are the result of murder.

Abstract

Early marriage is a significant social issue in Indonesia, considering its impact on individual and societal development. This article aims to analyze the social and cultural factors that influence early marriage and its impact from a sociological perspective. The study was conducted using a qualitative approach using literature studies. The results showed that customary norms, educational inequality, and economic pressures were the main factors causing early marriage. The impacts in question include poor reproductive health, psychological pressure, and socio-economic inequalities.

Abstract

The background of this research is the high rate of divorce for underage couples in KUA, Sekaran District, Lamongan Regency. So that researchers are interested in knowing what factors are the cause of divorce in underage couples and what efforts have been made by the KUA of Sekaran District, Lamongan Regency to reduce the number of divorces in underage married couples. The type of research used by researchers is empirical juridical research, which uses data collection techniques through observation, interviews and documentation. The data collected by the authors, then analyzed through the process of data reduction, data presentation and drawing conclusions. The results of the study showed that there was a synchronization of problems that were resolved by the KUA of Sekaran District, Lamongan Regency, but they were divorced due to economic problems, infidelity and communication. Therefore KUA provides space and time for consultation as a form of coaching or assistance. The efforts of the KUA in Sekaran District, Lamongan Regency are efforts to foster and assist marriage, and Marriage Socialization from the KUA in Sekaran District in collaboration with the Lamongan BPKBN which aims to provide understanding to the community about the purpose of marriage, the age limit for marriage, carrying out marriages according to the provisions (Islamic law, overcoming conflicts in the household, and what are the responsibilities of husband and wife in the household. Meanwhile, the KUA has currently made efforts since 2020 until now. This effort has been running for 3 years and has had a positive impact on reducing the divorce rate for underage couples in 2022 in Sekaran District, Lamongan Regency.

Abstract

Dalam Islam poligami dibolehkan tanpa perlu izin istri pertama, tetapi dalam hukum Indonesia, suami yang ingin berpoligami harus mengajukan izin kepada pengadilan dan atasannya (untuk PNS). Peraturan Pemerintah Nomor 10 Tahun 1983 dan 45 Tahun 1990 mengatur bahwa PNS pria yang ingin berpoligami harus memperoleh izin dari pejabat yang berwenang. Ketentuan ini dianggap kurang sesuai dengan Hak Asasi Manusia (HAM) karena membedakan perlakuan antara laki-laki dan perempuan dalam hal perkawinan. Penelitian ini bertujuan untuk mengeksplorasi aturan izin poligami bagi PNS dalam perspektif hukum Islam dan HAM. Hasil penelitian menunjukkan bahwa meskipun dalam hukum Islam tidak ada kewajiban meminta izin, dalam peraturan Indonesia dan Kompilasi Hukum Islam (KHI), suami yang ingin berpoligami harus memperoleh izin dari pengadilan agama dan mengikuti prosedur yang berlaku. Selain itu, HAM tidak mengatur poligami karena mengutamakan kesetaraan gender dalam perkawinan monogami. Penelitian menyarankan agar PNS yang ingin berpoligami harus mematuhi persyaratan yang ditentukan oleh undang-undang dan peraturan yang berlaku, serta berlaku adil terhadap istri-istri mereka, sesuai dengan ajaran Islam dan ketentuan hukum yang ada.

Abstract

The formation of a sakinah family is one of the goals of marriage. In its implementation, married couples must build positive and harmonious patterns of interaction in order to create harmony in the household. The type of research used is empirical legal research, which aims to see how the implementation of the pusaka sakinah program is carried out at the KUA of Paciran District, Lamongan Regency. Data collection is based on interviews with selected resource persons who understand and are directly related to the program, namely the Head of the KUA, the Penghulu, and the Extension Officer. The results showed that the implementation of the sakinah heirloom program at the KUA of Paciran District, Lamongan Regency based on analysis in accordance with Soerjono Soekanto's theory of legal effectiveness, has been carried out well but not all of them are optimal because the existing rules do not yet have firmness, such as the inclusion of the sakinah heirloom program as a requirement for divorce registration, in terms of the community, the community is enthusiastic about this program.

Abstract

The Sakinah Family Service Center (Pusaka Sakinah) is a program initiated by the Ministry of Religion to strengthen family resilience through guidance and consultation services at the Office of Religious Affairs (KUA). This research aims to analyze the implementation of Pusaka Sakinah in KUA Paciran District, Lamongan Regency and its impact on the community. The research method used is descriptive qualitative. Data was obtained through in-depth interviews, observation and document analysis. The research results show that Pusaka Sakinah has played a role in providing marriage guidance services, family conflict mediation, and family resilience education.
