Proses penyelesaian perkara pelanggaran berdasarkan Perma No. 12 Tahun 2016 yaitu pelanggar cukup melihat secara online atau dapat melihat langsung di papan pengumuman yang ada di Pengadilan Negeri untuk mengetahui putusan atas pelanggaran yang telah dilakukan. Setelah pelanggar mengetahui hasil putusan hakim yang biasanya berupa denda yang harus dibayar, selanjutnya pelanggar dapat membayar denda tersebut ke Bank BRI atau membayar langsung ke Kejaksaan untuk selanjutnya mengambil barang bukti di Kejaksaan. Masih terdapat banyak kekurangan dalam penerapan Perma No. 12 Tahun 2012, salah satunya terkait dengan pelaksanaan penyelesaian perkara pelanggaran lalu lintas tanpa hadirnya pelanggar. Permasalahannya adalah bagaimana jika pelanggar yang ditilang tidak merasa bersalah, pelanggar tidak dapat melakukan pembelaan diri karena proses penyelesaian pelanggaran lalu lintas dilaksanakan tanpa kehadiran pelanggar. Sesuai Perma No. 12 Tahun 2016, upaya hukum berupa perlawanan (verzet) hanya dapat dilakukan ketika pidana yang dijatuhkan berupa pidana perampasan kemerdekaan dan bukan pidana denda. Jadi apabila hanya dikenakan pidana denda, maka pelanggar tidak dapat melakukan upaya hukum. Salah satu yang didapat dari penelitian ini, yaitu terhadap putusan (yang sudah berkekuatan hukum tetap) termasuk dan tidak terbatas pada putusan (verstek) perkara tilang yang menjatuhkan pidana denda, apabila pelanggar merasa keberatan, tentu ada upaya hukum yang dapat dilakukan, yaitu upaya hukum luar biasa (berupa Peninjauan Kembali).The violation case settlement process is based on Perma No. 12 of 2016, offenders be able to see online, or directly on the notice board in the District Court to find out the results of the judge’s decision on violations that have been committed by the violator. After the violator knows the judge’s decision which is usually in the form of a fine that must be paid, then the violator can pay the fine to BRI Bank or pay directly to the prosecutor to then take the evidence at the prosecutor’s office. There are still many shortcomings in the application of Perma No. 12 of 2012, one of which is related to the implementation of settlement of traffic violation cases without the presence of violators. The problem is what if the ticketed offender does not feel guilty, the offender will not be able to defend himself because the process of resolving traffic violations is carried out without the presence of the violator. As per Perma No. 12 of 2016, legal efforts in the form of resistance (verzet) can only be carried out when the sentence imposed is in the form of a criminal offense of freedom and not a criminal fine. So if only a criminal fine is imposed, the offender cannot make a legal effort. One of the results of this study, which is on decisions (which have permanent legal force) includes and is not limited to verstek cases that impose criminal penalties, if the offender has objections, there is certainly a legal effort that can be taken, namely legal efforts extraordinary (in the form of a Review).

Pasca Putusan Mahkamah Agung Nomor 50 P/HUM/2018, Ujian Pengangkatan Notaris dihapus sebagai syarat untuk dapat diangkat menjadi notaris. Pengangkatan dan pemberhentian notaris tidak perlu menjadi kewenangan organisasi notaris sebab pada hakikatnya salah satu karakteristik notaris sebagai pejabat umum adalah diangkat dan diberhentikan oleh pemerintah. Tidak tepat apabila kewenangan tersebut dilimpahkan kepada organisasi notaris yang notabene bukan organ pemerintah karena akan menghilangkan karakteristik yang melekat pada notaris sebagai pejabat umum. Kewenangan untuk mengangkat dan memberhentikan notaris adalah kewenangan Menteri Hukum dan Hak Asasi Manusia, sedangkan organisasi notaris sendiri dibentuk dengan tujuan untuk meningkatkan kualitas profesi notaris melalui kegiatan pendidikan dan pelatihan, pertemuan ilmiah, ceramah, seminar, dan sebagainya.Post Supreme Court verdict Number 50 P/HUM/2018, Notary Assignment Exam removed as one of the requirements to be assigned a notary. The assignment and dismissal of the notary public does not need to be Notary Public Organization authority for the fact that one of the characteristics of the notary public is assigned and dismissed by the government. Less precise when the authority delegated to the Notary Public Organization which is not an organ of the government because it will eliminate the characteristics inherent in a notary public. The authority to assign and dismiss notary public is in the hands of the Minister of Laws and Human Rights. While the presence of Notary Public Organization in general only aims to improve the quality of the profession of notary public through educational activities and training, scientific meetings, lectures, seminars, and so on.

Peristiwa perdata, sudah barang tentu terjadi lebih banyak daripada peristiwa pidana. Sementara itu peristiwa perdata yang paling banyak terjadi, itu sudah pasti adalah peristiwa perikatan. Perikatan cukup mendominasi karena dapat terjadi atas dasar antar subyek hukum saling mengikatkan dirinya, atau atas dasar antar subyek hukum dipaksa saling mengikatkan dirinya oleh undang-undang. Subyek hukum yang saling mengikatkan dirinya, menjadi peristiwa perikatan yang mendominasi di masyarakat, bentuknya adalah perjanjian. Perjanjian terdapat beragam jenisnya, yang pada intinya ada perjanjian bernama, ataupun perjanjian tidak bernama. Salah satu contoh perjanjian tidak bernama yang dewasa ini marak digunakan sebagai pendukung kegiatan bisnis, adalah perjanjian pre project selling, perjanjian di mana penjualan dilakukan saat obyek tersebut belum nyata ada. Perjanjian pre project selling ini kerapkali dilakukan dalam bidang penjualan properti. Kendati demikian, perjanjian semcam ini tidak selamanya berakhir dengan baik, berulang kali timbul kerugian kepada pembeli (calon pemilik) baik itu dalam bentuk obyeknya tidak kunjung jadi, ataupun dalam bentuk obyeknya sudah jadi namun tidak sesuai dengan kehendak pembeli (calon pemilik) sebagaimana dalam penawaran. Tujuan dari penulisan ini adalah untuk mencari penyebab kerugian tersebut, dan penyelesaiannya. Hasil dari penelitian ini, adalah dibutuhkan mekanisme pembatas atau pengendali atas asas kebebasan berkontrak dalam peristiwa pre project selling.Civil events, of course, occur more than criminal events. While most civil incidents occur, it is definitely an engagement event. Engagement is quite dominating because it can occur on the basis of legal subjects binding to one another, or on the basis of legal subjects being forced to bind themselves to each other by law. Legal subjects that bind themselves to each other, become engagement events that dominate in society, the form is an agreement. There are various types of agreements, which basically have a named agreement, or an anonymous agreement. One example of an anonymous agreement that is currently widely used as a supporter of business activities, is the pre-project selling agreement, an agreement where sales are made when the object is not yet real. These pre-project selling agreements are often done in the field of property sales. Nevertheless, this kind of agreement does not always end well, repeatedly causing losses to the buyer (prospective owner) either in the form of the object not being finished, or in the form of the object is ready but not in accordance with the wishes of the buyer (prospective owner) as in the offer. The purpose of this paper is to find the cause of the loss, and its resolution. The results of this study, is the limiting or controlling mechanism for the principle of freedom of contract in the event of pre-project selling.

Penentuan posisi korban dalam adanya kecelakaan lalu lintas merupakan hal yang krusial yang cukup sulit. Ketentuan mengenai kedudukan korban secara khusus telah diatur dalam Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan yang mengatur mengenai konsep korban di mana korban adalah setiap orang yang mengalami kerugian berupa luka berat, maupun kematian yang diakibatkan dari adanya suatu kecelakaan lalu lintas. Konsep korban tersebut apabila dikaitkan dengan kecelakaan lalu lintas maka akan menimbulkan persepsi bahwa siapa saja yang mengalami luka berat atau meninggal dunia akan dipandang sebagai korban yang benar, padahal dalam kecelakaan lalu lintas, dapat saja terjadi bahwa korban adalah sekaligus pelaku yang lalai dalam berkendara. Selain itu, konsep korban yang terdapat dalam Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan menjadi bertentangan dengan konsep korban yang diatur dalam peraturan perundangan yang berlaku di Indonesia sehingga diperlukan adanya penafsiran konsep korban yang komprehensif dalam rangka penegakan hukum yang adil.Determination of the position of victims in traffic accidents is crucial that quite difficult. Provisions concerning the position of victims specifically been regulated in Act No. 22 Year 2009 on Traffic and Road Transportation concerning the concept of a victim where the victim is anyone who suffered losses in the form of serious injury, or death resulting from the existence of a traffic accident. Concepts relate to those victims of traffic accidents will rise to the perception that anyone who is seriously injured or dies will be seen as a true victim, whereas in a traffic accident, it can happen that the victim and perpetrator was negligent in driving. Besides, the concept of victims contained in the Act No 22 Year 2009 on Traffic and Transportation be contrary to the concept of victim stipulated in applicable laws and regulations in Indonesia so it needed a comprehensive interpretation of the concept of victim in the framework of a fair law enforcement.

Salah satu penghalang tidak saling mewarisi menurut hukum waris Islam adalah perbedaan agama antara pewaris dengan ahli waris. Penghalang mewarisi ialah keberadaan penghalang yang menggugurkan hak seseorang untuk mewarisi harta peninggalan. Namun ketiadaan penghalang bukan berarti harus memberikan hak waris kepada seseorang. Dengan kata lain, yang dimaksud dengan penghalang-penghalang mewarisi ialah tindakan atau hal-hal yang dapat menggugurkan hak seseorang untuk mewarisi harta peninggalan setelah adanya sebab-sebab mewarisi. Seperti karena ia pembunuh atau sebab berbeda agama. Orang semacam ini disebut sebagai orang yang diharamkan mendapatkan warisan, keberadaannya dianggap bagaikan tidak ada, dan dia tidak dapat menghalangi ahli waris yang lainnya. Dalam Kompilasi Hukum Islam (KHI) saja tidak ada mengatur tentang wasiat wajibah bagi orang yang berbeda agama.One barrier is not mutually inherit according to Islamic inheritance law is the difference of religion between the heir with the beneficiary.The barrier is inherited is the existence of the barrier which has waived the right of a person to inherit treasure relics.But the absence of the barrier does not mean having to give the inheritance to someone.In other words, is the barrier-the barrier is inherited is the actions or things that could disqualify a person’s right to inherit property remains after the inherited causes.Like a killer because he has a different religion or cause. Dalam utang piutang seyogyanya perjanjian utang piutang dibuat secara tertulis. Beberapa lembaga jaminan mensyaratkan untuk menggunakan akta notaris. Walaupun tidak dipersyaratkan, perjanjian utang piutang itu tetap dapat dibuat oleh atau di hadapan notaris. Suatu akta jaminan yang dibuat oleh notaris sesuai yang dipersyaratkan sudah barang tentu menyebutkan pula obyeknya. Terdapat potensi klaim oleh orang lain atas obyek yang sedang dijaminkan tersebut sebagaimana kerap terjadi bukti kepemilikan yang ganda. Permasalahannya adalah bagaimana tanggung gugat notaris manakala terjadi hal demikian. Penelitian ini merupakan penelitian normatif. Hasil dari penelitian ini adalah notaris harus mempertanggungjawabkan segala isi dalam aktanya, termasuk keabsahan kepemilikan objeknya.In this accounts receivable debt, the debt payable agreement should be made in writing. Some guarantee institutions require the use of a notarial deed. Althought not required, the loan agreement can still be made by or before a notary in accordance with the requirements, of course also mentions the object. There are potential claims by others for the object being pledged as proof of multiple ownership is often the case. The problem is how notary accountability occurs when such things occur. This research is a normative research. The results of this study are the notary must be able to take responsibility for all contents in the deed, including the validity of ownership of the object.

Dewasa ini untuk memenuhi kebutuhan masyarakat akan tempat tinggal yang layak di tengah pesatnya pertumbuhan ekonomi dan semakin berkurangnya ketersediaan tanah, maka dibangun tempat tinggal dalam bentuk rumah susun. Rumah susun merupakan bangunan gedung bertingkat yang digunakan untuk tempat hunian yang diatur dalam Undang-Undang Nomor 20 Tahun 2011 tentang Rumah Susun. Pada tesis ini penyusun memfokuskan pada bentuk tanggung gugat pengembang kepada pembeli akibat wanprestasi pada prasarana, sarana, dan utilitas umum dalam pelaksanaan perjanjian pengikatan jual beli satuan rumah susun, dan upaya hukum pembeli yang dapat dilakukan dengan cara menggugat pengembang yang wanprestasi secara perdata melalui pengadilan atau di luar pengadilan.Nowadays to fulfill people’s need for decent housing in the midst of rapid economic growth and decreasing of soil availability, then, it’s built in the form of flats. Flats are high rise buildings used for shelter as regulated in Act Number 20/2011 About Flats. In this thesis, the authors focus on developer liability to buyers as a result of in default on public utilities, facilities and utilities in the implementation of sale and purchase agreements and the buyer’s legal efforts that can be done by suing a developer who in default with civil rights through the court or outside court.
