Abstract

Globalization has increased the number of mixed-nationality and interfaith marriages, giving rise to cross-jurisdictional legal complexities, particularly for Muslim parties. This study aims to analyze the application of the principles of Private International Law—namely, lex patriae, lex domicilii, lex loci celebrationis, and lex rei sitae—in the resolution of disputes regarding mixed-nationality marriages and international inheritance. The methodology employed is normative legal research using a comparative law approach and analysis of court decisions. The results of the study indicate that the validity of mixed marriages is determined through a combination of formal requirements based on lex loci celebrationis and substantive requirements subject to lex patriae or lex domicilii, which often conflict with Sharia norms and the public policy of the forum state. In international inheritance, the differences between the faraidh system and Western law lead to fragmentation in dispute resolution, particularly regarding immovable property governed by lex rei sitae. To reduce legal uncertainty, cross-jurisdictional marriage contracts, international wills, mandatory bequests, and asset transfers that comply with the principle of dual compliance are necessary. Abstract

Fenomena penundaan perkawinan akibat faktor ekonomi semakin mengemuka di kalangan pemuda Muslim, menciptakan ketegangan antara anjuran syar’i dan tekanan sosio-ekonomi kontemporer. Penelitian ini bertujuan menganalisis status hukum penundaan perkawinan karena faktor ekonomi menurut hukum Islam, membedakan batasan antara penundaan yang diperbolehkan (jaiz) dan terlarang (makruh/haram), serta mengevaluasi keselarasan praktik tersebut dengan prinsip maqashid al-syari’ah. Metode yang digunakan adalah penelitian hukum normatif Islam dengan pendekatan kualitatif-deskriptif, mengolah data primer (Al-Qur’an, Hadis, kitab fikih) dan sekunder (fatwa MUI, literatur kontemporer) melalui teknik istimbath, kaidah fikih, dan analisis maqashidi. Hasil penelitian menunjukkan bahwa penundaan perkawinan hukumnya jaiz apabila bersifat sementara, dilandasi kesulitan ekonomi objektif, dan disertai ikhtiar nyata memenuhi nafkah dasar. Namun, status hukum bergeser menjadi makruh jika didorong oleh standar materialistis yang memberatkan, dan haram apabila berpotensi menimbulkan kemudaratan syar’i seperti zina, gangguan psikologis berat, atau pelanggaran hak pasangan. Evaluasi maqashidi menegaskan bahwa perlindungan agama, jiwa, dan keturunan (hifz al-din, al-nafs, al-nasl) memiliki prioritas lebih tinggi daripada perlindungan harta, sehingga penundaan yang mengorbankan unsur daruri demi gengsi sosial tidak proporsional. Penelitian ini merekomendasikan revitalisasi pendidikan pranikah berbasis kesederhanaan, penguatan literasi keuangan syariah di tingkat komunitas, serta kebijakan afirmatif pemerintah untuk memudahkan akses pernikahan tanpa mengabaikan prinsip taysir.

Abstract

Voter participation in regional head elections is central to democratic legitimacy, yet the 2024 simultaneous regional elections revealed substantial variation and participation below the national target. This study aims to formulate an institutional strategy for the General Elections Commission (Komisi Pemilihan Umum/KPU) to strengthen informed and inclusive voter participation while reducing involuntary and uninformed abstention. The research uses a qualitative integrative literature review. Legal documents, official KPU reports, books, and peer-reviewed articles were selected purposively from journal portals, Garuda, and official legal and electoral-document databases. The sources were analyzed thematically using the civic voluntarism model and the electoral management body perspective, focusing on resources, political engagement, mobilization, integrity, accessibility, and institutional coordination. The findings show that abstention is heterogeneous and cannot be treated solely as political apathy. Low turnout also results from administrative barriers, limited political efficacy, distrust, unequal information access, mobility constraints, and inaccessible polling services. KPU therefore needs an integrated strategy consisting of institutional integrity, segmented and continuous voter education, accessible electoral services, responsible digital communication, and multi-stakeholder collaboration supported by measurable evaluation. This study contributes the ILAK framework—integrity, literacy, accessibility, and collaboration—as a model for shifting KPU policy from event-based socialization toward a sustainable voter-participation ecosystem. The framework emphasizes that participation must be improved without coercing citizens or delegitimizing conscious political abstention.
