Abstract

Background: The ASEAN Economic Community (AEC) serves as a platform for economic integration in Southeast Asia, aiming for broader global economic synergy. Its blueprint envisions unrestricted movement of goods, services, capital, and investment across national borders. Investment is critical in enhancing Timor-Leste's national economy. However, achieving this requires an efficient licensing bureaucracy, a conducive investment climate, and government commitment to ensuring legal certainty. Objective: This study aims to analyze the role of legal certainty in attracting foreign investment in Timor-Leste, addressing the challenges posed by the ASEAN Economic Community. Methodology: A normative approach was employed, focusing on legal norms and their role in guaranteeing investment security in Timor-Leste within the AEC framework. Findings: First, the government must establish legal certainty to ensure a secure environment for investors, with consistent implementation of existing laws. Second, the establishment of an arbitration body is essential for swift and transparent business dispute resolution, meeting investor expectations. Third, prioritizing strategic economic sectors can effectively attract foreign investment. Conclusion: Legal certainty plays a pivotal role in attracting investors to Timor-Leste. Transparent dispute resolution through arbitration and promotion of priority sectors significantly enhance the country's appeal to foreign investors.

Abstract

The purpose of this study is to determine and explain the analysis of legal gaps in the protection of the rights of persons with disabilities in Timor-Leste and to determine and explain the factors that influence legal gaps in the protection of the rights of persons with disabilities in Timor-Leste. This research approach uses a normative juridical approach. The research used to complete this study is descriptive analysis. Data collection techniques were conducted through literature and document studies. All collected data, both primary and secondary, will be analyzed qualitatively using a normative legal approach. The data will then be presented descriptively and concluded. Based on the results of the conclusion that the analysis of legal gaps in the protection of the rights of persons with disabilities in Timor-Leste shows a gap between existing laws and regulations and their implementation in the field, as well as differences in the emphasis of national law with international instruments such as the Convention on the Rights of Persons with Disabilities (CRPD) which has been ratified by Timor-Leste. This gap appears in the form of a lack of comprehensive specific laws for disabilities, limited resources and infrastructure, and a lack of public and government awareness regarding the rights of persons with disabilities. Factors contributing to the gap in the protection of the rights of persons with disabilities in Timor-Leste include the lack of ratification of the UN Convention on the Rights of Persons with Disabilities (UNCRPD), socio-cultural stigma and discrimination, poverty that exacerbates disabilities, and barriers to access to education, employment, and other social services. A lack of commitment and effective policy implementation mechanisms at the government and community levels also contribute to this gap

Abstract

Discussing issues surrounding general elections and political party organization means we are talking about the involvement of citizens ara. In the context of a democratic country, one tangible form of citizen involvement is through participation in the general election process. The desires and hopes of the people are generally represented by a political party entity. In countries that practice democratic principles, the idea related to citizen participation   is that citizens have the right to participate in determining leaders who will influence public policy. This study uses a normative method to analyze the legal materials used. The type of research used is normative juridical, which is a type of research conducted by studying existing norms or laws and regulations related to the issues discussed. The data sources obtained include official documents, books, and applicable laws and regulations. Based on the results of this study,  East Timor's electoral law has normatively met international and modern standards, serving as a key pillar in building strong democratic institutions. However, continuous improvement in constitutional and implementation aspects is still needed to overcome political complexity and ensure the effectiveness of governance. The general legal framework for elections in Timor-Leste is in line with the basic principles of democracy and universal human rights. The country's constitution and election laws guarantee fundamental rights, although there are challenges in implementation and regulatory coherence.
