Abstract

The existance of proporsionalities principle in capital investmentagreement is wthin pre-agreement step, proporsionalities principle opensnegotiation among parties to interchange rights and duties, in fair, information step of agreement, this principle guarantees the equal rights andmakes free in controlling rights and duties proportions, in agreementimplementation proporsionalities principle guarantees for implementationof rights and duties interchange distribusion in accordance with proportionagreed and in case failure and dispute take place, so proporsionalitiesprinciple must be assesed proportinally about failure taken place andstresses on provement burden among parties.

Abstract

Forgiveness of debt principle is a principle of law that can be used to lighten theburden to be borne by the debtor as a result of financial difficulties by providing theforgiveness of debts to be clear so that the debtor can resume its business without theburden of old debts (fresh starting) as a breakthrough besides PKPU bankruptcy shouldbe able to protect and create a balance against the debtor and creditors. Therefore, thisarticle will explain whether the principle of starting with a fresh debt forgiveness can beenacted in PKPU.
