Abstract

ABSTRAKPeran dan tanggung jawab Polri sebagai Penegak Hukum dalam melaksanaan restorative justice untuk keadilan dan kemanfaatan masyarakat sangat diharapkan implementasinya, karena Polri menjadi ujung tombak dalam penegakan hukum, sehingga dituntut optimal dalam penanganannya. Hasil penelitian menunjukkan dengan menggunakan metode yuridis normatif dapat disimpulkan bahwa dengan menjadikan restorative justice sebagai pendekatan maka ada beberapa keuntungan yang didapatkan. Pertama, masyarakat diberikan ruang untuk menangani sendiri permasalahan hukumnya yang dirasakan lebih adil. Kedua, beban negara dalam beberapa hal menjadi berkurang. Penyidik Satreskrim Polres Rembang dapat melaksanakan mekanisme restorative justice melalui diskresi yang dimilikinya karena hal itu merupakan kelengkapan sistem, hukum nasional dapat diterima apabila dilaksanakan berdasarkan falsafah negara Pancasila, menjamin keadilan serta perlindungan hukum terhadap Hak Asasi Manusia. Untuk menjamin keseragaman dalam implementasinya, diperlukan suatu norma dan payung hukum untuk memberikan legitimasi agar tindakan yang dilakukan Penyidik Satreskrim Polres Rembang dalam implementasi restorative justice tidak dianggap ilegal.Kata Kunci : Keadilan, kemanfaatan , musyawarah. ABSTRACTThe role and responsibility of the Police as Law Enforcement in the implementation of restorative justice for justice and the benefit of society is expected to be implemented, because the Police become the spearhead in law enforcement, so it is demanded optimal in handling it.The result of this research is by using normative juridical method can be concluded that by making restorative justice as approach then there are some advantages obtained. First, the community is given space to handle its own legal problems that are felt more just. Second, the burden of the state is in some cases reduced. Police criminal detective Rembang can implement restorative justice mechanism through its discretion because it is a complete system, national law can be accepted if implemented based on Pancasila state philosophy, guarantee justice and legal protection to human rights. To ensure uniformity in its implementation, a legal norm and umbrella is required to provide legitimacy to ensure that actions carried out by the Police criminal detective Rembang in the implementation of restorative justice are not considered ellegal.Keywords: Justice, benefit, discussion.

Abstract

ABSTRAKPenelitian ini berjudul Impelementasi Peraturan Mahkamah Agung Nomor 2 Tahun 2012 Tentang Penyesuaian Batasan Tindak Pidana Ringan dan Jumlah Denda Dalam KUHP di Kepolisian Resor Rembang (Studi Kasus Pada Tindak Pidana Pencurian Ringan). Tujuan Penelitian ini : 1) Untuk mengetahui Implementasi Perma Nomor 2 Tahun 2012 yang berdasar  tindak pidana ringan dalam KUHP di Polres Rembang. 2) Untuk mengetahui dan menganalisa kelemahan dan solusi Implementasi Perma Nomor 2 Tahun 2012 tentang batasan tindak pidana ringan dalam KUHP di Polres Rembang.Hasil Penelitian : a) Selain unsur-unsur pokok perihal pembuktian dengan mengumpulkan alat bukti dalam hukum materiil, maka hakim turut juga berpedoman pada surat dakwaan yang dirumuskan oleh Jaksa Penuntut Umum (JPU). Akan tetapi, pada jenis tindak pidana ringan terdapat beberapa unsur khusus yang membedakan antara sistem acara cepat pada perkara tipiring dengan sistem acara pidana lainnya. Pada perkara tipiring yang menerapkan sistem pemeriksaan acara cepat tidak diperlukan surat dakwaan dalam pelimpahan perkara pidana ke pengadilan untuk proses persidangannya. b). Perbedaan antara Perma tentang Penyesuaian Batasan Tindak Pidana Ringan dan Jumlah Denda dalam KUHP yang dikeluarkan oleh MA, dengan KUHAP tentang Tipiring itu sendiri yaitu dengan adanya batasan nilai uang dengan jumlah Rp. 2.500.000,00 sedangkan di dalam KUHAP menekankan Tipiring pada jumlah kurungan paling lama 3 bulan atau denda sebanyak-banyaknya Rp. 7.500,00. Hal ini menjadi polemik sebab Perma dikeluarkan sepihak oleh Mahkamah Agung yang berimplikasi dalam penegakan hukum yang bersifat parsial. Oleh sebab itu, diperlukan koordinasi lebih jauh antara Mahkamah Agung, Kepolisian, dan juga Kejaksaan agar ada sinkronisasi dan kesepahaman antara penegak hukum lainnya terkait Tipring serta sanksi yang harus diberikan terhadap pelakunya.Kata Kunci : Tindak Pidana Ringan, Pencurian, Implementasi ABSTRACT This research is titled Impelementasi Supreme Court Regulation Number 2 Year 2012 About Adjustment Limitation of Criminal Act and Number of Penalties in Criminal Code at Resort Police Rembang (Case Study On Crime Of Theft). The purpose of this research: 1) To know Implementation of Perma Number 2 Year 2012 based on minor criminal act in Criminal Code at Polres Rembang. 2) To know and analyze weaknesses and solutions Implementation of Perma Number 2 Year 2012 on the limitation of minor criminal offenses in the Criminal Code in Rembang Polres.Research Result: a) In addition to the basic elements of proof by collecting evidence in the material law, the judge shall also be guided by the indictment formulated by the Public Prosecutor (JPU). However, in the type of minor crime there are some special elements that distinguish between the system of fast events on tipping cases with other criminal procedure systems. In case of tipiring applying a fast-checking system, no indictment is required in the transfer of criminal cases to the court for the proceedings. b). The difference between the Perma on Adjustment of Limitation of Criminal Crime and the Amount of Penalty in the Criminal Code issued by the Supreme Court, with the Criminal Code concerning Tipiring itself that is with the limit of the value of money by the amount of Rp. 2.500.000,00 whereas in KUHAP emphasizes Tipiring on the number of confinement for a maximum of 3 months or a fine of up to Rp. 7,500.00. This becomes a polemic because Perma is issued unilaterally by the Supreme Court which has implications in partial law enforcement. Therefore, further coordination between the Supreme Court, the Police and the Attorney Office is required in order to have synchronization and understanding between other law enforcers related to Tipring and the sanctions to be given to the perpetrators.Keywords: Mild Crime, Theft, Implementation

Abstract

The traffic accidents enhancement that occurred recently by the children as perpetrators who caused death victims incised black sheets in the traffic law. What people see about an accident occurred was completely the driver error. Meanwhile, according to legal theory that the accident must be seen from the major factor which caused the traffic accidents. This research investigate the implementation, constraints and its solutions in the implementation of restorative justice as a settlement form of traffic accident by children in Polres Rembang. Therefore this study intends to analyze the implementation of restorative justice, analyze the constraints faced by the Investigator and determine the solution of the constraints in the implementation of restorative justice to traffic accidents involving the child as a suspect traffic accident in the Rembang District police territory.The Rembang city police solves the incidents of traffic accidents with children as perpetrators through a diversion process, this was aimed to avoid the children from detention, and from being labeled as a criminal, and teachs the children to responsible for what tey have been done. The problem occurred in implementating the restorative justice were the perpetrators are less cooperative with the victim after the accident, the victim did not want to forgive the perpetrators and the existence of third person who gave bad doctrin, and also the lack of information abaut divesion process in society. The Rembang City Traffic Unit police Officers attempts to avoid conflict / complaints from the victims are, the the officers h neutral, the perpetrators are directed to conduct a good relationship and convey condolences to the victims, conduct deliberation and ask for assistance from the Correctional Institution. Abstract

ABSTRAKPenelitian ini berjudul Analisa Kebijakan Formulasi Hukum Pidana Dalam Penanggulangan Tindak Pidana Korupsi. Tujuan Penelitian ini : 1) Untuk mengetahui dan menganalisis kebijakan formulasi tindak pidana korupsi dalam perundang-undangan yang berlaku saat ini. 2) Untuk mengetahui dan menganalisis kebijakan formulasi tindak pidana korupsi yang akan datang.Hasil Penelitian : a) Kebijakan formulasi hukum pidana khususnya mengenai formulasi tindak pidana korupsi saat ini, memiliki sejumlah kelemahan yang mendasar, sebagi berikut: 1) Kebijakan hukum pidana dalam hal tindak pidana korupsi yang berlaku saat ini, tindak mencantumkan kualifikasi delik apakah sebagai “pelanggaran” atau “kejahatan”. Kebijakan Hukum pidana dalam hal tindak pidana korupsi saat ini tidak memberikan pengertian atau batasan-batasan yuridis mengenai “permufakatan jahat”, “tindak pidana dalam hal pembantuan atau pembatu” (medeplichtige) dan “pengulangan tindak pidana”(recidive). 2) Kebijakan hukum pidana dalam hal pemberantasan tidak pidana korupsi, masih tersebar di beberapa perundang-undangan dan menggunakan sanksi berdasarkan undang-undang yang berbeda, hal ini dapat menimbulkan persoalan terutama dalam aspek keadilan. b) Mencermati kelemahan yang terdapat dalam kebijakan hukum pidana mengenai tindak pidana korupsi saat ini, serta kelemahan-kelemahan yang terdapat dalam RUU Tentang Pemberantasan Tindak Pidana Korupsi yang disusun oleh pemerintah (Naskah bulan Agustus 2008), maka sebaiknya dilakukan pembaharuan terhadap kebijakan hukum pidana mengenai tindak pidana korupsi untuk yang akan datang, dengan memperhatikan hal-hal sebagai berikut: 1) Rumusan tindak pidana korupsi tetap menekankan pada unsur “merugikan keuangan atau perekonomian negara”. memberikan pengertian yuridis mengenai “Permufakatan jahat”, serta “pengulangan tindak pidana” (recedive). 2) Mencantumkan pemberatan pidana atau pemidanaan untuk tindak pidana korupsi khususnya pada lingkup “suap” dan “pemerasan dalam jabatan” yang dilakukan oleh penegak hukum terhadap perkara-perkara hukum yang sedang diperiksa.Kata Kunci : Analisa Kebijakan, Hukum Pidana, Tindak Pidana Korupsi ABSTRACT  This research entitled Policy Analysis of Criminal Law Formulation in Countering Corruption Crime. The purpose of this study: 1) To know and analyze the formulation policy of corruption in the current legislation. 2) To know and analyze the formulation policy of corruption crime that will come.Result of research: a) Formulation policy of criminal law especially concerning formulation of corruption crime at this time, has some fundamental weakness, as follows: 1) Criminal law policy in case of corruption crime in effect now, "Or" crime ". The criminal law policy in the case of corruption currently does not provide juridical definition or constraints on "malicious conspiracy", "meditlichtige and recidive". 2) Criminal law policy in the case of non-criminal corruption eradication, still scattered in several legislation and using sanctions based on different laws, this can cause problems especially in the aspect of justice. b) Paying close attention to the weaknesses contained in the criminal law policy regarding the current corruption crime, and the weaknesses contained in the Draft Law on Corruption Eradication made by the government (Manuscript of August 2008), it is advisable to update the criminal law policy regarding criminal corruption for the future, taking into account the following matters: 1) The formulation of criminal corruption still emphasizes the element of "harming the finance or economy of the country". provide a juridical understanding of "conspiracy", and "recedive". 2) Include a criminal or criminal penalty for corruption, particularly in the sphere of "bribery" and "extortion in office" committed by law enforcers against the legal cases being examined. Abstract

ABSTRAKDalam penelitian ini permasalahan yang akan dibahas yaitu: Mengapa terjadi disparitas pidana antara Putusan No.130/Pid.Sus-Anak/2016/PN Dmk dan Studi Putusan No.136/Pid.Sus-Anak/2017/PN dengan Putusan Pengadilan Negeri Demak Nomor: No.139/Pid.Sus-Anak/2017/PN. Demak dan Apakah akibat disparitas pidana terhadap anak pelaku tindak pidana pencabulan dengan kekerasan antara Putusan No.130/Pid.Sus-Anak/2016/PN Dmk dan Studi Putusan No.136/Pid.Sus-Anak/2017/PN dengan Putusan Pengadilan Negeri Demak Nomor: No.139/Pid.Sus-Anak/2017/PN. Demak terhadap pelaku dan korban yang masih anak.Pendekatan yang akan digunakan adalah pendekatan yang bersifat Yuridis Sosiologis. Adapaun sumber dan jenis data dalam penelitian ini adalah data primer yang diperoleh dari studi lapangan dengan wawancara . Dan data sekunder diperoleh dari studi kepustakaan.Kesimpulan dari penilitian ini adalah Peranan Terdakwa dalam melakukan tindak pidana persetubuhan dan atau pencabulan apakah direncanakan terlebih dahulu, dengan kekerasan yang menakibatkan anak korana tidak bisa berdaya sehingga tidak pidana terjadi atau sebelunya dalam melakukan tindak pidana dengan cara berpacaran terlebih dahulu; Korban Berpengaruh terhadap mental atau psikis anak korban itu sendiri, dengan putusan yang berbeda-beda, sehingga korban akan timbul merasa kekecewaan terhadap putusan yang dijatuhkan oleh hakim yang berdasarkan peraturan dan hukum yang ditegakan oleh aparatur penegak hukum yang dalam pertimbangan putusannya belum bisa memberi rasa keadialan bagi korban.Kata Kunci : Disparitas, Pidana, Perkara Anak ABSTRACTIn this study, the problems that will be discussed are: Why there is a criminal disparity between Decision No.130 / Pid.Sus-Anak / 2016 / PN Dmk and Study Decision No.136 / Pid.Sus-Anak / 2017 / PN with Decision of Demak District Court Number: No.139 / Pid.Sus / 2017 / PN. And secondary data obtained from literature study.The conclusion of this research is the role of the Defendant in committing the criminal act of intercourse and / or fornication whether planned first, with violence that invites the children of the newspaper can not be empowered so that no crime occurs or sebelunya in committing a crime by way of dating first; Victims Influential to the mental or psychic of the victim's own children, with different decisions, so that victims will arise feel the disappointment of the judgments imposed by judges based on the rules and laws enforced by law enforcement officials who in the consideration of its verdicts have not been able to give a taste of the nobility for the victim.Keywords: Disparity, Criminal, Child Case

Abstract

To achieve a relevant evidence of infringement (violation ticket) process its is necessary to have an information system that is supported by a network-based software or website that allows the dissemination of realtime information to every member of the police. The implementation of E-Tilang is could be an effective option to sanction the traffic offenders. Even tough the E-Tilang can not be said that it is effective because not every people in Indonesia are technologically literate. There are still many of them who do not know about the existence of E-Tilang so that they need for more vigorous and equitable socialization abaout it. Therefore this study intends to analyze the effectiveness of the implementation of Sanction of E-Tilang Penalty for Traffic Offenders Based on Law no. 22/2009 on Traffic and Road Transportation in the Territory of the Rembang Police, and to analyze how the implementation, constraints and the effectiveness of E-tilang system in the settlement of criminal cases of traffic violation in Rembang.E-Tilang has some advantages, it has faster service than a conventional one. This system is more practical and fast. The implementation of the electronic ticketing system (E-Tilang) is to facilitate speed and convenience, the openness of the execution of the ticketing process or as a substitute for on-site ticketing process. Some of the benefits for traffic violators in the presence of the E-Tilang system are the transparency of public apparatus's actions in government administration activities, community empowerment where people are expected to transmit the orderly attitude of the traffic after knowing the rules to those around them in order not to violate the existing regulations. The responsiveness of the authorities will be higher and more responsive to public complaints in traffic and equity, where violators with the same offense will get the same fine or penalty.
