Abstract

Abstract Revision of investment law should naturally consider the values of Pancasila (Five Pillar State Philosophy of Indonesia), justice principle of the government, and the Indonesian governing system, in order to solve the legal problems related to fai and synchronized investment license authority between those issued by the regional government and by the central government. According to the rules, such authority is in the hand of the regional government. It is therefore necessary to align to legal norms related to this authority among those legal laws set by the regional government, investment, technical sectoral (they are horizontally interrelated), and 1945 Constitution (vertically related), and the testing ground of Pancasila values, and justice principle of the government administration. Keywords : values of Pancasila, justice principle of the government administration, governing system, license authority, legal norms, synchronization   Abstrak   Pembaharuan Undang-Undang Penanaman Modal seyogianya memperhatikan nilai-nilai Pancasila, asas keadilan dalam penyelenggaraan pemerintahan, dan sistem berpemerintahan Indonesia, dalam rangka menyelesaikan permasalahan hukum mengenai keadilan-keserasian norma hukum mengenai kewenangan perijinan di bidang investasi antara Pemerintah Pusat dan Pemerintah Daerah. Karena secara normatif, kewenangan dimaksud semestinya berada pada Pemerintah Daerah.Oleh karena itu, perlu dilakukan sinkronisasi norma hukum mengenai hal tersebut antara sistem pengaturan norma hukum pemerintahan daerah, penanaman modal, dan investasi di bidang teknis sektoral satu sama lain (bersifat horisontal), dan dengan Undang-Undang Dasar 1945 (bersifat vertikal), dengan “batu uji” nilai-nilai Pancasila dan asas keadilan dalam penyelenggaraan pemerintahan.
