Abstract

Ngemplang (javanese term to call nonpayment deed of obligation) has been frightening many Batik industrialists in Pekalongan. In short, it harmed Batik industrial badly. They should get some profits for their work, just because of partner who broke the agreement by not settle his obligation, it would be gone and away. Unfortunately, the cheating practice has looked a like to be an habit in Pekalongan Batik industrials. So, I intended to study closer this phenomena and brought the facts to you. Therefore, I gathered the primary data (field research) purposively in order to show the details of Ngemplang deed in Pekalongan Batik industrials, ins and outs. I did so to the dispute resolution of it. The data were analyzed by using symbolic interactions theory and market-firm one. The result show us that ngemplang might occurred in every single chains of industry: from supplying phase, in the beginning, up to marketing one. To arrange the ngemplang dispute, the victims (owner) has performed all the way in which they can draw their credits back. Somehow, they collected the claim from ngemplang doer by hook or by crook, by using mediation; hiring some debt collectors; and/or seizing the debitor’s assets/properties, activa and passiva.

Abstract

this research is aimed to know the effectiveness of mediation process of divorce cases in Family Court of ex Pekalongan Residence after Perma no. 1 / 2008, the supporting factors of it, and any efforts that have been and will be done by Family Court of ex Pekalongan Residence. The result of this research shows that the mediation process in Family Court has not yet been effective. It is caused by many factors. They are the mediator, both parties, period of time, and infrastructure that have not yet been representative and the accumulation divorce cases. Each Family Court, in fact, have done many efforts to solve the problem, but it still need consciousness, thinking, and responsibility among the Family Courts, between the Family Courts and the High Family Court, and the Supreme Court

Abstract

Ada indikasi bahwa pemahaman  bias atas tafsir teks-teks relasi gender bukan disebabkan oleh keyakinan akan  sakralitas agama, akan tetapi lebih disebabkan sebagai alasan ‘pembenar’ atau menjustifikasi perilaku tindak kekerasan yang dilakukan terhadap korban. Oleh karena itu, akar penyebab tindak KDRT bukan hanya dipengaruhi oleh faktor pemahaman agama yang keliru, melainkan juga oleh faktor lain di luar agama, seperti  budaya patriarkhi, role mode; mitos KDRT yang  mengejawantah dalam kehidupan masyarakat; psikologis pelaku; faktor ekonomi dan idiologi harmoni. Faktor-faktor tersebut saling terkait erat dan tidak bisa berdiri sendiri sebagai alasan untuk menjustifikasi terjadinya  tindak KDRT.

Abstract

This study aims to analyze the effectiveness of the implementation of compulsory registration of fiduciary insurance as the provisions of Article 11 of Law No. 42 of 1999 concerning fiduciary in Mudharabah in Baitul Maal Wat Tamwil (BMT) Pekalongan and legal implication in terms of fiduciary insurance is not registered at the Office Registration Fiducia. Interviews and literary studies are used to collect data and data triangulation is used to check its credibility while Interactive Model is used to analyze data. The results showed that, as the fiduciary guarantee registration requirement contained in Article 11 (1) Fiduciary Insurance Law is not effective to be implemented, because: 1) substantially the article is not yet understood by all communities affected by the regulations; 2) law enforcement officials have not provided services to the fullest; 3) the legal infrastructure (legal facilities) are available yet provide ease and convenience to be able to access in implementing such regulations and; 4) lack of legal awareness of the managers of BMT. Legal consequences will occur if the fiduciary is not registered to the fiduciary registration office, namely: 1) non-fulfillment of the principle of specialties and publicity; 2) no preferent rights (the right to precedence) in the payment of the debt, if the debtor break a promise; 3) does not have the executorial power.

Abstract

Kentalnya budaya Jawa, didukung  oleh nilai kapitalisme religius lokal yang notabene bias gender mempengaruhi pola hubungan kerja dalam realitas Perempuan Pekerja Sanggan Industri Batik  Kota Pekalongan. Sehingga pola hubungan kerja yang dibangun adalah pola hubungan subordinasi dan pola hubungan juragan –buruh. Adanya ketidakseimbangan pemahaman hak dan kewajiban dalam hubungan kerja membuat mereka hanya mendapatkan upah atau “imbalan” sesuai dengan stándar juragan. Oleh karena itu, upaya untuk meretas persoalan mereka melalui penyadaran eksistensi diri sangat diperlukan dalam rangka mewujudkan perlindungan hukum yang berkeadilan gender.

Abstract

Adanya basis kekuatan ekonomi yang beralih ke tangan istri ditambah dengan pengaruh budaya negara di mana perempuan pekerja migran pernah  bekerja, alih-alih menjadi bergesernya pola relasi gender dalam keluarga perempuan pekerja migran. Pergeseran pola relasi gender ternyata bukan akar dari eskalasi cerai gugat, melainkan ketidakadilan gender (beban ganda, stereotipe, dominasi, subordinasi dan kekerasan) yang sudah lama dirasakan oleh para perempuan pekerja migran dalam kehidupan rumah tangganya itulah yang merupakan akar penyebabnya.
