Abstract

A brand is a sign to differentiate one good/service from another, protected under Article 3 of Law No. 20 of 2016 concerning Marks and Geographical Indications. How to protect the rights holders of the Onitsuka Tiger brand, which are used by other parties without rights based on Law No. 20 of 2016 concerning Trademarks and Geographical Indications, and what is the law regarding sales made by account holders without blue ticks who use other parties' brands without rights on Instagram is the main problem in this thesis. The type of research used is normative, which is analyzed qualitatively, with primary and secondary data as sources of information. Research findings indicate (1) Legal protection for registered trademark owners to protect their trademarks from fraudulent or detrimental actions from other business actors is stated in Article 21 Paragraph (1) and Paragraph (3) of the Trademark Law,Instagram, Instagram will only deactivate the violator's account and is not responsible for any losses experienced by the owner of the registered mark.

Abstract

Songs are objects protected by copyright, with the development of technology there can be copyright violations against songs, namely in the form of song modifications without the author's permission which have detrimental impacts. This research discusses violations of copyright law related to the modification of the song "Rayuan Perempuan Gila" on TikTok based on Law Number 28 of 2014 concerning Copyright and what actions can be taken regarding copyright violations. This research uses a normative research method with descriptive research characteristics, the data used is secondary data as the main data, analysis uses qualitative methods and conclusions are drawn using deductive methods. Based on the research results, the song "Rayuan Perempuan Gila" which has been modified with a remix format and uploaded on TikTok is included in a violation of copyright law in terms of moral and economic rights because it creates a loss for the creator and/or copyright holder as well as actions that can be taken by creators and/or copyright holders regarding copyright violations, namely by submitting a complaint to the Directorate General of Intellectual Property Rights (DJKI) in collaboration with the Ministry of Communication and Information (Kemenkominfo) to carry out executions of copyright violations. Therefore, the author recommends that the perpetrator of the modification should ask permission from the creator to modify the song and upload it to TikTok.

Abstract

Baduy Woven Fabric as one of the potential geographical indications in Lebak Regency, Banten Province has advantages and historical value that is closely related to the culture of the Baduy tribe. The Baduy people consider woven cloth to be an important part of their life. Every detail of cloth making is full of meaning because it has a philosophical basis. This research aims to to find out whether it is appropriate for Baduy Woven Cloth to be registered as a Geographical Indication Intellectual Property and receive legal protection from the Government. The research uses normative legal research methods, with secondary data supported by primary data. Based on the results of the research, it i known that based on Article 1 paragraph 6 of the Goverment Regulation Number 56 of 2022 concerning Communal Intellectual Property, the Baduy Weaving Cloth qualifies as a potential geographical indication and worthy of legal protection to ensure necessary security for the community to enjoy their legal rights, uphold human rights, and prevent threats against these rights.
