Abstract

This research aims to quality of apparatus resources in public services of Sungai Ambawang Kuala Village Sungai Ambawang District Kubu Raya Regency.This research is descriptive qualitative approach. The results of this research aims quality of apparatus resources in public services to run is good in assurance, tangibles, empathy and  responsivitas, but is less in reability.

Abstract

The background of this research is that the forms of business entities in Indonesia, Brunei Darussalam, and Malaysia still don’t accommodate a company system based on the provisions of Islamic law, but still rely on agreements underlying the parties in business activities that revolve around a particular product. The integration of Sharia principles in the contract to establish a business entity shows superior values that can be used as guidelines for company management based on Sharia principles in Indonesia, Brunei Darussalam, and Malaysia. This research aims to find the characteristics of Syirkah Mudharabah contracts which can be used as a form of developing cooperation in agreements to establish limited liability companies. This paper uses normative research methods with a statutory and conceptual approach. The results of this research show that the characteristics of the Syirkah Mudharabah contract in establishing a limited liability company include 4 (four) things, namely the legal subject or position of the parties in establishing the limited liability company, business capital managed, distribution of profits and losses from collaboration results, and responsibility limited capital owners. This research contributes new findings related to the contracts used in establishing limited liability companies to make them more effective and in line with current Sharia business conditions.

Abstract

Putusan Isbat cerai akan menimbulkan dampak atau akibat hukum dan berimplikasi pada hak pasca penceraian. Oleh karena itu putusan isbat cerai harus memerhatikan tiga cita hukum. Namun terdapat legal gab dimana dalam putusan isbat cerai Pengadilan Agama Situbondo nampaknya tidak memerhatikan cita hukum yang harus diperhatikan dalam putusan hakim sebagai produk hukum. Jenis penelitian ini tergolong hukum normatif (normative legal research) dengan pendekatan penelitian Perundang-Undangan (Statute Approach) dan Pendekatan kasus (Case Approach). Penelitian ini bertujuan untuk mengetahui pertimbangan hukum hakim (ratio decidendi) pada Pengadilan Agama Jember terhadap putusan isbat cerai, termasuk kesesuaian dengan cinta hukum. Hasil penelitian ini menunjukkan, dalam putusan 596/Pdt.G/2023/PA.Sit mejelis hakim menolak seluruh gugatan Penggugat karena itu cita hukum pada putusan ini lebih menekan pada aspek kepastian hukum dan tidak mengakomodir dua cita hukumnya yakni keadilan dan kemanfaatan hukum. Dalam putusan 1158/Pdt.G/2019/PA.Sit dan putusan 1576/Pdt.G/2019/PA.Sit mejelis hakim mengabulkan seluruh permohonan isbat cerai pemohon. Tiga cita hukum, keadilan kepastian dan kemanfaatan sudah terimplimentasi. Hanya jika dalam putusan 1158/Pdt.G/2019/PA.Sit majelis hakim memutuskan nafkah anak maka putusannya jauh lebih implimentatif mengakomodir cita hukum. Implikasi dari putusan tersebut adalah istri sebagai pihak Penggugat tidak mendapatkan hak-haknya pasca penceraian. Implikasi hukum lainnya seperti dalam putusan 1158/Pdt.G/2019/PA.Sit tidak memutus nafkah anak. Implikasinya tidak menimbulkan kepastian hukum bagi nafkah anak pasca penceraian.

Abstract

Dalam duduk perkara PA No. 3481/PDT.G/2021/PA.JR yang menjadikan alasan poligami pemohon adalah termohon yang menderita  Paranoid Schizophrenia (diagnose dokter) dengan gajala termohon seringkali berbicara sendiri sejak kelahiran anak ketiganya, yang tidak disebutkan secara rinci dalam undang-undang perkawinan apakah penyakit yang di derita tersebut masuk dalam kategori istri yang tidak bisa menjalankan kewajiban, atau istri yang menderita cacat badan, atau juga penyakit yang tidak dapat disembuhkan sehingga permohohonan dikabulkan. Mengingat di dalam Islam suami diperbolehkan berpoligami hanya dengan keadaan yang darurat yakni: istri mandul, takut akan zina, terhindar dari perceraian. Suatu kajian yang mana jenis penelitiannya normatif, yakni berfokus kepada beberapa bahan pustaka yang berkaitan dengan poligami serta regulasinya. Sehingga fokus dalam kajian ini yakni pertama: bagaimana dampak penyakit Schizophrenia terhadap hubungan keluarga?. kedua Bagaimana analisis Putusan Pengadilan Nomor 3481/ Pdt.G/2021/PA.Jr Ditinjau Dari Konsep Dasar Keadilan Berpoligami Dalam Hukum Islam. Hasil dari penelitian ini yakni pertama, bahwasannya dampak penyakit dari Schizophrenia adalah mempengaruhi keharmonisan rumah tangga, hal ini masuk pada syarat alternatif dalam kategori istri yang tidak mampu menjalankan kewajibannya secara total. Kedua, Hakim sudah mengacu pada ketentuan-ketentuan aturan yang ada yakni dalam Syariat Islam, KHI, Undang-undang nomor 1 tahun 1974, dan penjabaran dalam Peraturan Pemerintah nomor 9 Tahun 1975 tentang Pelaksanaan UU No.1 tahun 1974. Dalam PP No.9 Tahun 1975, yang berkaitan dengan poligami adalah pasal 40, 41, 42, 43 dan 44. Dalam konteks menyikapi Putusan Pengadilan Nomor 3481/ Pdt.G/2021/PA .Jr.

Abstract

Tradisi atatolong atau mudah di kenal dengan pendanaan pernikahan di masyarakat Bondowoso sangatlah penting, sebab tidak hanya sumbangan berbentuk materiil, adakalanya dedikasi yang diberikan bias berupa tenaga serta fikiran. Namun muncul sebuah permasalahn apabila orang yang memiliki tanggungan dalam tradisi atatolong tidak membayar kembali apa yang mereka terima. Oleh karenanya dalam penelitian ini peneliti ingin mengkaji lebih mendalam terkait fenomena yang terjadi dalam tradisi atatolong dengan jenis penelitian empiris, yaitu penelitian dengan adanya data-data lapangan sebagai sumber data utama, seperti hasil wawancara dan observasi, serta menggunakan pendekatan kualitatif yaitu suatu cara analisis hasil penelitian yang menghasilkan data deskriptif analitis, yang dinyatakan secara tertulis atau lisan serta juga tingkah laku yang nyata. Fokus Penelitian ini yakni 1.) Bagaimana Konstruksi sistem tradisi Atatolong dalam acara pernikahan pada Masyarakat Bondowoso? 2). Bagaimana Penyelesaian problem pada tradisi Atatolong dalam acara pernikahan masyarakat Bondowoso?. Hasil dari penelitian ini adalah 1). Konstruksi sistem tradisi atatolong masyarakat Bondowoso berpandangan bahwa tradisi tersebut berasal dari leluhur, yang mayoritas masih mendukung terhadap tradisi tersebut karena tradisi telah banyak membantu masyarakat Bondowoso selama pengalamannya. 2). Penyelesaian problem pada tradisi atatolong di Bondowoso dapat terselesaikan dengan beberapa pendekatan, yakni pendekatan musyawarah, adanya pihak ketiga, tawar menawar, dan kompromi dalam menacari jalan tengah dalam bentuk win-win solution.

Abstract

The Entikong border, as a trade gateway between Indonesia and Malaysia, is a crucial area to analyze regarding the impact of international cooperation in supporting export activities. This research aims to provide an in-depth understanding of the extent to which international cooperation has contributed to export development in the region. Involving a review of bilateral trade agreements, infrastructure development programs, and joint marketing initiatives, this analysis reflects the complex dynamics involving both countries. Infrastructure development cooperation, such as projects in the fields of transportation and border facilities, has had a significant impact on the efficiency of logistics and distribution of export products. Joint export promotion programs and the promotion of superior products are important instruments in diversifying export markets. This analysis evaluates the effectiveness of these initiatives in increasing product visibility in the global market. However, several challenges such as intense global competition and market dynamics need to be overcome to achieve more optimal market diversification. Through case studies, this research highlights the successes and challenges in implementing international cooperation. The results of this analysis provide a comprehensive picture of the impact of international cooperation in the context of exports at the Entikong Border. The policy implications found can be a guide for the government and stakeholders to increase the effectiveness of cooperation and strengthen the role of the Entikong Border as a dynamic trade center between Indonesia and Malaysia. Abstract

This paper is presented in response to the issue related to the impact of the COVID-19pandemic on the trade sector at the Entikong Border in West Kalimantan. The author uses cross-border governance to explain the dynamics and import-export activities during the pandemic. Data collection techniques in this study were interviews and literature studies. The results of this article show that export and import activities will continue during the pandemic. In 2020, it was found that freight shipments were recorded on both routes alone with 44.03% import-export activity through Supadio Airport amounting to US$193,668,243 and the Ports of Kendawang and Pontianak contributing 29.10%. In addition, there are oxygen import activities for pandemic mitigation and electricity imports to meet the needs of people at the border. During the pandemic, there was a change in international trade procedures impacted the depreciation of exports from Indonesia in early 2020 and started to stabilize in mid-April 2021. The Malaysian government's oxygen import policy took place as a result of the issue of increased oxygen demand during the Covid-19 pandemic. The activity of opening the two national borders between Indonesia and Malaysia can only be carried out for the importation of oxygen tanks (liquid oxygen), as well as the repatriation of PMI and the repatriation of motorized vehicles.

Abstract

This research is entitled Independent Village Policy Development Model in Rasau Jaya District, Kubu Raya Regency, which aims to construct an independent village development model in Rasau Jaya District, Kubu Raya Regency. This research is motivated by the problems of poverty, welfare, and community empowerment in six villages in Rasau Jaya District (General Rasau Jaya Village, Rasau Jaya Satu Village, Rasau Jaya Dua Village, Rasau Jaya Tiga, Bintang Mas Village, and Pematang Seven Village), while in the Building Village Index (IDM) the six villages have been included in the independent village category in 2023. This is certainly a special concern in the implementation of independent villages and the need for strategic steps to maintain and improve the development of the social composite index (IKS), economic composite index (IKE) and environmental composite index (IKL) in the village with village empowerment programs or policies. In order to determine the implementation of development in six villages in Rasau Jaya District, this research was conducted by qualitative descriptive analysis. The results of this study show that the social composite index needs efforts to improve the condition of the poor, IKE has the potential for plantations, agriculture and animal husbandry to be an important sector in supporting the economy of the people of Rasau Jaya District, and IKL becomes a polemic is that forest fires still often occur in Rasau Jaya District and the community's water needs are a problem for the environment. Researchers recommend the need for policies to maintain the Status of Independent Villages in Rasau Jaya District by involving the government, private sector, community and academics in preparing strategic village policy plans in Rasau Jaya District, Kubu Raya Regency.
