Abstract

Penelitian ini bertujuan untuk menjelaskan tujuan dan prinsip dalam Maqashid asy-Syari’ah, yaitu konsep fundamental dalam hukum Islam yang berfokus pada kemaslahatan umat. Metode penelitian yang digunakan adalah studi pustaka, yang melibatkan pengumpulan data dari berbagai literatur klasik dan kontemporer, membaca, mencatat, serta mengolah bahan penelitian secara sistematis. Studi ini menelaah bagaimana Maqashid asy-Syari’ah menjadi dasar dalam penetapan hukum Islam dengan mempertimbangkan nilai-nilai keadilan, kemaslahatan, dan keseimbangan dalam kehidupan sosial. Hasil penelitian ini mengidentifikasi lima pokok utama dalam Maqashid asy-Syari’ah, yaitu memelihara agama (hifdz al-din), memelihara jiwa (hifdz al-nafs), memelihara akal (hifdz al-aql), memelihara keturunan (hifdz al-nasl), dan memelihara harta (hifdz al-mal). Dengan demikian, penelitian ini memberikan pemahaman yang lebih mendalam mengenai peran Maqashid asy-Syari’ah dalam membentuk sistem hukum Islam yang adaptif dan kontekstual.

Abstract

This research is a normative legal study with a conceptual and legislative approach. The research results show that the role of the Constitutional Court in Indonesia in realizing dignified justice can be carried out by using the theory of dignified justice in the efforts of the Constitutional Court judges to interpret the constitution. The efforts of the Constitutional Court judges to interpret the constitution based on dignified justice are aimed at ensuring that substantive justice can be realized for the community. The role and orientation of the Constitutional Court's authority from the perspective of constitutional law can be seen in the efforts of the Constitutional Court judges to optimize the Court's authority through constitutional interpretation. In this context, both judicial restraint and judicial activism play important roles in the development of law and the enforcement of justice, and their application often depends on the specific context of each case
