<![CDATA[Penegakan asas praduga tak bersalah merupakan pilar penting dalam sistem peradilan pidana Indonesia, khususnya pada tahap penyidikan yang menentukan lingkungan perlindungan hak tersangka. Namun, dalam praktiknya masih sering terjadi pelanggaran, seperti perlakuan diskriminatif, tekanan psikologis, hingga pemberitaan media yang menilai tersangka bersalah sebelum ada putusan pengadilan. Isu hukum yang dikaji dalam penelitian ini adalah bagaimana penerapan asas praduga tak bersalah memengaruhi perlindungan hak tersangka selama proses penyidikan. Rumusan masalahnya mencakup sejauh mana asas tersebut dijalankan oleh aparat penyidik dan dampaknya terhadap pemenuhan hak-hak tersangka sebagaimana diatur dalam KUHAP. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan kasus, menggunakan data sekunder berupa literatur hukum dan berita aktual. Hasil penelitian menunjukkan bahwa penerapan asas praduga tak bersalah belum sepenuhnya diimplementasikan secara konsisten oleh penyidik. Faktor penyebabnya meliputi kurangnya pengawasan internal, tekanan publik, serta minimnya pemahaman aparat terhadap prinsip hak asasi manusia. Peningkatan pelatihan hukum dan pengawasan etik menjadi kunci untuk menciptakan lingkungan penyidikan yang menghormati hak tersangka. The enforcement of the presumption of innocence is an important pillar in the Indonesian criminal justice system, particularly at the investigation stage, which determines the environment for protecting the rights of suspects. However, in practice, violations still often occur, such as discriminatory treatment, psychological pressure, and media reports that judge suspect guilty before a court decision. The legal issue examined in this study is how the application of the presumption of innocence affect the protection of suspects rights during the investigation process. The research question covers the extent to which this principle is implemented by investigators and its impact on the fulfillment of suspects' rights as stipulated in the Criminal Procedure Code. The research method used is normative juridical with a legislative and case approach, using secondary data in the form of legal literature and current news. The results of the study show that the application of the presumption of innocence principle has not been fully and consistently implemented by investigators. The contributing factors include a lack of internal supervision, public pressure, and a lack of understanding of human rights principles among officials. Improved legal training and ethical supervision are key to creating an investigative environment that respects the rights of suspects.]]>
