Fakultas Hukum Universitas Brawijaya Email: [e-mail]   ABSTRAK Penelitian ini bertujuan untuk mengetahui bagaimana efektivitas pasal 7 huruf a Peraturan Walikota Mojokerto nomor 13 tahun 2016 tentang Angkutan Sekolah Gratis yang dimana siswa berkewajiban ikut serta menyukseskan program angkutan sekolah gratis, untuk menggunakan angkutan sekolah gratis sebagai sarana transportasi massal, dan apa hambatan serta solusi yang dapat dilakukan oleh Dinas Perhubungan Komunikasi dan Informatika. Hal tersebut di latar belakangi masih banyak terlihat siswa yang menggunakan kendaraan bermotor pribadi setelah adanya angkutan sekolah gratis di Kota Mojokerto serta masih banyaknya siswa yang tidak mengetahui trayek atau cara menggunakan angkutan sekolah gratis tersebut. Jenis penelitian ini adalah jenis penelitian yuridis empiris dengan metode penelitian Yuridis Sosiologis yang dilakukan dengan wawancara serta menyebarkan angket untuk memperoleh data serta informasi langsung mengenai Angkutan Sekolah Gratis dan mengenai efektivitas pasal 7 huruf a Peraturan Walikota Mojokerto nomor 13 tahun 2016 tentang Angkutan sekolah gratis serta hambatan dan solusinya. Berdasarkan penelitian yang telah dilakukan maka dapat diketahui bahwa pelaksanaan pasal tersebut belum efektif dikarenakan masih banyak siswa yang tidak menggunakan angkutan sekolah gratis dan menggunakan kendaraan bermotor pribadi, selain itu armada yang disediakan masih belum bisa memenuhi kebutuhan siswa dan Dinas Perhubungan Kota Mojokerto belum melakukan penegasan terkait kewajiban siswa pada pasal tersebut. Kata Kunci: Efektivitas Pasal, Angkutan Sekolah, Kewajiban   ABSTRACT This research is aimed to study the effectiveness of Article 7 letter a of Mayor Regulation of Mojokerto Number 13 of 2016 concerning Free School Transports where students’ involvement is required to help run this program. Moreover, this research also observes how the transports are used by the students as mass transport system, what impeding factors are present and the solution offered by the Department of Transportation, Communication and Informatics. This research embarks from the fact that a number of students are still found to use their own private transports despite the free school transports available, and most students seem to have no ideas of how to use the available free transports. Empirical juridical method was employed in this research, in which socio-juridical method was involved by conducting interviews and distributing questionnaire to obtain direct information regarding free school transports and the effectiveness of the implementation of Article 7 letter a of Mayor Regulation of Mojokerto Number 13 of 2016. The discussion in this research reveals that the regulation has not been effectively implemented since most students do not use the facility provided in addition to the incremental issue where the available vehicles still fail to accommodate the need of the school students. There has not been any follow-up measure taken by the public authorities in Mojokerto regarding the students’ responsibility as stated in the Article.
