PEMBATALAN PERATURAN DESA CACAT YURIDIS KARENA TANPA KLARIFIKASI BUPATI (Kajian Terhadap Peraturan Desa yang Cacat Yuridis)

Fakultas Hukum Universitas Brawijaya [e-mail]   ABSTRAK   Peraturan desa tertentu, untuk berlaku sepenuhnya harus melalui proses klarifikasi, khususnya peraturan desa tentang pungutan. Peraturan desa harus dibuat sesuai prosedur dalam peraturan perundang-undangan yang berlaku. Penelitian ini mengkaji tentang peraturan desa yang dibuat tidak berdasarkan prosedur seharusnya, yaitu melewatkan proses klarifikasi. Penulis mengkaji akibat hukum dan pembatalan peraturan desa yang cacat yuridis tersebut. Penelitian ini merupakan penelitian yuridis normatif dengan pedekatan perundang-undangan dan pendekatan konsep. Sehingga disimpulkan bahwa peraturan desa yang tidak melalui proses klarifikasi adalah batal demi hukum. Bupati harus melakukan pembatalan dengan melakukan klarifikasi.   Kata kunci : Peraturan desa, klarifikasi, bupati ABSTRACT   A certain Village rule to be function properly must go through clarification process. It also applies on the village rule on levies. Village rules must be made in accordance with the procedure contained in the Law. This research analyzes the village rules that were made not in the accordance with the procedure in which it missed the clarification process. The researcher analyzed the legal consequence and the cancellation of Village Rule containing juridical defect. This research is juridical normative using statute and conceptual approaches. It can be concluded that the absence of clarification of a village rule result in cancellation of law.
