Benardictus Octo Caesariano, Lutfi Effendi, Agus Yulianto Fakultas Hukum Universitas Brawijaya Email: [e-mail]  ABSTRAK Penelitian ini menganalisis penerapan Pasal 29 ayat 1 Peraturan Daerah Kota Batu Nomor 24 Tahun 2012 tentang Penataan Dan Pengendalian Menara Telekomunikasi Di Kabupaten Pasuruan. Di dalam Pasal tersebut mengamanatkan tentang pembangunan menara memiliki IMBM dari Bupati atau Pejabat yang ditunjuk setelah mendapatkan rekomendasi dari TP3MTB. Di dalam rumusan masalah menjelaskan : (1) apa penerapan dari pasal 29 ayat 1 PERDA No. 24 Tahun 2012 tentang penataan dan pengendalian menara telekomunikasi kabupaten pasuruan? (2) faktor yang menghambat dari pasal 29 ayat 1 PERDA No. 24 Tahun 2012 tentang penataan dan pengendalian menara telekomunikasi di kabupaten pasuruan? Melalui penggunaan metode penelitian yuridis empiris, yuridis sosiologis pendekatan penelitian. Jawaban dari rumusan masalah (1) pelaku usaha lebih memperlihatkan insfrakstruktur menara. (2) Hambatan dari Sumber Daya Manusia (SDM) dari Satuan Polisi Pamong Praja yang melakukan penertiban dengan penyegelan,penyitaan dan pembongkaran terhadap menara telekomunikasi yang belom memiliki IMBM. Kata Kunci: Penerapan Hukum, Peraturan Daerah, Satuan Polisi Pamong Praja, Dinas Penanaman Modal Dan Pelayanan Terpadu Kabupaten Pasuruan, Jawa Timur ABSTRACT This research analyses about the implementation of Article 29 paragraph (1) of the Local Regulation Number 24 Year 2012 on Planning and Control of Telecommunication Tower in Pasuruan Regency. This article regulates about the tower building should have Telecommunication Tower Building Permit (IMBMT) from Regent or designated public officials after get recommendation from the Team to Facilitate the Supervision and Control of the Construction of Telecommunication Towers (TP3MTB). In the research problem, it explains: (1) what is the implementation of Article 29 paragraph (1) of the Local Regulation Number 24 Year 2012 on Planning and Control of Telecommunication Tower in Pasuruan Regency? (2) what are factors that hamper the implementation of Article 29 paragraph (1) of Local Regulation Number 24 Year 2012 on Planning and Control of the Telecommunication Tower in Pasuruan Regency? This research uses empirical research method and sociological jurisprudence research approach. The answer of the research problems are: (1) businessmen focus to show tower infrastructures; (2) the obstacles from human resources, especially Pamong Praja Police Unit that keep in order through seal, confiscation, and demolition of telecommunication towers which do not have IMBMT.
