Fakultas Hukum Universitas Brawijaya Email: [e-mail]   Abstrak Dalam studi kasus penetapan hakim Pengadilan Agama Kabupaten Gresik dan Pengadilan Agama Kabupaten Wonosobo terdapat perbedaan dalam dasar pertimbangan hakim dengan dasar yang sama yaitu tidak saling cinta. pertentangan dengan Peraturan Pemerintah Nomor 9 Tahun 1975 dan Kompilasi Hukum Islam. Dimana hakim bertentangan aturan yang ada di dalam pasal 19 Peraturan Pemerintan dan pasal 116 Kompilasi Hukum Islam terkait alasan-alasan perceraian. Dijelaskan bahwasanya alasan-alasan perceraian yang dapat diajukan oleh seseorang untuk melakukan perceraian telah diatur secara limitatif dalam pasal-pasal tersebut. Namun disini hakim dalam dasar pertimbangannya mengabulkan permohonan gugatan cerai dengan alasan tidak saling cinta yang mana tidak diatur dalam undang undang. Bila melihat salah satu tujuan hukum adalah kepastian, maka hal tersebut tidak memberikan kepastian pada hukum. Kata kunci: putusan pengadilan, perceraian, pembatalan perkawinan, tidak saling cinta. Abstract A case study was conducted and it found that there is difference in term of basic consideration of the judge of Religious Court of Regency of Gresik and the judge of Religious Court of the Regency of Wonosobo regarding divorce suit that comes from the same reason in which the feeling of love between husband and wife is absent. This is irrelevant to Government Regulation Number 9 Year 1975 and Compilation of Islamic Law. The decision made by the judge is irrelevant to provision of Article 19 of Government Regulation and Article 116 of Compilation of Islamic Law on reasons of divorce. It implied that reasons of divorce have been limitedly regulated in those Articles, which is contradictory to the decision of the judge to grant marriage annulment because of the absence of love between husband and wife, in which this reason is not provided in the Articles. Furthermore, this is not consistent with the principle that implies that the purpose of law is to provide legal certainty. Keywords: court decision, divorce, marriage annulment, absence of love
