Every married couple longs for a child as an offspring and an heir. However, it is sometimes not realized; therefore they usually adopt a child to be raised and treated as their own biological child. Adoption in the Batak Toba community uses local adat law which does not have any strong evidence. As time goes by, theĀ child becomes an adult, raised by his adoptive parents. Then, his biological parents intend to take him from his adoptive parents. The research problems are as follows: how about the mechanism of adopting a child in the Batak Toba community, how about the position of an adopted child, adoptive parents, and biological parents in adopting a child underhandedly in Batak Toba community, how about the legal remedy of the adoptive parents when the adopted child is taken again by his biological parents underhandedly in Batak Toba community in Simanindo Subdistrict, Samosir Regency.
