ABSTRAK            Keadilan restoratif (restorative justice) adalah pemulihan bagi korban dan masyarakat oleh terdakwa sebagai pemenuhan kewajibannya karena menyadari akan perbuatannya yang salah. Dalam praktik di Pengadilan Negeri Pontianak terhadap kasus persetubuhan terhadap anak, ada ketidakpuasan atas putusan Hakim karena tidak mengakomodir keadilan restoratif padahal kasusnya memenuhi syarat untuk diterapkan keadilan restoratif. Sesuai hasil penelitian ada putusan hakim yang menerapkan keadilan restoratif seperti dalam kasus Chin Po Khiong alias Afat Anak Sin Cheng On namun ada juga yang yang tidak menerapkan keadilan restoratif seperti dalam kasus Triadi alias Ade Bin Safarudin. Direkomendasikan pengaturan konsep keadilan restoratif dalam Putusan Hakim sebagai perluasan makna alasan pemaaf sebagai dasar penghapus pidana. Sebagai alasan Penghapus Pidana, terdakwa Triadi alias Ade Bin Safarudin tersebut seharusnya dilepaskan dari tuntutan hukum sama dengan terdakwa Chin Po Khiong alias Afat Anak Sin Cheng On. Kata kunci: Keadilan Restoratif, Putusan Hakim, Persetubuhan Terhadap Anak. ABSTRACT Restorative Justice is restoration for victims and society by the defendants as fulfilling their obligations because they are aware of their wrong actions. In practice, at the Pontianak District Court especially in cases of sexual intercourse with children, there was dissatisfaction with the Judge?s decision because it did not accommodate restorative justice when the case is eligible for the application of restorative justice system. According to the results of research, there was a judge?s decision to apply restorative justice as in the case of Chin Po Khiong a.k.a Afat son of Sin Cheng On, but there were also those who did not apply restorative justice as in the case of Triadi a.k.a Ade Bin Safarudin. It is recommended the concept of restorative justice should be regulated in the Judge?s  Decision as an extension of the definition of forgiving reasons as the basis of criminal waiver. As the reason for the criminal waiver, the defendant Triadi a.k.a Ade Bin Safarudin should be released from the same lawsuit with defendant Chin Po Khiong a.k.a Afat son of Sin Cheng On. Keywords: restorative justice, Judge?s decision, Child Sexual Abuse.
