Rafiqa Awwalin Nastiti, Dr. Siti Hamidah, S.H., M.M, Shinta Puspita Sari, S.H., M.H Fakultas Hukum, Universitas Brawijaya Rafika.anastiti@gmail.com  ABSTRAKPenelitian ini dilatar belakangi oleh adanya para ahli waris yang memohon penetapan Pengadilan Agama terkait adanya salah satu ahli wari yang hilang untuk dinyatakan mafqud, setelah Pengadilan Agama menyatakan penetapan mafqud, kemudian para ahli waris membagi harta warisan sesuai bagiannya masing-masing. Beberapa tahun kemudian ahli waris yang telah dinyatakan mafqud oleh Pengadilan Agama tersebut kembali dalam keadaan hidup, berdasarkan latar belakang tersebut, kami mengerucutkan dalam dua rumusan masalah yaitu bagaimana upaya hukum yang dapat dilakukan oleh ahli waris yang kembali setelah adanya penetapan Pengadilan Agama dan apa akibat hukum yang terjadi terhadap pembagian harta warisan setelah ahli waris yang dinyatakan mafqud kembali lagi. Guna mempermudah analisis penelitian, penulis menggunakan jenis pendekatan yuridis normatif berdasarkan bahan hukum primer, sekunder dan tersier serta menggunakan metode pendekatan eraturan perundang-undangan dan pendekatan kasus. Sehingga hasil penelitiannya yaitu seorang ahli waris yang telah dinyatakan mafqud oleh Pengadilan Agama dapat mengajukan upaya hukum sebagaimana telah diatur dalam hukum dan yurisprudensi. Yang mana pihak yang merasa dirugikan dapat mengajukan (i) perlawanan, apabila proses pemeriksaan permhonan penetapa masih berlangsung di pengadilan, (ii) mengajukan gugatan perdata, (iii) mengajukan kasasi, (iv) mengajukan permohonan pembatalan penetapan Mahkamah Agung dan (v) mengajukan upaya hukum Peninjauan Kembali. Kembalinya ahli waris yang telah dinyatakan mafqud oleh Pengadilan Agama memiliki akibat hukum diantaranya akibat hukum terhadap hak dan kewajiba ahli waris mafqud yang telah kembali, akibat hukum terhadap status hukum harta waris, dan akibat hukum terhadap pembagian harta waris. Kata kunci: Penetapan, Ahli waris mafqud, akibat hukum.  ABSTRACT This research is motivated by the existence of heirs who requested the determination of the Religious Court related to the existence of one of the heir who were lost to be declared mafqud, after the Religious Court declared the determination of mafqud, then the heirs divided the inheritance according to their respective parts. But, few years later the heir who have been declared mafqud by the Religious Court returned alive, based on this background, the author pursed in two formulations of the problem such as how do legal effort can be carried out by the heir who returned after the establishment of the Religious Court and what is legal consequences to the distribution of inheritance after heir declared mafqud back again. In order to facilitate research analysis, the author uses a type of normative juridical approach based on primary, secondary and tertiary legal materials and uses the method of the statutory and case approach. So the results of this research are an heir who has been declared mafqud by the Religious Court can submit legal effort as stipulated in law and jurisprudence. Where the party who feels aggrieved can submit (i) resistance, if the examination process for the determination application is still ongoing in court, (ii) submit a civil lawsuit, (iii) submit an appeal, (iv) submit the request to cancel the determination of the Supreme Court and (v) submit Judicial remedies. The return of heir who has been declared mafqud by the Religious Courts has legal consequences including legal consequences on the rights and obligations of returned mafqud heir, legal consequences on the legal status of inheritance, and legal consequences on the distribution of inheritance.
