PELAKSANAAN TENTANG EKSEKUSI BUYBACK GUARANTEE ANTARA BANK DENGAN DEVELOPER DALAM KERJASAMA PEMILIKAN KPR (Studi Di PT. Bank Negara Indonesia Tbk Jakarta Kota)

Abstract

Fakultas Hukum, Universitas Brawijaya Email : farhazmi@gmail.com ABSTRAK Pelaksanaan Buyback Guarantee pada perjanjian kerjasama (PKS) antara developer dengan PT. Bank Negara Indonesia Tbk (Bank BNI) seringkali terjadi hambatan, oleh karena itu Bank BNI perlu menilai kualitas calon developer sesuai dengan kebijakan Bank BNI, yaitu “BNI dalam upaya untuk memastikan penyediaan dana kepada pihak terkait dan dalam jumlah besar telah sesuai dengan prinsip kehati-hatian”. Berdasarkan kebijakan tersebut, maka ada faktor lain penyebab hambatan. Permаsаlаhаn hukum yаng dikemukаkаn аdаlаh bagaimana pelaksanaan eksekusi buyback guarantee bila ditinjau secara yuridis dan bagaimana upaya untuk mengurangi risiko kerugian dari perjanjian kerjasama buyback guarantee. Penelitiаn yuridis empiris ini menggunakan pendekаtаn yuridis sosiologis, jenis dan sumber data dalam penelitian ini diperoleh dari wawancara dengan Nasabah Bank BNI, Developer, Manajer Credit Service, Pemimpin Kelompok CPM, dan Manajer Collection Bank BNI, serta data berupa contoh PKS, literatur, dan peraturan perundangan. Berdаsаrkаn pembаhаsаn, hambatan yang terjadi karena hal diluar dugaan berupa wanprestasi, seperti Developer mengalami kebangkrutan,  perizinan pembangunan tidak jelas dan Developer kabur. Upaya yang dilakukan Bank BNI untuk mengurangi risiko dapat dilakukan dengan pengecekan asosiasi pengembang rumah serta data di OJK, bila terjadi perselisihan maka dilakukan musyawarah selama 30 hari, bila tidak menghasilkan selanjutnya dilakukan penggugatan ke pengadilan negeri atau pengadilan niaga apabila ada 2 hutang jatuh tempo. Kata Kunci : Perjanjian Kerjasama, Kredit Pemilikan Rumah, Buyback Guarantee.  ABSTRACT The Implementation of the Buyback Guarantee in the cooperation agreement between the developer and PT. Bank Negara Indonesia Tbk (Bank BNI) often has obstacles, therefore Bank BNI needs to assess the quality of prospective developers in accordance with Bank BNI's policy, namely "BNI in an effort to ensure the provision of funds to related parties and in large amounts is in accordance with the principle of prudence careful ". Based on the policy, there are other factors that cause obstacles. The legal problem that is expressed is how the execution of the buyback guarantee is carried out judicially and how to reduce the risk of loss from the buyback guarantee cooperation agreement. This empirical juridical research uses sociological juridical approaches, types and sources of data in this study were obtained from interviews with Bank BNI Customers, Developers, Credit Service Managers, CPM Group Leaders, and BNI Bank Collection Managers, as well as data in the form of cooperation agreement examples, literature, and regulations legislation. Based on the payment, the obstacles that occur due to unexpected things in the form of defaults, such as Developer bankruptcy, development permits are unclear and Developers run away. Efforts made by Bank BNI to reduce risk can be done by checking the association of home developers as well as data in the OJK. If there is a dispute, then a 30 day consultation is held, if it does not result then a lawsuit is brought to the district court or the commercial court if there are two debts due.
