Abstract

This study aims to develop the concept of consumer contracts from the philosophical perspective of Pancasila in Indonesia to achieve the legal objectives of legal certainty, justice, and legal benefits. The research is formulated to question how to conceptualize consumer contracts from the philosophical perspective of Pancasila. By using doctrinal research, this study concludes that consumer contracts in Indonesia do not meet the values of Pancasila. Therefore, the article attempts to conceptualize the consumer contract by offering communal principles to realize mutual benefits between the parties in a consumer contract without ignoring the special characteristics of the nation that existed before the independence of the Republic of IndonesiaKeywords: Consumer Contracts, Pancasila Philosophy.Rekonseptualisasi Kontrak Konsumen dalam Perspektif Filosofis PancasilaAbstrakPenelitian ini bertujuan untuk mengembangkan konsep kontrak konsumen dari perspektif filosofis ideologi Pancasila di Indonesia untuk mencapai tujuan yaitu kepastian hukum, keadilan, dan kemanfaatan hukum. Penelitian ini dirumuskan untuk mempertanyakan bagaimana mengkonseptualisasikan kontrak konsumen dari perspektif filosofis Pancasila. Dengan menggunakan penelitian doktrinal, penelitian ini menyimpulkan bahwa kontrak konsumen di Indonesia tidak memenuhi nilai-nilai Pancasila. Oleh karena itu, pasal tersebut berusaha mengkonseptualisasikan kontrak konsumen dengan menawarkan prinsip komunal untuk mewujudkan saling menguntungkan antara para pihak dalam kontrak konsumen tanpa mengabaikan ciri khas bangsa yang ada sebelum kemerdekaan Republik IndonesiaKata kunci: Filosofis Pancasila; Kontrak Konsumen
