Salah satu sengketa yang muncul adalah proses diskualifikasi petahana yang diduga melakukan pelanggaran dalam pemilu. Proses sengketa diskualifikasi kepada petahana masih ada berbagai masalah dan pendapat tentang norma-norma yang berlaku. Masalah-masalah ini termasuk bagaimana memeriksa tuduhan pelanggaran yang dilakukan oleh petahana; bagaimana keputusan KPU memproses pemeriksaan tentang diskualifikasi petahana. Oleh karena itu perlu dikaji secara mendalam pola dan pemeriksaan yang bertujuan untuk memberikan keadilan dan kepastian hukum penyelesaian sengketa pilkada.The principle of the implementation of the local election must be able to protect the legal rights of the parties concerned in the election especially in the event of a dispute.
